I've read the posts on several sites and the opinions vary. I find it
interesting that there are some people who think it's mandantory to give a
tip and it's not my right to omit a tip if service isn't deserving of one.

This is a little different than ordering a cheeseburger with fries.
Almost every menu I've ever seen has a caveat that an (x)% gratuity will
be added to party's of (x) or more. That makes it part of the contract
the group made when they ordered their food. If your service with the
cheeseburger sux you can stiff the server, if you refuse to pay the
contracted amount it's theft. I don't like it and would probably refuse
to pay if the service sucked. But it is what it is. I'd be real
interested in the judge's comments.

I've been in a few places that require a "gratuity" of some amount, which
varies from place to place. I didn't like the idea of not having control
over the amount of tip and if I left a tip. But, I never had bad service so
it wasn't an issue for me, in fact when in a large group it's usually a fun
time and everyone's in a good mood, which usually causes the waiter/waitress
to give good service, so a lot of people will drop a tip even though the
required gratuity is on the check.
I understand the legalities of the incident in the article but sympathize
with the customers, assuming all the info so far is true and they did get
treated bad. I guess the only way to really solve the problem is for the
owners to pay at least minimum wage or something like the burger joints pay
and if service is good or above then a tip would be appropriate. Then
customers would have to pay a lot more for their meals but it would probably
even out. Maybe.
All this thinkin' makes my head hurt.
