Children's Nursery Rhyme Triggers Racial Discrimination Lawsuit

(CNSNews.com) - A Southwest Airlines flight attendant's use of a popular
children's rhyme - "Eenie, meenie, minie, moe" - has resulted in a federal
racial discrimination lawsuit against the airline filed by two African American
women asking for unspecified financial damages.
One of the two women suing over the allegedly offensive nursery rhyme claims
hearing the rhyme caused her to be bedridden for three days and suffer from
"unexplained memory gaps," according to court documents.
The trial was supposed to start Tuesday in Kansas City, Kan., but U.S. District
Court Judge Kathryn Vratil delayed the case until Sept. 29.
Southwest Airline passengers Louise Sawyer and Grace Fuller allege they
suffered racial discrimination on the flight in February 2001 when flight
attendant Jennifer Cundiff said over the plane's intercom, "Eenie, meenie,
minie, moe; pick a seat, we gotta go." The two women say they were the only
passengers standing in the aisle at the time.
Sawyer and Fuller said that as soon as they heard the rhyme, they were reminded
of the racist version that starts with the phrase: "Eenie, meenie, minie, moe;
catch a n***** by his toe ..."
A more modern version of the nursery rhyme substitutes the offensive phrase
with the words, "Catch a tiger by the toe." The rhyme is traditionally used by
children to pick someone who will be "it." According to at least one word and
phrase historian, the original rhyme using the n-word dates back to about the
mid-19th century.
Sawyer and Fuller, who are sisters, had also originally alleged physical and
emotional distress as a result of the nursery rhyme but earlier this year,
Judge Vratil dismissed that aspect of the lawsuit, narrowing the complaint to
the issue of discrimination.
"The court agrees with the plaintiffs that because of its history, the phrase
'eenie, meenie, minie, moe' could reasonably be viewed as objectively racist
and offensive," Vratil stated in court papers. "The jury, however, must decide
whether Cundiff's remark was racist or simply a benign and innocent attempt at
humor."
Cundiff, who is white, disputes that Sawyer and Fuller were the only ones
standing on the crowded flight. Cundiff said she had been using the rhyme on
several different flights as a humorous way to get passengers to sit. Southwest
Airlines employees are known for their folksy manner and casual atmosphere.
Scott A. Wissel, the Kansas City, Mo., attorney representing Sawyer and Fuller,
declined to comment for this article.
But according to court documents, Sawyer said she was "infuriated by the
[nursery rhyme] comment" and said fellow passengers giggled after it was said,
making her feel alienated.
'Unexplained Memory Gaps'
Fuller believes Cundiff intentionally singled out her and her sister. "It was
like I was too dumb to find a seat," Fuller complained in the court papers.
Fuller, who has epilepsy, said she was so unnerved by the nursery rhyme that
her hands trembled during the trip and she has experienced "unexplained memory
gaps" about the flight ever since.
Fuller also maintains that the nursery rhyme incident caused her to be
bedridden for three days because she suffered a "grand mal seizure." However,
Fuller said she could not medically verify the incident because as a result of
lacking health insurance, she did not seek medical help for the seizure.
Cundiff wrote a report about the incident as part of a Southwest Airlines'
internal investigation.
"The statement I made on Flight 524 was not racist or discriminating, and I am
offended that because I have white skin, suddenly I am a racist," Cundiff
wrote. "Maybe those that run around pointing fingers yelling racist should stop
and turn that finger around."
Southwest agreed with Cundiff and does not believe the phrase was racist or
that she acted inappropriately. Even though Southwest did not ask her to stop
saying the rhyme, Cundiff said she stopped because of the controversy.
Wissel said he is trying to get the courts to prohibit Southwest Airlines
employees from using the nursery rhyme and force the airline to provide
employee training to prevent future racial controversies.
Wissel's clients, Sawyer and Fuller, are seeking an unspecified financial
amount in compensatory and punitive damages.
'Ridiculous Lawsuit'
The lawsuit has provided critics of the American legal system more ammunition
for their tort reform battle.
"Seems sort of a ridiculous lawsuit, but this is the rise of this litigious
culture, where people look to sue at the most insignificant remark," said Steve
Lilienthal, spokesman for the Free Congress Foundation (FCF). The group just
hosted a seminar last week on Capitol Hill focusing on what it considers the
explosion of frivolous lawsuits in America.
"There is no real racist connotation in the phrase. How can you view [that
phrase] as being racist? It just doesn't make sense. Most people would look at
this lawsuit and be dumbfounded," Lilienthal said.
He sees this lawsuit as part of a larger cultural problem, "one more sign of
people who are simply looking to sue," Lilienthal explained. "There is a whole
grievance industry set up based on the increasing use of litigation."
This is not the first time the "eenie, meenie, minie, moe" nursery rhyme has
come under fire. In 2002, government officials in University City, Mo., a
suburb of St. Louis, printed a calendar that had a cover photo of the feet of
five children, one bare and the others with shoes with a caption reading, "Eeny
... meeny ... miny ... moe" (alternate spelling). Most of the kids in the photo
were African American.
After a city employee complained that the calendar was racially offensive, the
city reprinted all 18,000 copies of the calendar with the photo deleted,
according to the Kansas City Star.

