Well, he did stir up a firefight, I'll admit that. And Robb and
Elissa are getting some great support and positive feedback from all
the people jumping to their defense, so if they wondered if people
liked their videos, now they know that they definately do. So yeah,
some good came out of this, but it was inspite of the troll, not
because of him.

I've only seen 1 Alvey/White video at a friends house. I think it was
the ACE trip to Europe in 2002. It was quite enjoyable.
Lot of good, clear ride & park footage.
The music was good. My only concern was some of the scene's needed to be
a few seconds longer....but there's only so much you can fit on a tape.
There were some kissy scene's between Alvey & White, but that just added
a little personal touch to it.
I couldn't tell who Alvey's gay friends were in this European video, but
some of the boys constantly being filmed were quite funny. Even the
dude bothering that one sheep was a laugh. So the video also had a
comedy aspect to it as well.
As for Alvey being older than White..who cares ! If the relationship
works for them, great..Age doesn't matter. Theres lots of people in the
world with partners 10, 15 20 years older or younger than themselves.
What you said about White needing to eat something, well I'm sure she
eats. She's petite and petite girls are usually small boned and thin. I
don't know the girl personally but have seen her at a few parks and as a
40 year old male I think she looks damn fine and I'm envious of Alvey.

Personally, it's the PEOPLE in Robb's videos that are the reason I like
them so much (and not just because I'm one of those people!)
Personally, I'm not a huge fan of the videos that focus on just the coaster
rides, esp. POV shots. There have been tons of them. They were fun at
first, but now they're old to me. It's juts not the same as riding the
things anyways, so why bother? If I want to simulate the experience of
riding the coaster without any of the forces, I can play No Limits on my
computer. On that, I can even look around!
But you have to admit, few people have been able to capture the feel of a
day at the park with friends like Robb has (now with Elissa, too.) Whether
it's just a day of Robb and Elissa and maybe a few friends, or it's a big
event like Stark Raven Mad, you really feel like you get the whole
experience of a day at the park with their videos. And that's what I like
most in coaster videos. Whether you like the people personally, or not,
you have to admit that their videos are very well done. And they even make
footage videos for those who like those kinds. (Personally, I've only
bought one of the footage videos: the one from the ECO trip, as a souvenir
of parks I won't be back to soon.)
no one here really knows me since i have no time to go to different
coaster events..but i bought the videos a few weeks ago..well just
sent the payment yesterday..i loved them..they are great..gives me a
chance to see the parks that i have not been to yet..which are a lot
of them..so thank you robb and elissa for putting together some great
videos which was compieled obviously from alot of footage..maybe this
year i can get to PPP.

Thanks Dan! It's always been my policy since day one! Becase they are our
'home movies' and I know that might not be everyone's 'thing', and I didn't
want to dissapoint anyone or think they were being 'tricked' into getting a
"Discovery Channel" type video. Since it's a home-made project for fun....if
someone else couldn't share in the fun or understand it, why should they pay
for it? The $10 really just covers our cost of materials, postage, and our
time (which seems to be all of our free time lately!) The honor system seems to
work out pretty good...not too many deadbeats, and we're willing to take that
risk really to show it's not about the money, it's about the fun! If we were
in it for a profit, I'm sure we could easily get $20 for them, but it's not
about that.

The sad thing is, I wouldn't put in past the RIAA to do that to you.
They exist basically to bully people. I mean, really, the royalties
you would owe for all the videos you've ever made would be, what, $20?
Royalties are based on the audience size. Of course, radio is exempt,
since they are basically in cahoots with the record industry. And,
since internet stations apparently aren't, the RIAA is trying to rid
the world of them. I'm sure Clear Channel sends in a check quite
often to help destroy the internet radios.
If the record industry wasn't so fucking greedy, maybe piracy wouldn't
be so rampant. And, if the software industry didn't tack on spyware,
or release bug-riddled games and programs, perhaps folks would be more
apt to pay for them.

are you so blind to all the emphasis the riaa puts on length? if you're
effectively reproducing the whole of copyrighted piece of work, fair use
arguments get that much tougher. it can't be enough that you're affecting (or
not) the market. you've also got to somehow justify the active distribution of
reproductions and prove that you're not engaging in a for profit venture.
remember, there's a mighty fine line between that which is for profit and that
which is not, and it's not whether you actually make a profit. i really don't
believe your use would qualify as any sort of "fair use," at the very least
because you're engaging in distribution. this isn't to say that i believe
you're inappropriately using copyrighted works. but that's because of my
feelings on what's appropriate.

