i have to admit, when you are right ,you are right. just got back from
the peoples court.
i lost; the judge was in a bad mood. basically, because i didnt have
a statement from an arborist saying the trees were diseased, i was not
going to win. i knew that in the 1st 2 minutes. i told her how could
i get an arborist on to his property. she didnt care. he didnt have a
statement saying they were healthy. then the guy lied , said the
tree came down during hurricane sandy. it didnt, it came down later
in a snowstorm. the pictures had snow . she didnt care. she said it
was an act of God. . i said 1st time yes, 2nd time maybe, 3rd time
no. she didnt care. then she said it was a zoning problem, the town
inspector would make him cut them down, i should have called them. i
did that months ago, they said its not their jurisdiction, there is no
law to force a tree removal. you can only sue for damages if one
falls. you think i'd be in court if i could get the town to do it?
she's a rank whore, i will never watch that show again. i only did it
because in regular court, if i won a judgement, i'd have to chase the
guy down to get paid, maybe never . i did get 250.00 for showing up.
whether or not i would have done better in a real court, who knows.
it was the last case of the day, i think she was in a hurry to get
out. either that, or too may plaintiffs won and blew the budget for
the day.
i learned alot, for the next piece of shit tree that falls. and next
time its real court.