toe"...etc. Later in life I learned of a version, I guess the original,
which of course is offensive...but I would imagine many people never know it
any way other than as an innocent-sounding rhyme.

FWIW, I've heard that nursery rhyme both ways, with "tiger" and the
"n-word." Certainly the n-word can be viewed as objectionable. You don't
always have to *say* something when the *implication* speaks volumes.

When my sister and I were young, my mother taught it to us as "...catch
a fellow by the toe." As I got a little older (6-7 yrs old), and
started playing with other kids in the neighborhood, it became "...catch
a tiger by the toe," as that's how they all said it.
It wasn't until I got into high school that I heard a kid using the
original(?), racist version. Unfortunately for him, my friend Karl
(6'2", dark skinned Jamaican) was standing next to me and heard it too.
I guess Karl must've read the politcal correctness handbook because he
sure took offense. Back then, however, lawsuits for things like that
were unheard of. He quickly slapped the taste out of the other kid's
mouth.

If the flight attendant had no knowledge of the original nursery rhyme, and
had no intent to use it in an insulting manner any more than on any previous
occasion when she used it, then it is absurd to say her ignorance is no
excuse.
What's next? Will saying "It's a little nippy out today" on a cold morning
result in lawsuits from any Japanese folks within hearing? Think of all the
everyday expressions we use quite innocently that refer in some way to
particular nationalities, do we have to weed out all of them for fear of
being sued?

attention to it like this will certainly help put the racist version back
into everyone's consciousness. She was merely talking to the women on a
level that they could understand. Who the hell needs to be told to sit
down before a plane takes off? Did they not think it was leaving? Their
only responsibility was to get on the plane and sit down, and that was
obviously too much for them to handle. They are obviously morons to begin

That's probably a stretch. But to bring forth this lawsuit, these two women
must have some witnesses to testify on their behalf, no? As I said earlier,
on the surface it seems silly. But hopefully our justice system can sort it
out and find out what the intent was, if any. If this lawsuit is frivolous,
both the women and their attorney should receive penalties.

kids nursery rhyme. I doubt that the flight attendant or most of the
passengers had either. If two silly women can't sit down fast enough on a
plane and some flight attendant uses a popular, non racist nursery rhyme to
hasten their cooperation, I fail to see what the hell this is doing in court.

and be goofy (at least pre-9/11). They used to ham it up during the
safety instructions. On one flight I was on a few years ago, a flight
attendant hid in an overhead compartment and yelled BOO when someone
opened it. The flight attendants make fun of each other and the
captain. The captain makes fun of the flight attendants. They sing.
They giggle. They act silly.

the horrible racism that went on in the 30's, 40's and 50's(or from people
using the N word in a nursery rhyme) but still think that they are OWED
something because a bunch of people that they never even knew suffered from

struggled in the past and I am ashamed at what our anscestors did to them.
HOWEVER- since I am not going to be punished for what my white ancestors put