Robb and Elissa's videos actually inspired me to edit my own video on
a Disney World convention. I studied their tapes to figure out how
it's done. My video has gotten great reviews by those who have seen

response from the "masters." I suppose they are busy planning a
wedding.
As for their age difference, who really cares? They both enjoy each
other's company and they both like roller coasters. Who else has a
significant other who has so many similiar interests?

I realize that after reading what I wrote. I stooped to the same
level as the troll, and I kick myself now for doing it. However, I
feel I need to clarify my situation here. I've been reading all the
character attacks on Robb and Elissa lately, and it's been getting
VERY old. An attack on a friend of mine is an attack on me, so I take
it personally. A person can only take so much before he blows his
top, and that's what made me post a tirade like that. You singled me
out for being immature, and yet you mention nothing of the attack on
Robb and Elissa from the original poster? I take offense to that,
especially since that type of post from me is VERY irregular. As I've
said before, I usually hold my tongue when it comes to this crap, but
I've had enough. Telling me to grow up after only reading one of my
posts doesn't seem very mature of you. It seems like an attack on my
character, and that pisses me off. I feel I've been very mature in
most of my posts here on the newsgroup, regardless of the topic. One
profanity-filled tirade doesn't make a person immature, just look at
all the crap that gets posted here by certain people ALL THE TIME.

Not true.
There's a pre-commitment to royalties that has to be met to even use the
songs. Think of an escrow account. Think thousands of dollars --
depending on the copyright holder (like Harry Fox Agency who owns the
lion's share of published music).
The truth is that someone like Robb couldn't meet those obligations,
even if he wanted to. Nobody would take him seriously, or the barriers
to get the rights to use the music he did choose would prevent him from
legally using the music.
That said, his arguments of "fair use" are utter nonsense. And, he is
charging the price he does to make a profit. So, he is absolutely
breaking the law by doing so.
(I work for one of the biggest record companies in the World, in case
anyone wonders where I get my information).
I'll reiterate what I mentioned months ago -- don't charge for the
videos. If you really want to "share" your home movies with friends,
then you should not charge for them. Or, donate reimbursements for
production to a charity. Or better yet, choose unpublished music from
great artists at FarmClub.com or MP3.com
It all just comes down to a moral decision. Do you profit off the blood,
sweat & tears of somebody whom you are not sharing the profit? I
certainly wouldn't, but that's just the way my moral compass points.
Would the videos you make be half as enjoyable with "Joe's Garage Band"
instead of "Blink 182?" Well, that's the ultimate test of your filmaking
ability.
Personally, I use published artists in my videos because the music and
the familiarity of the songs make the video more enjoyable to me. The
difference is, I wouldn't give a moment's thought of charging someone to
have to a copy, if they wanted to see it. That's precisely where you
cross the line from the gray area of "fair use" to the black & white
area of "copyright infringement."

I work at a radio station and we have to pay about 2% of our net sales to
ASCAP/BMI, I don't know what they would want Robb to pay if anything,
individuals may only be rated by profit.?

For the four-letter words, I don't deny that it was a bit much but I also
know that this isn't like Justin and when I read the comment, I let it go at
that. This troll happened to get to several people pretty well and Justin
was one of them.
It wasn't so much of an actual apology as a phrase of speech. Perhaps a
better choice of words would have been better. It's always interesting
trying to express emotions across the 'net ;)

Are you *sure* Rob "gets legal" merely by not charging? The song
owner still could say, "Hey, it's MY song and you are using MY
property and giving it away. I can't come into your home, get a
beautiful, popular painting and go display it to the world and hide
behind the I'm-not-charging-for-it excuse." All that said, before I
get flamed, I realize this is hardly "substantive". But, per the
strict letter of the law, my guess is that not charging means nothing.
It's still not his music. My purpose in asking, however, is NOT to
explore the morality of this, but just to learn the exact nature of
the law.
If Rob ever wants to comply with the exact letter of the law (that is,
IF, IF I'm right), surely there's a coaster enthusiast somewhere in
the corporations that own the rights that could "run this through" the
Legal Dept. and get Rob the necessary waiver.
For the record, I enjoy his videos and find them VERY useful in

