Two men cleared of assaulting Vancouver police officer after more video surfaces

Two young men accused of assaulting a VPD officer in 2018 are free after a judge dismissed all charges against them - despite the fact the officer was taken to hospital. Rumina Daya reports.

Two brothers have been cleared of assaulting a Vancouver police officer following a traffic stop in 2018, after more video came to light.

Brendan and Troy Robinson, as well as a third man, had been driving in a Dodge Durango through a restricted area of Granville Street just before 10 p.m. on Oct. 9, 2018, police said at the time.

The three men, all in their early 20s, were verbally abusive, refused to follow direction and began reaching under the car seat, police said.

When an officer opened the passenger door, the man in the front seat pulled him into the SUV and two of the men punched the officer repeatedly in the head and face, police said.

All three men got out of the vehicle and continued to assault the officers, police said.

Cell phone video surfaced that showed part of a brawl that ensured between Brendan Robinson and one of the officers.

At the time, a Vancouver Police Department spokesperson said the officers were defending themselves against the suspects’ blows.

However, on Monday, a B.C. Provincial Court judge dismissed all charges against the Robinsons because of more video that had been shot by Troy.

The judge said Brendan Robinson had been the one to defend himself and shouldn’t have been arrested, adding that the testimony of the two police officers in the case was unreliable.

“I’m just happy that we had the video evidence to prove that we were innocent,” Troy told Global News outside of court.

“Otherwise, we would have got charges that were undeserved.”

Two of three men charged with assaulting a Vancouver police officer Tuesday are sons of an original member of the East End Hells Angels, Postmedia has learned.

A Vancouver police officer was taken to hospital Tuesday night after he was beaten during a routine traffic stop in downtown Vancouver.


It happened at around 10 p.m. when two plainclothes officers pulled over a Dodge Durango on Robson Street after they spotted travelling through an area of Granville Street closed to private vehicles.

The VPD says the three men in the vehicle, all in their early 20s and well-known to the police, were confrontational and verbally abusive during the traffic stop.

“The officers became concerned for their safety as the occupants refused to follow police direction and began reaching under the seat,” VPD spokesman Sgt. Jason Robillard said in a news release.

The assault began when one officer opened the passenger door and the front passenger pulled him into the vehicle and two men began punching him in the face. As the other officer rushed to help, all three men got out of the vehicle and continued to assault the officers.

While the officers were waiting for backup to arrive, one of the three men ran away and was hit by a pickup truck as he crossed an intersection against a red light.

The man continued to run for two more blocks before being arrested by the uninjured officer, who was giving chase.

“This is an example of the risk all police officers face as they work to protect the citizens they serve. This sort of incident affects the entire policing community,” said Robillard. “We wish our officer a speedy recovery and will ensure the officer and his family have the support they need.”

Troy Michael Robinson, born in 1996, and his brother Brendan John Robinson, born in 1997, both of West Vancouver, were arrested Tuesday by Vancouver police after fleeing the scene of the assault.

Both are sons of Lloyd Robinson, who retired from the Hells Angels several years ago.

The elder Robinson is the half-brother of John Bryce, the president of the East End chapter of the notorious biker gang.

Lloyd Robinson left the HA after a major undercover investigation in which police agent Micheal Plante infiltrated the gang by getting close to him.

Both Troy and Brendan Robinson are charged with assaulting a police officer and resisting arrest along with a third man, Brian Benjamin Allen, of Victoria.

Allen is also charged with possession of stolen property worth under $5,000.

Troy and Brendan’s brother, Lloyd Robinson Jr., was convicted in 2014 of assaulting a taxi driver and breaking his nose and eye sockets . He was sentenced to 16 months in jail.

In a video of Tuesday’s incident posted to YouTube, a witness, who claims to have assisted in the arrest, can be heard questioning the arresting officer’s use of force.

“That dude kicked him in the stomach pretty hard for no reason,” the man said while pointing at the officer.

“He severely assaulted my partner and he is combative,” responded the officer.

The VPD said the man who ran from the scene was lucky not to have been seriously injured. He was check in hospital and released.

