Tell them to contact your attorney. If the facts are as you state, you never
had a contract for the cruise.

Since your credit card was never charged, you never had a binding
agreement. No "consideration" was ever received, therefore, no valid
contract ever existed.

Tell them to stuff it. If they choose to continue, wait for something
in writing and then request to see a valid contract.

You have nothing to fear from these people, other then minor harassment.

If the original payment for the booking was never made, the 7 day hold
would have expired. That should have been the end of the story.

I think the person needs to explain that the deposit was never paid and
no booking was ever made. All that happened was that a cabin was put on
hold and that hold was allowed to expire. No payment of $100 should be
due for that.

Well, the agency said they would call me to discuss this further on Tuesday,
but so far I haven't heard from them at all.

You do not owe this agency or anybody there anything at all. Not even an
explanation. Sounds to me like they are desperate and are trying to bully you
into sending money.

We have a guy here on the West Coast that does the same thing, charges a Fee to
people when they change their mind but does not tell them that up front when he
gets the Credit Card number. One of these days he is going to get too bold and
wind up in jail.

If they continue to harass you ask them to send everything in writing, in
duplicate, because your District Attorney has requested a copy. That should dry
things up.

If your credit card was not run then that means you did not have a booking
so how can they take something for you that is not there? Crazy! I would not
worry about it!