When I contacted MPL , the first contact went great, but my telephone call
was never returned. I wanted so use a piece of music legally, and pay for it
, oh well , my guess is that the artist cares more about his profit than his
true fans.
When it comes down to the RIIA , they should be regulated to the hilt along
with the record companies. I can tell you , if I have the chance to talk to
my elected officials in Washington , in person , my first comment will be on
what the record industry is up too. This is a industry that needs a lot of
oversight , copy coding CD's , what's next , pay per play. Think MP3 , it
has the ability to be coded for pay per play , just like record industry
would like to see.
25 cents per play , you purchase the album , then you have to pay for every
play. Don't think that the industry wouldn't do that. When they went after
Napster , they were worried about one thing , and one thing only, the
backlash , that's the only thing that keeps this tiger under wraps.
Sorry everyone , when it comes down to the Record Industry, I don't trust
them as far a I can throw them. I do want to make sure that the artist gets
his piece of the pie from any production that I do , but don't make it so
impossible that I can't do things legally.

All the BS aside , Robb and Elissa managed to capture pretty close to
everyone of us that were on the UK\Europe tour. I couldn't have done any
better myself. Did Robb and Elissa capture UK\Europe trip essence , in my
opinion yes. I watch the tape and enjoy the music and video and editing. I
see all my friends in ACE on this tape , and the tape captured the trip in a

Like I mentioned, the "charging for profit" aspect puts him into very
definitive violation of royalty agreements under the jurisdiction of
laws such as those dealing with copyrights.
There is a "gray area" of fair use that, IMO, would keep him out of
trouble if he stopped charging for the videos.
Royalties are my job. I am responsible for systems that pay out millions
of dollars in royalties on a monthly basis to some of the world's most
well known artists. I'm not a lawyer, but having to master the "business
rules" of what's involved, I'd like to think that I know where some
things lay in the legal spectrum in regards to royalties.
The RIAA is a just a watchdog group. Why do they need regulation?
They're essentially just lobbyists.

