FCC Deletes KDND Sacramento License

The FCC has denied a Petition For Reconsideration and Application For
Review filed by former 106.5 KWOD owner Ed Stolz and has deleted the
license for 107.9 KDND Sacramento.

Stolz, who has been battling Entercom to have his 1996 sale of then KWOD
(now 106.5 KUDL and home to the former KDND programming) rescinded for the
past two decades sought to have his case added to the license revocation
proceeding so that he could have KUDL turned back over to him and also
sought to have all of Entercoms other Sacramento station licenses revoked.
The FCC ruled against his petitions seeing no merit to his arguments and is
not a party of interest in the dispute between Media Action Center and
Entercom that led to the license revocation hearing.

Update 2/3: With the CBS Radio merger now its top priority, Entercom has
decided to turn in the license of CHR 107.9 The End KDND Sacramento rather
than have the hearing hold up its CBS deal.

Entercom released a brief statement saying.

Entercom has submitted a public filing today voluntarily turning in license
to operate KDND in Sacramento to facilitate the timely FCC approvals for
the planned combination with CBS Radio.

While, the 107.9 license will be shut down on Wednesday, February 8 this
will not mean the end of the End format. The End will move en-masse to what
is now Hot AC Star 106.5 KUDL on Monday, February 6 at 9:00am. That would
also be a slap in the face to petitioner Ed Stolz who has long been
battling Entercom to have his 1996 sale of 106.5 for $25 million rescinded
after a case of sellers remorse.

Once turned into the FCC, the 107.9 license will be dark until the next FCC
auction when it will be put up for bid. When the FCC pulled the licenses of
Contemporary Medias five stations including 98.3 KFMZ Columbia MO and 107.5
WZZQ Terre Haute IN in 2001 following owner Michael Rices conviction on
child molestation charges, his legal challenges kept the stations out of
auction and off the air for a decade and a half. 98.3 only returned to the
air in November 2016, while 107.5 Terre Haute was reclassified as a
non-commercial allocation is still a Construction Permit held by Terre
Haute Seventh-Day Adventist Church. Entercom will not challenge the
revocation of the licenses but it will still be 3-5 years minimum before
anything returns to the 107.9 frequency.

Original Report 10/27/16: The January 2007 Hold Your Wee for a Wii contest
at Entercom CHR 107.9 The End KDND Sacramento that led to the death of
Jennifer Strange could lead to the loss of the stations license as the FCC
has scheduled a hearing proceeding before an Administrative Law Judge to
determine whether the stations license should be renewed.

On January 12, 2007 the stations Morning Rave morning show held the contest
where listeners had to drink as much water as long as possible without
urinating to win a Nintendo Wii video game system. Jennifer Strange had
finished in second place during the contest but after returning to work
that day died from water poisoning. Program Director Steve Weed (now SVP
Programming for iHeartMedia Central California), morning hosts Steve Maney
(now at WNKS Charlotte), Lukas Cox (now at KRBB Wichita), and Trish Sweet
(now Jayde Donovan at WPLJ New York) and six others were swiftly fired. In
2009 Stranges husband won $16.5 million compensation in a wrongful death
lawsuit against Entercom.

Now the consequences will be much higher. KDNDs license renewal filings in
2005 and 2013 will be heard by a judge to determine whether Entercom will
be able to continue operating the station after petitions to deny from
Media Action Center and Ed Stolz and an informal objection by Roger Smith.
The FCC states that Based on the totality of the evidence, there are
substantial and material questions of fact as to whether Entercom: (i)
designed and conducted a contest that was inherently dangerous; (ii)
increased the danger to the contestants by changing the announced Contest
terms; (iii) was aware of the potential dangers of the Contest and water
intoxication; (iv) failed to protect the contestants from the potential
dangers of the Contest; (v) failed to warn the contestants of the Contest’s
potential dangers; (vi) prioritized entertainment value over the welfare of
the contestants; and (vii) failed to conduct adequate training and exercise
appropriate supervision of Station KDND employees and the Contest to ensure
the safety of the contestants.

