Zoning/CCR Restrictions and DirectTV

Hello, all...

We've purchased a home in a newer subdivsion, and the CC&Rs have a
restriction against satellite dishes, antennae, etc. It seems to me
that there is a right to receive federal law that would supercede this,
but i can't remember what it is...i do remember something about it from
when I had my Big DisH...Can you all help?

Others have posted the location of FCC information, so I won't
waste your time doing it again. However, I'll relate our experience.

We also recently moved to a CC&R community, with specific
restrictions against dishes. Our community has an approval process
for any architectural changes to the property, so I just submitted
an approval request for the dish.

The request was approved within 5 days, with the only stipulation
that it be shielded from view from the street by shrubbery. (This
stipulation is allowed by the FCC as long as the cost of
implementation isn't unreasonable.)

We put the dish up, shielded it with inexpensive decorative sea
grasses, and everybody's happy.

Moral of the story? Just Ask - they'll probably say yes! It
seems most of the community management companies and Homeowner's
Associations (at least in Florida) are aware that these CC&R
stipulations are unenforceable, and don't even bother to try.

And the dish limitation stays in the CC&R's because (1) maybe it
will deter the uninformed, and (2) it costs money (sometimes LOTS
of money!) to have the CC&R modified to remove it, with no benefit
to the developer or Homeowner's Association.
