Harassment at Steve's Hobby

On Friday, I made a 60 mile trip to Sylvania, Ohio in order to get some model
railroad supplies. The staff made totally off-color remarks regarding my
girlfriend's age with a wink and smirk (she is in college), and then approached
her with the statement, "You look like a pumper girl. You might like these
Athearn fire trucks..." (another wink). Both of us found this behavior
incredibly bizarre, offensive, and harassing.

A few minutes after the last comment, I asked both the sales people, "Who is
Steve?" You guessed it...the guy with the smart mouth pipes up, "That's me." I
inquired, "What's going on with the suggestive comments to my girlfriend?" He
replied, sheepishly, "I don't know what you're talking about- I thought we were
playing a little game." I let him know that I'd originally planned on spending
several hundred dollars there, but definitely would not be doing so from this
point forward.

After leaving, my girlfriend asked me, "What was that all about? Who the f**k
does he think he is to be saying that stuff, especially with you right there
with me??!" She burst into tears. Thank you, Steve, for making her cry, and
having me waste a 120-mile round trip drive for nothing.

This is not the first time this type of behavior has been exhibited at that
hobby shop. Several inappropriate comments have been made over the last few
years by the (male) sales staff about my female friends. I totally understand
that the model railroad hobby is 99% male, but these comments quickly force the
few women right out of there.

My advice to you would be to get an attorney, and file a civil action against
the store and the store management as a seperate defendant. you can also file a
hate crime/sexual harassment and assault complaint with the local police
department. At the very least, you will force this moron to have to spend a ton
of money defending himself . At the most, you might end up owning his business
in a settlement. what happened to your girlfriend is not only legitimate
grounds to seek a remedy in the civil courts, it is also prosecutable criminal
behavior. Someone needs to sue this man into bankruptcy. This is one case
where using the court system as a fiscal club to bankrupt someone through legal
costs, is justified. It will cost you very little to file the suit, and nothing
to file the criminal charges.

Yup, that's the solution for boorish behavior.... another law suit. What
damages have the parties really suffered? Geez, more of the courts time
taken up with another frivolous suit.


Don't spend any more money there, tell others and move on.

Seriously though "Just get over it" seems more appropriate. Forget
about it and take your business elsewhere. Enjoy the 4th - see a
fireworks show.

Why are we going on so about this incident?
I read the original posting and thought it sounded like something out of "Legally
Blonde", or a Monty Python skit.
I asked my self if I even believed it.
Then I wondered, even if it were true, why anyone would post it here.

Because there are laws against that sort of behavior. And the way the laws are
structured in this country, you can sue anybody for anything in tort law.
Remember: It's the lawyers who wrote the laws. One of their major interests in
tort legislation is keeping lawyers like themselves employed.

You also need to realize that America graduated HUGE numbers of law students in
the 80s. We have WAYYYYY too many. Can we send a few your way?

I agree. Not enough witnesses, double-entendres. No real economic loss. Hurt
feelings to be sure. Not clear-cut enough for a jury in my mind.

Spread the word and avoid the place like the plague.

I'm generally with LynnM on this one, as stated by the phrase, "it is also
prosecutable criminal behavior" (meaning the harassment part). However, I
disagree with the sentiment that "Someone needs to sue this man into
bankruptcy," which sounds like one is pursuing a vendetta. However, I DO agree
with the civil component of a legal action.

Last I checked, simply offending someone with boorish behavior hasn't yet been
deemed a violation of their civil rights. Folks really need to read up on how
harassment is defined legally in Ohio before encouraging someone to file what
appears to be a weak lawsuit. Some states require there to be repeated
behavior for a crime to have been committed. It might be more wise to leave
opinions on whether crimes were committed up to folks licensed to practice law
in the state of Ohio, and not to Internet legal novices.

Quite frankly, I think the idea of suing over an incident such as this is just
plain idiotic. I'd simply take my business elsewhere. If I were to consider
legal action over someone else exersising their constitutional right to be a
moron, I'd have to question my own intelligence, and if I should get a grip by
growing a thicker skin...

Steve零 hobbys is one of the major dealers with the Gats road shows and the
Dupage Illinios show.He also runs the largest show in northwest Ohio at
Christmas time.

I have known him for 15 plus year and he is even cruder than what you say.
You would hate to hear him referring to his employees and other dealers
before shows.

I never bought much but stop totally about 10 years after he refer to a lady
working for him a lazy bitch because she was slow putting up his display.
Interestingly I know because I have helped dealers on the road at times that
some of his employees buy from the competitors because they get better
prices

I regret he said something that hurt your lady friends feeling.

However you said you have been there before and he has acted in a similar
manner.

Why did you think he would change?