The renewal hearing will be held within nine months of todays order.

Negligently causing the death of a member of the Station’s listening
audience, as the jury found of Entercom at the Trial, appears to be prima
facie contrary to the public interest. Accordingly, we are unable to make
the finding required by Section 309(k)(1)(A). We therefore designate
Entercom’s license renewal Applications for hearing in order to develop a
more complete record and provide Entercom with an opportunity to raise
additional facts and circumstances, including those not related to the
Contest, that may be relevant to our public interest determination. In
addition, we specify that the hearing proceeding will commence no later
than the first business day after the nine-month anniversary of the release
of this Order. We further expect that the Presiding Judge and the parties
will move through this case expeditiously and that, upon conclusion of the
hearing, the Presiding Judge will make all reasonable efforts to issue his
Initial Decision on an expedited basis.

Accordingly, IT IS ORDERED that, pursuant to Section 309(e) of the
Communications Act of 1934, as amended, 47 U.S.C. § 309(e), Applications
for Renewal of License for KDND(FM), File Nos. BRH-20130730ANM and
BRH-20050728AUU, are DESIGNATED FOR HEARING in a proceeding before an
Administrative Law Judge in Washington, D.C. to be commenced no later than
the first business day after the nine-month anniversary of the release of
this Order, upon the following issues:

(a) To determine whether Entercom designed and conducted a contest that was
inherently dangerous;

(b) To determine whether Entercom increased the danger to the contestants
in the “Hold Your Wee for a Wii” contest by changing the contest terms;

(c) To determine whether Entercom was aware of the potential dangers of the
“Hold Your Wee for a Wii” contest and water intoxication;

(d) To determine whether Entercom failed to protect the contestants of the
“Hold Your Wee for a Wii” contest from its potential dangers;

(e) To determine whether Entercom failed to warn the contestants of the
“Hold Your Wee for a Wii” contest of the contest’s potential dangers;

(f) To determine whether Entercom prioritized entertainment value over the
welfare of contestants of the “Hold Your Wee for a Wii” contest; Federal
Communications Commission FCC 16-153 35

(g) To determine whether Entercom failed to properly train and exercise
appropriate supervision of Station KDND(FM) staff and the “Hold Your Wee
for a Wii” contest to ensure the safety of the contestants;

(h) To determine, in light of the evidence adduced under the foregoing
issues and the totality of circumstances, whether Entercom License, LLC
operated Station KDND(FM) in the public interest during the most recent
license term; and

(i) To determine, in light of the evidence adduced under the foregoing
issues and the totality of circumstances, whether Entercom’s Applications
for Renewal of License for KDND(FM), File Nos. BRH-20130730ANM and
BRH-20050728AUU, should be granted.


The FCC has concurrently dismissed Stolz challenges to Entercoms license

John Madden Returns To KCBS

Longtime NFL coach and analyst John Madden is resuming his twice-weekly
football analysis and commentaries on CBS News 740 KCBS/106.9 KFRC San
Francisco.

Madden had been heard on KCBS from 1997 until health issues led to his exit
in November 2015. His commentaries will be heard live on KCBS/KFRC at
9:15am on Mondays and Fridays and be shared as a podcast on Radio.com. The
81 year old Madden continues to be known nationally mainly for the video
game that shares his name, but has mostly been out of the public spotlight
since leaving NBCs Sunday Night Football in 2008.

Today, KCBS RADIO announced that the legendary Coach and Pro Football Hall
of Famer John Madden has returned to ALL NEWS KCBS 106.9FM | 740AM Mondays
and Fridays live at 9:15 AM, PT. His first day back on air was today,
Friday, September 8. Each report features Madden’s signature style football
analysis and candid sports commentary. The live segments air with several
repeats throughout the day and are also available on kcbs.com and
Radio.com. John Madden previously hosted live morning drive sports reports
on KCBS RADIO from August 1997 through July 2016.