Man, I grew up in a second-generation German family that was racist like you
wouldn't believe. If they weren't railing against the money-grubbing Jews,
they were trashing the lazy and shiftless blacks.
My mother spent almost every family gathering arguing with her parents and
in-laws about racial issues. On the way home from these gatherings, she
would always deliver a long lecture to me about the evils of racism. If it
weren't for that, I'd be a closed-minded bigot for sure.
My Grandpappy recited the racist version of this poem to me literally
hundreds of times. But only when he was sure my mother couldn't hear.....
My Grandfather would finish the poem with: "If he hollers let him go/Slap
him down and tell him no!"
My associations to this poem are indelibly marked with the worst kind of
racism. I get queasy and sad thinking about it. My relatives were good,
kind people in most ways. But they were horribly misguided about race
relations.

The point I have been making since the beginning of this thread is that
I can see how this rhyme can be taken as racist. I only brought up the
judges decision in my recent posts. My reason for doing this is to point
out that no matter what you or I or anyone else thinks, and like it or
not, it is the judge who decides if the case goes forward.
There are two sides to this story. Both sides deserve to be heard and
need to be considered. So many readily jump to the white attendant's
defense and accuse the African Americans of money grabbing. What is
this? White is automatically right? You guys (my bet is that you are
all or mostly all white) see this one way and the minority women see it
another. THAT is the reason cases like this end up in court.
Oh, and by the way Toad, what does judges throwing pot smokers in jail
have to do with the price of smoke? That is an entirely different
subject.
I for one am happy to start a class action law suit against the entire
Rap/Hip Hop musical industrial complex for the ontold harm and distress they
have caused African Americans for their blatant use of that "N" word.
Can we find some African Americans (maybe the two from this story) to be

Try this on for size. There is a world full of professional victims our
there. They make excuses about why they aren't successful, they are always
looking to avenge some real or imagined wrong, and they are always looking
to punish people whom they feel slighted by.
Maybe the remark was racist and maybe it wasn't, but even if it was (which I
REALLY doubt BTW) So what? The world is filled with stupid, racist people,
are these women so fragile that they are going to suffer blackouts and
become bedridden everytime somebody hurts their feelings? If so then they
need to get help, and should remove themselves from society, because they
are going to be constantly bedridden and unable to function.
I will concede that I can see how the rhyme could be construed as racist,

outrage to U.S. District court Judge Kathryn Vatril in Kansas City,
Kansas, because it certainly is being lost on me. She is the judge who
decided to move the case forward. If you don't like her decision then
let her know and see where that will get you because you surely are not
accomplishing anything by lashing out at me.
Most of us have faith that the court will realize the frivolity and decide
not to reward those broads with the cash they are so desparately grabbing
at.

People post things, then they get knocked for it; it happens to me every
time I post anything political. It's usually a matter of minutes before

people there think. But having been born and raised there and as one
who continues to visit and still knows scores of people there, I think I
can speak with some authority on the matter. I see this as an excellent
opportunity to describe what I see. If this doesn't apply to you,

Many Marinites live in a bubble. The bubble secures them from minority
groups and the lower socio-economic classes, as they are confined to a
few run down neighborhoods (Canal, Marin City). The saving of open
space drove land and housing prices so high that the millionaires are
permanently protected from the riff raff. The bubble dwellers rant and
rave about how intolerant the rest of the country is, when the reality
is that almost every non-Marinite lives in a far more diverse and
egalitarian environment than they do. Every social cause imaginable,
from the serious to the trivial, is championed by the Marinites, yet the
emphasis appears to be on the trivial. The excess leisure enjoyed by
many Marinites encourages this phenomenon of focusing on micro-issues.
They have nothing better to do than to try to continue their charade
that they are a superior life form. They have a need to self-validate
their otherwise unproductive existence. Hence we see things like
support for people who had to take to bed for three days upon hearing a
harmless rhyme used on playgrounds across America to pick dodgeball
teams. This is NOT how it used to be. The county was always crazy,
producing a large number of musicians, artists, writers, and activists
of every variety. Almost every new social trend had at least some roots
in Marin. It was an anything goes environment. People experimented
with everything. It was a vibrant, exciting place with the most open
minds on the planet.
Unfortunately, that tradition seems to have faded into the sunset. Now
I see way too many examples of dogmatic ideologues, intolerant of anyone
who thinks for themselves. There is an accepted truth, and deviating
from it results in lame, knee-jerk charges of racism and sexism. These
concepts weren't learned from ever having any actual experience with
them (not in the bubble...), but from sitting through university
lectures and activist group symposiums where allegedly learned men and
women droned on and on about how awful everyone but themselves and their
ilk really were. The zombie like audience nodded approvingly.......it's
become the Stepford County. Dermotologists are making a fortune there,
not only by doing face peels and Botox injections, but by treating the
large masses of Marinites with tissue-paper-for-skin conditions.
Marinites: Return to your past! Embrace diversity! Celebrate personal
independence! Throw off the shackles of the fascist "leftists"! Keep