The injured police officer, meanwhile, is recovering at home.

“The injuries are to the head and face, and we consider them to be substantial injuries,” said Robillard.

Robillard was asked at a Thursday media conference if the officers, who were dressed in plainclothes, properly identified themselves as the police.

“These officers in this particular case were in plainclothes. They did pull this vehicle over with their emergency lights on their vehicle, they did identify themselves as police officers, and there is no doubt in my mind that the three occupants in the vehicle knew they were police officers — just from comments made and evidence I read,” he said.

Lloyd Robinson had so much respect and clout within HAMC that when Plante was revealed to be a police agent who audiably recorded activities at the East End clubhouse at 3598 E.Georgia V5K 2L8 and whose testimony sent various full patches to prison he was allowed to resign rather than be killed. Cecil Baxter Smith wasn't so lucky.

One thing that struck me as I stood outside the Hells Angels party all weekend is why this close-knit brotherhood of motorcyclists wasn’t out putting up missing person’s posters for long-time member Ced Smith, who was in the Vancouver chapter. In fact, until the Sun reported on his disappearance Friday, fellow Angel bikers had not uttered a word publicly about the fact their friend had vanished some time after the Victoria Day weekend.

A full-patch member of the Vancouver Hells Angels who unwittingly introduced a police informant to the organized crime group is missing and feared dead, The Vancouver Sun has learned.

Cedric Baxter Smith, 59, was one of the early members of the powerful biker gang, which is gathering in Langley this weekend to mark the 25th anniversary of its first chapters in B.C.

Smith was out on parole on a series of drug-trafficking convictions when he was last seen by his club brethren on the Victoria Day long weekend.

He failed to report to his probation officer June 17 and the next day, RCMP visited his Langley home in an unsuccessful bid to find him.

Police then heard from a senior Vancouver Hells Angels member on June 27 that Smith might have met with “foul play.” RCMP located his abandoned vehicle in a Langley alley later that day.

Insp. Gary Shinkaruk, who heads the RCMP’s Outlaw Motorcycle Gang unit, confirmed that Smith has vanished without a trace.

“Cedric Smith of the Vancouver Chapter Hells Angels has been reported missing for some time now,” Shinkaruk said. “We don’t know where he is. We haven’t found him yet.”

Smith was the first Hells Angels member to have contact with a police agent who had already secretly agreed to infiltrate clubs in Vancouver and Prince George in a covert operation dubbed Project Essen.

The investigation led to 10 major arrests in January 2005, including Smith and Vancouver club president Norman Krogstad. All the accused eventually pleaded guilty to various drug and gun charges, making the project the most successful prosecution of B.C. bikers to date.

Because of the guilty pleas, the police agent, who is now in the witness protection program, did not end up testifying.

Smith is not the only biker in the case who may have met with a violent end. Co-accused William (Billy) Moore, who headed the Hells Angels puppet club in Prince George, was slain in March 2005. The bullet-riddled body of the Renegades president was found slumped in his car near the charred remains of his rural home. The murder remains unsolved.

Moore had extensive contact with the police agent during the 18-month undercover operation. Members of both the Angels and Renegades praised Moore at his funeral, held under the watchful eye of police.

At the time, Hells Angels spokesman Rickey Ciarniello, who owns the Vancouver chapter clubhouse, called Moore “a nice man” and said he was shocked at the murder.

Ciarniello refused to disclose Thursday if he had spoken to the RCMP about Smith’s disappearance.

“I have nothing to say about that,” Ciarniello said. “I am not going to say anything about it.”

At Smith and Krogstad’s sentencing hearing, prosecutor Martha Devlin laid out the Crown case against the pair.

She said the police agent began meeting Smith in June 2003 at his Langley home and was soon purchasing kilos of cocaine for $39,600 each.

Some of the coke was delivered to a nearby Wendy’s restaurant. The agent would leave the code 666 on Smith’s pager as a signal to meet at the restaurant.

Some of the coke was sold to the agent by Smith in Cache Creek and Boston Bar.