“With the start of football season, I thought it was the right time to come
back to radio. I am excited to be back with KCBS,” commented Madden.

Minnesota Vikings in Super Bowl XI. His winning percentage (.750) is the
best of any head coach in NFL history. John Madden has been honored by The
National Academy of Television Arts and Sciences with 16 Outstanding Sports
Personality/Analyst Emmy Awards and in recognition of his coaching career,
and was inducted into the Pro Football Hall of Fame in 2006. His popularity
expanded with the EA Sports Madden NFL video game franchise launched in
1988. Madden also worked as a color analyst for all four major television
networks including CBS, FOX, ABC, and NBC.

Your Summer Song And My Summer Song

It’s interesting that I’m still getting e-mails, tweets, and other
communications from readers asking me when I’m going to name my Song of the
Summer. Maybe, in their busy lives, they missed that moment where I
knowingly went entirely off the grid and gave it to “Praying” by Kesha.
Maybe it’s their way of saying “for real, though.”
I’ve been ready for the last month to write the column acknowledging that
“Despacito” is, at the very least, the Record of Summer 2017. If it were
just the song that I’d heard the most for the last two-thirds of summer, it
would be Shawn Mendes’ “There’s Nothing Holding Me Back.” But “Despacito,”
by claiming the summer crown for a song (largely) in another language, was
clearly more of an event and cultural signifier. “There’s Nothing Holding
Me Back” was a big hit record, but never phenomenal.
If it were the song I’d heard most this summer altogether, it would be Zedd
& Alessia Cara’s “Stay.” It was really a spring hit. It didn’t particularly
have the right feel to me. But it was the unavoidable song of Memorial Day
weekend, and took the entire summer to fall out of the top 10. Then again,
with CHR’s current emphasis on recurrents, the lingering spring hit may end
up being the biggest hit of every summer.
If it were the song that readers most scolded me for excluding, it would
probably be Sam Hunt’s “Body Like a Back Road.” I never wrote about it as a
Summer Song 2017 contender because of tempo, but those considerations have
long gone out the window. Clearly, Hunt is phenomenal. Like Taylor Swift a
decade ago, Country PDs torture over his role in the format. But he is
Swift’s truest successor as the “I don’t usually like Country, but I love
_____” artist. And there were still multiple votes for “Body” at summer’s
end, when I took to Facebook to ask readers for their Summer Song 2017
choices.
If it were the record I enjoyed most on the radio this summer, it would be
Calvin Harris’ “Feels.” As with much of Harris’ worthy output over the last
year, “Feels” never quite reached the undeniable heights of its
competition. But it still got several reader mentions. “If ‘Feels’ had come
out a few weeks earlier, it would have won the summer,” wrote Jay Lawrence.
Timing also plays in to “Feel It Still” by Portugal. The Man. In June,
industry vet Mark Gorlick, now part of the band’s management team, wrote in
on their behalf. But “Feel” it was still a few weeks away from going to pop
radio. And given the paucity of Alternative to CHR crossovers, the notion
of that song as a pop hit (while exciting to consider) was still an
abstraction.
But this week, “Feel It Still” is the fifth biggest gainer at CHR. At this
moment, it certainly seems like a song that will still be heavily played on
CHR when we start discussing next summer’s hits. And it is also the song
that the largest number of Ross on Radio readers cite as their Song of
Summer 2017, edging “Despacito” and Sam Hunt. Interestingly, much of its
support comes from people whose day-to-day world is not focused (or focused
entirely) around CHR radio — something worth considering as CHR’s primacy
in the radio universe starts to falter again.
Then there’s my summer song choice. When I wrote about Kesha’s “Praying,”
it really seemed to be in that place from which Adele’s “Rolling in the
Deep” had been launched skyward. The initial believers were moving it from
15 spins a week to 60 spins. The initially skeptical large-market CHRs were
suddenly moving it into significant rotation. As the column hit, the
medium-market growth continued, but the large markets held at a few spins a
day, waiting for that first good week of callout. And over the next few
weeks, the issue went from whether “Praying” would be a song for the ages
to whether it would be a power.
At this writing, “Praying” is No. 12 at CHR. The medium-market stories
continue. There are encouraging signs of growth in the large markets again,
but whether it is ultimately a power or a Harry Styles “Sign of the
Times”-type curio is still very much in play. There were derisive comments
about my choice, but there were a lot of earnest “I don’t get it” responses
as well. All of those comments, it is worth noting, were from men. And if
any song tests the potential disconnect of our mostly male pop programmers
and their female target audience, it will probably be this one.
Seeing the reaction to “Praying” among my female co-workers was, under any
circumstances, my galvanizing music moment of the summer. That hasn’t
changed, even as the song’s fortunes fluctuate. Galvanizing music moments
are in short supply right now.

