The exception to not reading the Miranda rights is used in a situation
of public safety, where questioning the suspect for further information
may save lives, etc.
And your "red handed" part: in court, the defendants lawyer would surely
have a different view of whether it was "red handed." Not to mention the
fact that you'd be required to read the Miranda rights upon an arrest,
sans the exception.
You just "made up" that crap as a "smart remark," right ? Even you're
not that stupid. And if you just made it up, you're very close to being
that stupid.
But on the topic at hand, this terrorist doesn't have to be determined
to be an enemy combatant to question him without "Miranda rights" if
it's, as mentioned, a public safety situation.
The point is, it's doubtful that the Obama administration (that doesn't
even recognize a "Bushian" "War On Terror") will have him tried before a
military tribunal; and what's happened so far (no immediate Miranda
rights) is really no indication to the contrary.
McCain and Graham are just grandstanding in pretending that they're
conservatives on an "easy one" as usual, because they know damn well
that an "enemy combatant" status isn't going to happen under Obama.