At one point, when the police agent complained his kilogram was an ounce “short,” Smith arranged a meeting with the agent and Krogstad, who was also charged with trafficking cocaine in Prince George with the Renegades and Moore.

When Smith was arrested, police found $73,000 at his house. In addition to a four-year sentence, Smith had to pay $100,000, but was allowed to use the seized cash towards the fine.

His lawyer, David Martin, said at the time that Smith was single and had spent his entire life as an auto-body repairman.

Project Essen was the first major RCMP operation against the Hells Angels in B.C. and resulted in nine people convicted — four connected to the Vancouver chapter and the other five from the puppet Renegades. Moore, the tenth person arrested in Project Essen, died before he could be convicted.

Smith and Krogstad both got early parole in March 2007 due to their good behaviour.

But Smith was banned from associating with members of the biker gang until after the expiry of his warrant on Nov. 6, 2009, according to National Parole Board documents obtained by The Sun.

“There were no reasonable grounds to believe that, if released, you are likely to commit an offence involving violence before the expiry of your sentence,” the parole board said.

But board members also said Smith must recognize that his “association with people involved in criminal activity and criminal organizations was a causal factor in your criminal behaviour.

“You must therefore avoid any person you know or suspect is affiliated with an outlaw motorcycle gang or other organized criminal group.”

“This condition is reasonable and necessary to protect society and to facilitate your successful reintegration as a law-abiding citizen,” the board said.

The board noted that Smith’s criminal record wasn’t clear prior to the police sting that resulted in 11 charges against him.

“Though you have a number of convictions dating back to 1975 and 1993 that involved violent behaviour, the board is satisfied that you were a low risk for future violence,” the parole documents said.

“Your affiliations with members of an outlaw motorcycle group and involvement in the drug trade were issues that had the potential of increasing your risk for violence.

“None of these have been in evidence since your day parole began.”

Jonathan Sal Bryce the son of the East End President was sentenced to six years in prison for cocaine trafficking thanks to Plante's police agent work. Dave Mulligan and Joe Mulligan who were dealing pot 18 months ago threw Jonathan Sal Bryce's name around a few times. I only type this because someone with No Caller ID phoned me 6 times the other day with no msg. That is something Dave and Joe used to do but I thankfully haven't heard from them in over a year. The RCMP use No Caller ID but they would have left a msg and in any case they know my address and the contact info for my lawyer. Fraudsters sometimes do that but why? What kind of idiot would fall for a scam from someone they don't know who won't reveal their phone number? Joe Mulligan told me he sexually assaulted a granny lady. He also told me he ratted out his best friends to the Ottawa police after they beat up the drunk driver who killed his wife and child in a drunk driving accident. I have seen Joe steal things. Joe owes me $1k. He owes money to various ppl in town including former landlords. He and his brother Dave were evicted four times during the 3 years I knew them always for non-payment of rent. Last I heard both were unemployed and that was before the pandemic. They collect pop cans to help their unattractive Mom pay her rent. Dave Mulligan has wisely removed his FB page but Joe Mulligan's FB page has various pictures of him. Joe Mulligan's FB page has had no activity since April 23. These guys have no IRL friends and the bar aquaintences they make quickly regret it. Various bartenders and waitresses are friendly to them while on duty because that is part of their job. More customers make the boss happy and tips are important to bar staff obviously. Some guy bought Joe Mulligan a bunch of drinks one night in a New West pub after Joe promised to pay him back. He never did he never does and the guy ended up threatening to rape him in a voice so loud the whole bar heard so they had
to find another place to drink.

One of Joe's favourite phrases is, "You don't know the real Joe." Fine we don't care.

If the cop that the Robinson brother's assaulted was punched 10 times in the head why didn't the VPD release a pic of the injuries?

Muggy day here will probably go for a walk later on the Seawall. Went to the Guildford Taphouse and Earl's on 152 St. yesterday night. Good time had the Lobster Ravioli at Earl's. Earl's is pricey. The young women to young men ratio was 3:1 at Guildford Taphouse and 2:1 at Earl's.