Midroll Media Announces Fall Slate Of Podcast Rollouts

Midroll Media has announced its fall podcast roll-outs including
partnerships with the NFL and Vox Media.

Midroll will take over ad sales for the NFLs existing podcasts and assist
with the development of new shows including todays launch of “Game Theory
and Money” hosted by Cynthia Frelund and Matt Money Smith. The company will
also provide creative consultation and serve as advertising partner for Vox
Medias daily news show launching in early 2018.

The company is also taking over distribution of true-crime/comedy behemouth
My Favorite Murder from Feral Audio. Midroll will develop spin-off shows
and a full network down the road based around the flagship program.

Leading podcast company Midroll Media announced new partnerships with the
NFL and Vox Media, along with its fall lineup of new podcasts, at its IAB
Podcast Upfront presentation in New York City.

Expanding its footprint in sports podcasting, Midroll is partnering with
the NFL to represent advertising sales for its existing League podcasts,
including popular shows like “Around the NFL,” “Move The Sticks,” “The Dave
Dameshek Football Program” and “Fantasy Live.” The deal also includes the
development of new shows, beginning with the “Game Theory and Money”
podcast, featuring Cynthia Frelund and Matt “Money” Smith, which launches
today. NFL teams also have the opportunity to partner with Midroll on their
club podcasts. The NFL joins Midroll’s growing roster of sports content,
which also includes shows from Bill Simmons’ The Ringer network.

Vox Media has tapped Midroll and its Stitcher content development team to
help launch its first daily news podcast. Midroll is providing creative
consultation and is the exclusive advertising partner for the show, which
is set to launch in early 2018.

Midroll has signed hit true-crime podcast “My Favorite Murder.” In each
episode, hosts Karen Kilgariff and Georgia Hardstark share their favorite
tales of murder, consistently attracting an impressive 1 million listeners
per episode. Kilgariff and Hardstark plan to grow the show’s brand through
spin-off series and, eventually, a fully fledged network inspired by the
show. “My Favorite Murder” joins from Feral Audio, which helped grow the
podcast into a successful brand and collaborated on its transition to
Midroll. The show is represented by United Talent Agency.

“With our ability to serve every part of the podcast community — from
creators to advertisers to listeners — Midroll is positioned to help bring
the world’s best shows to light across a wide spectrum of genres,” said

Other shows launching this fall include:

“Heaven’s Gate,” hosted by Glynn Washington of “Snap Judgment,” is a
Stitcher 10-part series that will take a new, unconventional look at our
nation’s largest mass suicide. It will explore the original underpinnings
of the cult as well as the lives of its founders and members, taking a deep
dive into how its promise turned to such tragedy. Executive producers for
the series include the production team behind Stitcher’s popular true-crime
series “Stranglers” and Pineapple Media, the executive producers of
“Missing Richard Simmons.”