this for kids and it is still wonderful. Basically, it is a variation on a
tunnel of fudge cake. "
1 cup butter, softened
1 (8 ounce) package cream cheese
1 teaspoon vanilla extract
6 tablespoons unsweetened
cocoa powder
1/2 cup packed brown sugar
1 cup white sugar
4 tablespoons bourbon
4 eggs
2 1/2 cups all-purpose flour
1 1/2 teaspoons baking powder
1/4 cup unsalted butter
1/4 cup unsweetened cocoa powder
3/4 cup packed brown sugar
1 tablespoon bourbon
1 cup toasted pecan pieces
1/4 cup unsweetened cocoa powder
1 cup confectioners' sugar
1 teaspoon vanilla extract
1 tablespoon butter, softened
5 tablespoons hot water
Directions
1 Preheat oven to 325 degrees F (165 degrees C). Grease
and flour one 10 inch Bundt or tube pan.
2 Cream 1 cup of the butter or margarine, cream cheese, 1
teaspoon of the vanilla, 6 tablespoons of the cocoa, 1/2 cup of
the brown sugar, white sugar, and 4 tablespoons of the
bourbon. Add eggs one at a time mixing well after each one.
3 Mix together flour and baking powder and mix into
batter. Beat on medium speed about 3 minutes. Spread half of
the batter in bottom of the prepared pan and place
teaspoonfuls of filling around the center of batter. Cover with the
remaining batter.
4 Bake at 325 degree F (165 degrees C) for 70 to 75
minutes or until a toothpick comes out clean. Let cool
slightly on damp tea towel and then invert on to a plate. Cool
completely and then spread with glaze.
5 To Make The Filling: Blend 1/4 cup of the unsalted
butter or margarine, 1/4 cup of the cocoa, 3/4 cup of the
brown sugar, and 1 tablespoon of the bourbon together. Fold
in the toasted pecans.
6 To Make The Glaze: Blend 1/4 cup of the cocoa, 1 cup of
the confectioner's sugar,1 teaspoon of the vanilla, 1
tablespoon of the butter, and starting with 4 tablespoons of the
water then adding more until the desired consistency is
reached. Spoon over top of cooled cake.

My skills in the kitchen are non existant. Like you, the primary
cooking and baking was done by my father when I was growing up.
(Although he did work outside the home, too. Air Force.) None of the
women in my immediate family cook. My dad had very little patience with
people hanging around in the kitchen, so I never developed an interest

To be fair to the RMGD upper crust, it's not just Marin. You get the
same sense of smug superiority in all these unreal wealthy white
bubbles. Beverly Hills, Newport, the Hamptons, Palm Beach, Aspen, etc.
are similar in that minorites are confined to the servants quarters,
little or no productive work is done by the residents, and the amount of
leisure time exceeds the ability of the bubble dwellers to fill it with
anything useful. Fantasy rules the day, as there's nothing else to do
(unless ordering your personal shopper to return that pair of shoes to
Nordstrom counts).
The problem with Marin is that instead of understanding and admitting
their role in the world (engaging in mass consumption, tax avoidance,
and frivolous entertainments) as most residents of the other communities
I named understand and admit, they insist on perpetuating the charade
that they are somehow "down with the peeps" and are MORE real than those
of us who live in regular communities where people do their own cooking

studies have noted hardening of the arteries and kidney stones in people
who overdue it with the vitamin.