"Record Industry" is a compound subject. It includes a) artists b)
record companies that develop artists (fund) c) record companies that
distribute media d) publishers who own "rights" to songs and e) watchdog
groups like RIAA, ASCAP, etc.
The problem is, you can't just "give" an artist his/her money and be
done with it. That's not the system. Many (ok, most) artists trade all
rights to their music in exchange for funding of studio time, media
generation, promotion, tour support, and distribution. They lose most of
their rights the minute someone like David Geffen presents them a
contract. There are alternatives -- I spoke with Todd Mohr from Big Head
Todd recently and he told me how they had to wait out their record
company dying (bankruptcy), just to get the rights to their music back.
When they did, they decided to be their own label. They shrewdly inked a
deal with Warner to just "distribute" the media. In doing so, they
retain a larger piece of the pie and control their own destiny. But, it
takes money, and it takes negotiation, and it takes proven sales to get
to this point.
Last night, I spoke with Mike Gurley from Butterly Jones/dada. He told
me how they've been in a legal fight with MCA about rights to 10
leftover songs from their last album that they want to put out. MCA is
sitting on them. There's literally nothing that can be done outside the
courtroom. dada is stuck in limbo. They can't even shop a new deal. They
can't even put music on their site for free under the name of dada.
The point is, there are many hands in the pot. The artists largely don't
control their own destiny. Even if they wanted to permit someone to use
a song in a video, their hands are tied. You need at least 3 entities to
agree on doing so, and to agree separately on renumeration. Not likely,
at least not without people working in an agent for you trying to secure
all the rights. It's precisely this point that would prevent a small
timer like Robb to legally secure rights. It ain't gonna happen.
It's a bad system, and you can see how CDs are so expensive (especially
adding in the retailers markup -- you have at least 4 hands in the pot).
So, while some record companies are very bad, it's not always their
fault, or just their fault that CDs are expensive and rights are hard to
come by. There's plenty of blame to go around. I'd say the publisher is
usually the most wacko of the parties -- Yoko Ono is/was a prime example
of a holder of publishing rights. Remember that Michael Jackson also
bought into Beatles publishing rights at some point.
Believe you me, Napster didn't scare the industry because of backlash
per se. It identified two things: a shift to a new media distribution
(digital), and it raised the question of how to make that shift and how
to secure those files from piracy. MP3 cannot be secured. It's the
reason that PressPlay, for instance, decided to go with the WMA format.
WMA includes DRM (Digital Rights Management) at its core.
There's a potential bigger problem with the shift to digital
distribution: You now have another hand in the pot -- Microsoft in the
case of WMA. Whatever standard develops -- MP3, WMA, Liquid Audio, Ogg
Vorbis, etc., you can be assured that "licensing fees" for the owner of
that format will be tacked onto the price of the download.
Optimistically, I think the industry is moving towards a $.99 download a
song from Amazon type setup. I think that's good. I've long advocated in
my company that the real way to beat Napster/Gnutella/Etc. is to offer
a) cheap enough tracks that you wouldn't waste your time stealing it and
b) excellent quality tracks that you frequently cannot get on the peer
to peer networks.
I want to use a song legally on a coaster video, and yes it might get shown
in public. I want to make sure that the artist gets his money for the use,
because his music was displayed in public. There is no clear cut way, like a
one stop shopping process like, BMI/ASCAP that I as a private person can go
to get legal permission from.
Mike as you pointed out, it's a pretty bizarre system that does a disservice
not only to the artist, but also to others that would like to use commercial
music legally.
You will have to forgive me ; I always thought that RIAA was a cheerleader
for the Record Industry.
On the Napster issue, the papers in my area covered the story with a little
more in depth reporting, it was a local story. At the time that Napster was
having issues with the record industry, the record industry spokesperson
eluded that they wanted to tread lightly; they didn't want to set off a
backlash against the industry. There have been 2 backlashes against groups
and the industry, one being the Beatle record burnings in the 60's, and the
Disco Sucks record burnings of the 70's.
There's 3 things that I have a bones of contention with the record industry.
1.) Digital Copy Coding of CD's. I like to compile music from CD's and Tapes
and Records on to a burnt CD, that way I'm not looking for multiple formats,
and I'm not fiddling with handfuls of CD's while I'm driving my car, or
fiddling with a controller while driving.
2.) Public Use of Commercial Music. I want to make sure that the artist gets
his money if I use his music. If I have plans to show a production of mine
in public with commercial music, I want to make sure that I have paid for
the showing. Here's where I say, give me one stop shopping.
3.) Internet Radio Streaming. I liked being able to hear to of my favorite
out of area radio stations on my computer. When I travel the northeast, 2
radio stations are usually tuned in on my radio, WMAS Springfield MA, and
Jersey 101.5 on the Weekends. That all changed when the Record Industy and
SAG put a stop to streaming.
What got me to really pay attention to the industry was the killing of radio
streaming, it sent up one hell of a red flag with me.
This is one industry that should be closely monitored, if not regulated.
Here's 2 reasons for regulation, Payola scandal of the 1980's, and the
recent price gouging the record industry did in the 1990's. That's why I
call for a regulation to the hilt on this industry, it needs it.
I play 3 musical instruments, as well as write songs, so I do believe that
the artist should be compensated. I think that the music industry should
follow the lead of the amusement industry , you must be proactive and show
that you are fairly balancing everyone's intrest , and not just the bottom
line.