Two stars of improv comedy — Emmy-nominated actress and comedian Lauren
Lapkus and actor and writer Jon Gabrus — are launching the new podcast
“Raised by Television” on Earwolf. Well known in the industry for their own
podcasts (“With Special Guest Lauren Lapkus,” “High and Mighty”) and
appearances on top comedy podcast “Comedy Bang! Bang!”, the hilarious duo
will revel in the TV shows of the ’80s and ’90s with a side of nostalgia
and humor.

Cristen Conger and Caroline Ervin, formerly of “Stuff Mom Never Told You,”
are back together for “Unladylike,” a weekly show that investigates and
crowdsources women-centric topics. Cristen and Caroline are
journalistically trained, research-addicted feminists who are best known
for launching iTunes’ first educational women’s podcast, which ultimately
earned 1 million monthly podcast streams.

In “Dr. Gameshow,” hosts Jo Firestone and Manolo Moreno play original game
shows with their comedian friends and via listener call-ins. Listeners will
be entertained as Firestone and Moreno struggle through outrageous games
submitted by people all over the world, from New Jersey to Pakistan. This
cult-favorite radio show is now on Earwolf.

It will also bring Bobby Bones Nashville Podcast Network to the platform.

Christian Broadcasting of Greenwood sells CHR Hot 1240 WGRM and Urban

operating the station via LMA and has flipped the station to Spanish Public
News/Talk Radio Bilingue.

John Higgs is buying out the 75% of Broadcast South and its eight stations
and one translator in south central Georgia that he doesnt own for $1.05
million. The company owns Regional Mexican Que Buena 860 WDMG Douglas,
Classic Hits 105.9 The Sting 920 WHJD/105.9 W290BR Hazlehurst, Oldies 1240
WBHB Fitzgerald, Country 92.5 The Farm WKZZ Tifton, Classic Rock 93.5 The
Eagle WVOH-FM Nicholls/Waycross, Hot AC Radio 96.9 WRDO Fitzgerald, Classic
Hits 97.9 WDMG-FM Ambrose, and CHR Shine 101.9 WPNG Pearson.

In a deal not properly filed with the FCC, Viva Media LLC will convert
their Time Brokerage of Caroline Smiths Norteno 105.1 KAMT
Channing/Amarillo TX to a purchase for $351,000 minus a $100,000 TBA
payment. The deal was filed within a supplement to a petition to deny filed
by Smith to Vivas purchase of CHR Wild 104.3 KQFX Borger/Amarillo from
Tejas Broadcasting.

Despite what happens with the Entercom and CBS Radio merger and the
necessary divestitures in Boston, one thing will remain certain: the NFLs
New England Patriots will continue to be heard on Sports 98.5 The Sports
Hub WBZ-FM.

During the pregame show prior to tonights season opening game, Patriots
President Jonathan Kraft announced that the team has signed a multi-year
extension to keep the games on WBZ-FM. The Patriots have been heard on CBS
Radio stations in the Boston market since 1994 when they spent a season on
then Westinghouse News/Talk 1030 WBZ, before moving to Infinity
Broadcastings 104.1 WBCN in 1995 and to 98.5 when that frequency flipped to
Sports in 2009.

The teams current broadcasters, play-by-play man Bob Socci and analyst
Scott Zolak are expected to remain in those positions for the duration of
the deal.

CBS RADIO and the five-time Super Bowl champion New England Patriots
jointly announced today a multi-year contract extension to keep Patriots
games on Boston’s WBZ-FM, 98.5 The Sports Hub. Team President Jonathan
Kraft joined today’s pre-game show to share the news. Bob Socci and Scott
Zolak will continue as play-by-play host and color analyst, respectively.
CBS RADIO has served as the flagship radio partner of the Patriots since
1994 when the games aired on WBZ-AM, before transitioning to WBCN-FM in
1995.

