Officers in Fatal Shooting of Rayshard Brooks Will Not Be Charged

Mr. Brooks was shot to death in 2020, after two
Atlanta officers tried to arrest him. A special
prosecutor announced on Tuesday that the case
against them would be dropped.

ATLANTA — More than two years after Rayshard Brooks, a 27-year-old Black man, was fatally shot by a white police officer in the parking lot of an Atlanta fast-food restaurant, a prosecutor has determined that the officer who fired, as well as another officer on the scene, “committed no crimes” in the incident.

The decision to drop charges against the two Atlanta police officers, Devin Brosnan and Garrett Rolfe, was announced in a news conference on Tuesday by Pete Skandalakis, a veteran former Georgia prosecutor appointed to handle the case by Chris Carr, the Georgia attorney general. Mr. Skandalakis and another former prosecutor, Danny Porter, presided over a multimedia presentation about the June 12, 2020, incident, which they said showed that Mr. Brooks, by taking the taser of one officer and firing it at the officers, had given Mr. Rolfe justification to use deadly force, shooting him in the back and buttocks.

Mr. Porter described a police interaction that began cordially in the parking lot of a Wendy’s restaurant in South Atlanta, as Mr. Brosnan responded to a call about complaints that Mr. Brooks had fallen asleep, while behind the wheel of his car, in the drive-through lane. The interaction remained cordial as Mr. Rolfe arrived and subjected Mr. Brooks to a drunken-driving breath test, which Mr. Brooks failed.

But as Mr. Rolfe moved to handcuff Mr. Brooks and place him under arrest, Mr. Brooks lunged forward, instigating a brawl that left Mr. Brosnan with a concussion. As Mr. Brooks ran away, he pointed and fired the taser he had wrested away from Mr. Brosnan at Mr. Rolfe, who then fired his handgun at Mr. Brooks.

Mr. Rolfe was initially charged with a number of counts, including murder, and Mr. Brosnan faced a number of lesser charges. The prosecutors said they would move to vacate those charges.

The killing of Mr. Brooks occurred a few weeks after the murder of George Floyd by a Minneapolis police officer. That incident sparked protests nationwide and a vigorous discussion of the treatment of Black Americans at the hands of the police.

A fresh round of protests erupted in Atlanta after Mr. Brooks’s killing. In its immediate wake, the police chief at the time, Erika Shields, resigned, and the Wendy’s restaurant was burned down. The area around the site was briefly dominated by protesters, some of whom were armed and threatened passers-by.

On July 4, 2020, an 8-year-old girl, Secoriea Turner, was fatally shot while being driven through the area in an SUV.

'Republicans used the "defund the police" slogan after George Floyd's murder to paint the Democratic Party as radical. But since the FBI's search of Mar-a-Lago, a growing number of GOP candidates and lawmakers are rallying around their own calls to defund or abolish federal law enforcement agencies.

Why it matters: The new demands muddle a narrative embraced by Republicans long before the Black Lives Matter demonstrations of 2020 — that they are the party of law enforcement. They also show how much former President Trump has reshaped his party.

Strategists say it could jeopardize the GOP's chances in some contests in November.

The big question: Could this become the new Trump loyalty litmus test?

Driving the news: Dan Bolduc and Bruce Fenton, leading Republican Senate candidates in New Hampshire, said in a recent debate they believe the Department of Homeland Security and top agencies need to be significantly "reduced" and called for abolishing the FBI.

Anthony Sabatini, a leading primary candidate in Florida's 7th District, has long called to defund the FBI and tweeted on the night of the Mar-a-Lago search that Florida should "sever all ties with DOJ immediately" and arrest FBI agents on sight.

Tim Baxter, a candidate in New Hampshire’s 1st District, expressed support for abolishing the FBI in a debate on Saturday. Another candidate, Karoline Leavitt, called to "investigate, litigate and incarcerate them."

J.R. Majewski, the GOP nominee in Ohio's 9th District, says on his website's issues page: "I will fight to abolish all unconstitutional three letter agencies," including the CIA.

Sandy Smith, the GOP nominee in North Carolina’s 1st District, tweeted a poll with "Abolish the FBI" as one of the options.

Asked in a recent radio interview whether Republicans are "actually going to be willing" to defund the FBI, IRS and other agencies, Bo Hines, the Trump-endorsed GOP nominee in North Carolina's 13th District, responded: "Well, I mean we have to."

The position also has been embraced by
Texas GOP chair Matt Rinaldi and
Reps. Paul Gosar (R-Ariz.),
Lauren Boebert (R-Colo.) and
Marjorie Taylor Greene (R-Ga.), who is selling "Defund the FBI" merchandise.

All you did was spend weeks arguing that the police officers were guilty of murder. They weren't. Their actions were objectively reasonable. You can't understand that because you were, at best, a paralegal for 10 minutes 30 years ago. You must have been weeded our pretty quickly. They know I was I was called to the bar in BC on August 30, 1996 (i.e. I appear on the rolls of the Law Society of BC) and that I have never been disbarred or otherwise disciplined. I am not currently a dues paying member, because I don't see the value in sending them $500 a year to get a quarterly magazine. That also means I am not under their jurisdiction and I am not required to give them an undertaking, which is important.

Post I mentioned that after about 6-8 months the monthly royalty checks tapered down to nothing,
then stopped; as it usually does in book (and movie) royalties. They sell out a printing, and books that
didn’t sell return and that’s it.
