He is out of jail and ordered not to leave his house after posting a $50,000
bond as of mid-July. Charged with two sex crimes while authorities mull
further charges, including murder.

RADFORD - The allegations against Radford photographer Bob Shell escalated
Wednesday as a grand jury brought 10 new charges, including felony murder
and four counts of defiling a corpse, in connection with the death of one
of his models.
Authorities said the model, 19-year-old Marion Elizabeth Franklin of
Boone, N.C., had taken a generic form of Valium and morphine - and later
died - the evening of June 3. Shell has admitted to having sex with her in
his studio during that period, but authorities are not commenting on
specifics.
Shell is now charged with felony murder, four counts of defiling a corpse,
possession of diazepam, distribution of diazepam, forcible sodomy and two
counts of animate object penetration - all felonies - and misdemeanor
possession of morphine.
Felony murder is a death, whether intended or not, that results from
another crime that is a felony.
Shell, who has been released on a $50,000 bond and had been under house
arrest for the past two months, was taken back to the New River Valley
Regional Jail on Wednesday afternoon.
Shell is an author of 18 photography books, has been the editor-at-large
for Shutterbug magazine and an internationally regarded instructor, and is
known for his nude photography. In an interview at his home last week,
Shell said he was innocent.
"There was no crime committed," Shell said. "I'm adamant about that, and I
will remain adamant about that."
Defense attorney Marc Small said Shell should be able to meet new bond
conditions today. Among those conditions ordered by Circuit Judge Brett
Geisler is an increase in the bond amount to $75,000 and a second
affidavit from Shell's wife that says he is allowed to live in their
Radford home until trial.
Once those conditions are met, Shell will be returned to house arrest.
Geisler said he will allow Shell access to his photography studio on West
Main Street once a week.
Commonwealth's Attorney Randal Duncan objected to any bond being set for
Shell, arguing that the "situation has changed dramatically" with the 10
new charges.
Duncan told Geisler he has evidence that Franklin was either unconscious
or physically unable to consent to having sex with Shell in the hours
before she died.
"He was taking advantage of a young lady who was physically helpless,"
Duncan argued.
In a written statement released this week, Franklin's family seemed to
agree.
"Marion was full of life, bright, vivacious, funny and loving," family
members wrote. "While Bob Shell may have recognized her many wonderful
qualities, he is a much older man who took advantage of a young girl's
weaknesses as well as her desire to better herself. Because of this, we
will never know the woman she would have become, and for that there must
be justice."
Family members declined further comment.
The investigation is ongoing, said Radford investigator Andy Wilburn.
"We are pleased with how the investigation has progressed so far but there
is a lot more work to be done," Wilburn said.
Shell said last week that Franklin did consent to having sex, and that the
two had been having an affair for the past year.
He said Franklin was awake, not unconscious, until about 6 p.m. June 3,
when she lay down for a nap. He said he realized nearly an hour later that
she wasn't breathing and called for help, telling emergency dispatchers
that drugs might be involved.
Shell said he knew Franklin had a drug addiction, using both marijuana and
prescription medications, but never realized quite how deep the problem
ran.
"She was the sweetest person you could imagine and highly intelligent,"
Shell said. "But she was just a slave to her addictions."
Shell brought Franklin, who modeled under the name Chloe Jennings, to
Radford in September 2002, got her an apartment and hired her as his
studio manager.
Small said he was surprised by the sheer number of charges brought by the
grand jury. He said his next step is to request copies of all police and
forensic reports and get to work on Shell's defense.

Shell doesn't sound like Christ, but let's be certain of one thing: a
particular Commonwealth's Attorney decided to lay charges against Shell, and HE
or SHE, not the state, presented the case to the grand jury along with evidence
aimed at getting an indictment. Nothing else.
The CA is a minion of the state. He is not the state. So, you are right. The
courts will decide. And expostulating on forensic or other evidence here is
irrelevant. Probably none of us know enough about the case to even make a
sensible statement about it.

Dunno. I've read about people inserting small mammals in their anuses because

I have no idea what the charges really mean in this particular case.

see how many American homes there are, versus German cars, then start the
comparison, with the knowledge that it can never be accurate, because driving
