Cyclists sound like 'hive of bees'

DEANSBORO - A group of Marshall residents wants a rural entertainment
venue in southern Oneida County closed until the owner obtains the
appropriate permits.
The group is most aggravated by noise generated from a practice
motocross track on the MKJ Farm property along Route 12B, said member
Gary Ford, who lives a half mile away.
"The practice motocross track went from bad to worse to intolerable,"
Ford said. "For us who are neighbors, it was like living inside a hive
of bees."
The group, known as Neighbors for a Responsible Community, has urged
the Marshall Zoning Board of Appeals to order owner Jack Buschmann to
stop all commercial recreational activities on the property - where
Lynyrd Skynyrd played last month -- until each event is regulated by a
special use permit.
Without special use permits -- which allow landowners to use their
property in certain ways under certain conditions -- Buschmann is
violating town zoning laws, said attorney Barry Schreibman of
Cazenovia, who's representing the group.
MKJ Farm currently is zoned for agricultural use, Schreibman said.
Buschmann could not be reached Monday.
Anne Jasek, chairwoman of Marshall's Zoning Board of Appeals, declined
to comment Monday and referred all questions to Town Supervisor John
Reile, who could not be reached for comment.
According to the MKJ Farm Web site, no upcoming events are scheduled.
But the site has hosted Central New York bull riding championships and
musical events.
According to Schreibman, Buschmann has applied for a special use permit
for the motocross track. But the group wants the town to ensure that
Buschmann applies for such permits for each venture related to MKJ
Farm, Schreibman said.
Neighbors' group member Maryanne Marsh, whose property borders some of
Buschmann's 270 acres, emphasized that the group isn't against
Buschmann's commercial endeavors.
"We are not trying to attack Mr. Buschmann. It's not about him," Marsh
said. "It's what's beneficial for our area."
The neighbors' group expects Buschmann's application to be discussed by
town officials at a meeting set for 7 p.m. Wednesday, July 27, at the
Marshall Town Hall.
