This subject, for me, is analogous to the MP3 piracy discussion. Strata-East
has its own website (www.serecs.com) listing th eofficial releases of
Strata-East, mostly Tolliver/Music, Inc. dates.
Charly has been caught and convicted of bootlegging in the past, and since
these Strata-East reissues on Charly are NOT official SE releases, but use the
original artwork, etc., my guess is that they are still at it.
I was in London and found Clifford Jordan's _Glass Bead Games_, something I
have on vinyl, but wanted on cd. I bought it, not thinking about whether it was
an official release. On coming back to the states, I contacted the staff at
Strata-East to ask if they had licensed other of the Jordan produced "Dolphy
Series" SE releases. Their answer was that most of the non-Tolliver non-Cowell
SE's were licensed from the artists involved, SE being essentially a musicians'
record label. Thus, records such as Jordan's _In The World_ or Charles
Brackeen's _Rhythm X_ have reverted to the artist (or estate). Charly is not
afaik paying anybody anything --certainly not Strata East, who claimed no
knowledge of the release of Glass Bead Games, and were a bit p'o'ed about the
idea of Tolliver SE's, which Tolliver himself is keeping alive on SE, being
released on Charly.
Now, maybe I've got my facts skewed, but it sounds to me like Charly is the
"Hard Copy" version of a Napster-dl.
It poses an ethical dilemma, imo.

MCA Wins Five Year Battle Against Charly Records
The Supreme Court refused to review an appeals court decision that U.K.-based
Charly Records Ltd. and its affiliates had violated the rights of Universal
Music's MCA Records by marketing records from Chess Records "Masters"
collection, ending a five year dispute between the companies. MCA was awarded
$8.4 million in copyright-infringement-violation damages.

Charly Records also rates highly on Sue Mingus' list of bootlegged disks to
avoid.
The ethical dilemma for me? There are cd's I would like to have, mostly copies
of vinyl I already own, that are on Charly. Since I know that they are one of
the companies that took advantage of the looser (read nonexistent) European
copyright laws, I have a better than 90% feel that these are records for which
royalties are not being paid.
On the other hand, noone is busting their butts to try to legitimately release
Jordan's records originally on Strata-East, or the BYG/Actuel dates of Braxton
or Shepp, or Cherry, or Sunny Murray - just a few of the BYG's I have on vinyl.
And who knows if the artists were ever paid for those?????
I'd do it (legitimately) myself, if I had half a notion how -- though I assume
right out of the gate that I don't have the requisite funds. Efforts at
contacting One Way Records, Koch Records, and the Clifford Jordan estate have
not proved fruitful.
So, the music remains unavailable legally, but there are those tempting
"gray-label" disks out there. Personally, I stopped buying Charly when I
learned of their practices, because I have too many musician friends trying to
make it, without supporting a company that makes money off artists without
obtaining license.

Yes, and as already covered, not with the participation of Strata-East.
Bellaphon copied many of the Strata's and several of the ESP-disks.
That doesn't excuse their piracy of Strata-East, Chess, MCA, does it?
