Not having an idea what would happen in arbitration, you voted for the
legal risk to the Federation.

American dollars in six figures, and a foolish vote by an
internationally naive EB, was a low point for the Federation. Anyone
who voted for this fiasco, won't get my vote.

The "internationally naive EB" comment is little more than a vote for
Realpolitik, a proposition advanced by several, including Polgar. We
did resist FIDE's abuses of its own rules. I would unhesitatingly do
so again. I personally took every reasonable step to minimize risk to
the Federation, including extracting promises from others with massive
wherewithal to safeguard the USCF both on the score of liability and
legal fees. To date, the USCF has never paid a dime in money. The
CAS arbitration has ended. As for retribution from FIDE, the fact
that you even raise the prospect underscores the nature of the beast.
You will undoubtedly be able to find candidates who will promise to go
along to get along. I'm not one of them. I'm naive enough to believe
that principled process and action will further the interests of the
game more than resorting to expediencies.

Realpolitik, when dealing with the block votes Kirsan has (both Kirsan
elections had almost identical votes), reflects how Kirsan acts.
Either the European federations should leave the organization, or
remain neutral to assure accurate ratings, titles, and challenger
opportunities. I would suggest leaving, should Kirsan go for re-
election again.

As for the future, only time will tell. Again, our agreement in
writing is with Karpov 2011, Inc. I do not know of any written
agreement with any individuals. Do you?

Again, I do not know what agreement we have with the lawyers, who
handled this. Some say they will cover any new challenges, charging
only expenses. Some say everything will be free of charge. What do we
actually have in writing from the lawyers?

Everything has been presented piecemeal. Can we get a definitive
answers to any of my questions?

This has been hashed and rehashed dozens of times at a time far more
contemporaneous with the actual events. You've gotten good answers on
all of these questions years ago. You didn't read them, or you don't
remember. Karpov2010 promised through counsel to cover the USCF's
liability. The counsel themselves promised to provide [i]pro bono[/i]
legal support. But this is all moot, because "as for the future," the
Arbitration has concluded; the Court has decided. We don't owe any
money that hasn't already been paid by others. You'll need to tell me
what remains for Karpov2010 or White & Case to do before I can answer
further. The legal principle of [i]res judicata[/i] is in operation
here, meaning that FIDE is foreclosed from relitigating these same
issues.

We have been reading your posts and we do remember your inane
comments. It is you who have not been paying attention. You just took
up chess recently and have no knowledge of FIDE and the history of the
organization.

White & Case and Karpov2010 promised to cover our LEGAL EXPENSES.
Nothing else. I was at the meeting where they made that verbal un-
written promise.

It was Nigel Freeman, not Kirsan, who demanded that the USCF among
other countries pay $1,000,000 (one million dollars) in damages to
FIDE. I was present when Nigel Freeman made that demand. I did not see
you there. When Nigel Freeman made that demand, the delegate from
Germany, one of the five countries involved, collapsed and fell to the
floor. Ambulance came and took him to the hospital and he was
Medevaced back to Germany. I am a personal witness to this as I was
standing next to him when this happened.

I agree that FIDE will never get the one million dollars in damages
but the question is: If it were to happen that FIDE and the
arbitration court orders the USCF to pay one million dollars, would
White and Case and Karpov 2010 pay the million? Do you have anything
in writing from White and Case and Karpov 2010 to pay the million. If
it is in writing, which I doubt, would such a contract be legally
enforceable?

You have not addressed this question nor have you addressed the issue
that Karpov and Kasparov both have bad reputations as far as FIDE is
concerned. Since you are a newcomer to chess you have no knowledge of
this.