To be honest, I think they're already to late for that. People aren't
burning records this time, they're burning CD's. (Ooh, that was clever of
me!) But seriously, they are making their statement by not buying music
any more and downloading it instead.
I know that at least one major music chain in the Boston area is already
warning their employees that they will have to start to focus on other pop
culture items or they may end up out of business. They already have plans
to downsize to stay in business. And they say that a lot of this is
because of CD-burning.
A whole lot of people are pissed with the music industry for a whole lot of
reasons, some of them legitimate, some of them not.
In the end, I think that a lot of people still would have downloaded music
if they could get away with it without paying for it. But the actions of
the industry in recent years have given people a reasonable justification
to do so and not feel guilty about it.
And it's very possible that it may be too late to change that.
If the industry was smart, they'd make a million concessions to their
customers before it's too late. While they may make less money, they'll
still be in business. And if they don't watch out, a whole lot of record
labels will be going out of business. Quite a few already have.
My personal bone of contention is how the industry tries to force us to buy
albums when the truth is that most of us want SONGS. I don't want a whole
album. I like particular songs. Why should i have to pay for 10-12 songs
when I only want one? They know this, and that's why they've stopped even
MAKING singles for most songs they are pushing on the radio.
Now they're trying to get us to buy whole albums by only offering the
remixes of certain songs as a "bonus" CD with an album. I'm sorry, I love
the Hex Hector remix of Deborah Cox's "Mister Lonely", but I'm not paying
$15 for it! Yes, I'm technically paying for the album, but I don't want
it. I won't listen to it. Besides, I had the mix for like 4 months before
they released it as part of the album pack.
And more specifically, I want DANCE songs, and remixes. And all too often
the industry completely refuses to even release them. They'll make some
promo copies on vinyl (and now sometimes on CD, mostly for radio stations),
and yes, you can usually buy those at some stores. But technically it's
not even legal to buy those, so it's pretty much the same thing as
downloading the song.
At this point, even the leaking of songs on the net is becoming a part of
the record industry's marketing strategy. Then they slam the people who
download it! A friend of mine was at a club recently and was talking to a
rep for the singers who were there. They blatantly told him that the song
would be leaked online a few weeks prior to the single's release.
Then they call us criminals for downloading the songs that THEY are
providing?
In some clubs these days, as many as half the songs that the DJ's are
playing are songs that they have downloaded because they cannot legally buy
the songs. And the DJ's who are obeying the law are losing their jobs
because they are behind the times!
By the time the industry even decides to release a lot of songs, many of us
are already sick of them. I download good remixes of good songs. If they
are commercially available, I'll buy them. I'd like to keep remixers like
hex Hector and Thunderpuss in the business. If I no longer want to hear it
enough to justify paying $6+ for a CD single at that point, I won't buy it.
I'm trying hard to think of the last time I bought a CD.
Two of the top 5 songs on the billboard club play chart this week are not
commercially available. One of them is an import you're technically not
supposed to be able to buy in the US. 4 of the top 8 songs on the
Billboard Hot 100 chart are album-only cuts.
And they wonder why I don't buy much music any more?
And to keep this on-topic, one of the two dance songs that you CAN buy is
Emotional Rollercoaster! ;-)

I agree with what you've said, David.
The silver lining in all of this is that digital distribution should
make more music available to a wider audience. The barriers to entry for
digital distribution are minuscule compared to what it took to produce
and distribute a physical product like vinyl or a CD. You're already
seeing it. MP3.com has over 200,000 artists that offer downloads,
streams, and on-demand CD purchases. That's 200,000 artists you probably
would never have been able to become exposed to prior to digital
distribution. Believe me, it scares the shit out of the industry. After
all, it's an industry that favors "style" more than "substance."
CD burners have also opened up all kinds of avenues for artists.
Formerly the playground of the big boys, CD's can cheaply be made and
sold at concerts, websites, etc. by any unsigned artist. I was at a show
the other night, and there were 3 opening bands. All 3 had CDs for sale
at the front door. Yeah, it may have been tapes before that -- but not
as good quality and certainly not as cheap.
My point is that it's getting better. It already is better if you have
the drive to seek out music. That may be the biggest stranglehold on
consumers -- they only are exposed to what the record companies who
promote want them to see -- you may not see the Linkin Parks of the
world because it's crap like Backstreet Boys and Jennifer Lopez that
rings the registers after all that style is packaged and bombed on an
unsuspecting public.
Linkin Park, for example, was denied record contracts at every major
label. Three times over. They got smart -- they self produced some
music, threw it up on sites like UBL and MP3.com, and when the following
quickly came, record companies were falling over each other to sign
them. And LP shrewdly inked a deal that was favorable to them, to their
publishing rights, and sets them up to do what they want. It's precisely
"digital distribution" that leveled the playing field for them. "Hybrid
Theory" was the top selling album of 2001, IIRC. Not bad for a band that
saw nothing but shut doors, took digital distribution by the horns, and
created their own destiny.
As for the music you like, I'd imagine that being a very niche product,
the major labels won't touch it. But, who's to say that the dj's and
remix guys won't start selling their stuff digitally?