“Our continued partnership with the New England Patriots underscores CBS
RADIO’s leadership in sports radio,” said Andre Fernandez, President and
CEO, CBS RADIO. “We have enjoyed an incredible relationship with this
storied franchise for over 20 years and are proud to continue our
partnership into the future.”

relationship that we have had with CBS RADIO since the Krafts bought the

delivery than Bob Socci, and Scott Zolak not only provides unique insight,
but has quickly become an iconic fan-favorite in New England. We look
forward to many more years teaming with 98.5 The Sports Hub.”

Complementing each game, The Sports Hub broadcasts “Patriots Preview” three
hours prior to each game, as well as a three-hour post-game show which
breaks down the game, features press conferences and gives fans a chance to
react. Both shows are hosted by Marc Bertrand, co-host of The Sports Hub’s
midday show, “Zolak and Bertrand.” Joining Bertrand as co-hosts of the pre
and post-game shows are Chris Gasper and Steve DeOssie. Gasper is a Boston
Globe and Boston.com columnist and co-host of “Gasper Murray” on The
Sports Hub on Saturdays mornings. DeOssie is a former NFL player for the
Patriots, Giants and Cowboys, and a stand-out player at Boston College.
Albert Breer, host of Sports Illustrated’s “The MMQB Podcast,” serves as a
pregame contributor.

Before joining the Patriots Radio Network, play-by-play reporter Bob Socci
served as the voice of the Naval Academy Midshipmen for 16 years. The
Milton, Mass. native has also been the lead voice of Patriot League college
basketball for CBS Sports Network, and has called Triple A baseball, most
recently as voice of the Pawtucket Red Sox.

Scott Zolak spent eight seasons as a Patriots quarterback and is currently
the co-host of The Sports Hub’s midday show, “Zolak Bertrand.” He also
co-hosts WBZ-TV’s Patriots All Access and TV38’s Patriots This Week. Zolak
served a season on the sidelines as an on-field reporter in 2011. Prior to
that, he was a co-host of the Patriots Radio Network pre-and post-game
shows for six seasons. He’s served as an analyst on Channel 4’s Patriots
Gameday and Patriots Fifth Quarter for the last 14 seasons. Zo’s been a
frequent guest on Comcast SportsNet New England, and he’s shown his skill
in the television booth as a color analyst on college football telecasts
for CSTV.

Hubbard Radio Hot AC 101.9 The Mix WTMX Chicago has announced that morning
co-host Kathy Hart will not return to the station.

Hart has been absent from the station since April and only released a vague
statement in August to explain why. She joined WTMX in 1995 after working
at WNCI Columbus, KVRY and KDKB Phoenix, WTRG and WDCG Raleigh, as well as
stations in Rockford and Milwaukee and was soon paired in mornings with
Eric Ferguson.

The Eric Kathy show grew into the dominant morning show in the Chicago
market over the past 21 years and will continue with Ferguson and sidekicks
Melissa McGurren, Brian “Whip” Paruch, Cynthia DeNicolo and John “Swany”
Swanson.

101.9 THE MIX (WTMX) has announced that morning show host Kathy Hart will
not be returning to her role on the “Eric Kathy Show” after 21 years.

“We wish her all the best as she moves on to the next phase of her career,”
said Jeff England, Vice President at Hubbard Radio Chicago, which owns and
operates THE MIX in addition to 97.1 The Drive (WDRV) and SHE 100.3 (WSHE).
“To our listeners and clients, rest assured that Eric, the morning show
team, and all of us at THE MIX will continue to serve you as we enter a new
era of morning radio on the station.”

“We will always be grateful to Kathy for her contributions over more than
two decades with the station,” said Drew Horowitz, President and Chief
Operating Officer of Hubbard Radio, LLC. THE MIX will move forward with
Eric Ferguson and the rest of the morning show team, including Melissa
McGurren, Brian “Whip” Paruch, Cynthia DeNicolo and John “Swany” Swanson.
