Derby man charged in bank fraud

A Derby man who was accused three years ago of trying to
use privately minted coins to buy beer at a Buffalo
Sabres game is the suspect in a federal bank fraud case,
U. S. Attorney Terrance P. Flynn said Friday.
Shane C. Buczek, 38, was arrested Friday on a charge of
violating the conditions of his bail from last March in
another federal case - allegedly lying on a passport
application.
In the latest case, Buczek is accused of opening an
account at a Best Buy store in the Town of Hamburg and
making several purchases - including a 52- inch
flat-screen television, washer and dryer - then
instructing HSBC Bank to obtain the funds to pay off
$8,800 by debiting a non-existing account, according to
an FBI agent's affidavit.
FBI and other federal agents raided Buczek's Derby Road
home Friday and seized "most of the items Buczek had
purchased from Best Buy," authorities said. The
investigation is continuing.
Buczek, who is representing himself, appeared before
U. S. Magistrate Judge H. Kenneth Schroeder Jr. on
Friday and is in custody pending a psychiatric
evaluation of his competency to stand trial.
He was indicted last March 4 on three counts charging
him with altering a passport application, making
false statments on the application and using a false
identification document while submitting the
application through the Postal Service. That case
has yet to go to trial. Buczek, who faces up to 10
years in prison and $250,000 in fines if he is
convicted in that case, had been free on bail
until Friday.
Last summer, a judge overturned City Court jury
convictions against Buczek and his father, Daniel,
58, in connection with a December 2005 scuffle with
a security officer at HSBC Arena after they tried
to use privately minted Liberty coins to buy beer.
