URGENT CALL TO ACTION 1099 REPEAL

On Monday, November 29, the Senate will vote on Senator Mike
Johanns’ (R-NE) proposal to repeal the new Form 1099 filing
requirements. The fully funded proposal will be considered as an
amendment to the Food Safety Modernization Act, S. 510. Senator Max
Baucus (D-MT) has proposed a Form 1099 repeal that is virtually
identical to Senator Johanns’ proposal but lacks an offset to maintain
budget neutrality. Senator Johanns’ amendment directs the Office of
Management and Budget to identify $39 billion in unspent and
unobligated accounts to replace the revenue that might have been
generated by the 1099 paperwork mandate.
Your Action is Needed: Contact your Senators and urge them to support
the Johanns Amendment when it comes up for a vote on Monday, November

this 1099 thing...they have been getting calls all summer from people
believing it requires a paper
form on everything over $600 that a person buys or sells, and that it
is sinisterly aimed at tracking
gold coins, but it applies only to rents, dividends, lawyer fees, and
has no effect on the ordinary
person. Looks like it has been spread on Limbaugh, Hannity, Fox News
and other conservative
outlets.

As to motive: Does anyone know whether Nick Pyle has any history of an
interest in numismatics? He apparently is a long-time lobbyist for a bread
bakers trade group in DC (which, like most of the business community,
presumably opposes the new 1099 requirement for their own reasons). Unless
he has ties to coin lobbying, dealing, or collecting, you have to wonder why
he started this numismatic lobbying group.
Even if he does have a past history of collecting or dealing, motive is
further clouded by the fact that he specifically calls for support of the
Republican version of the 1099 repeal. If all this were purely apolitical
and rooted in the interests of collectors and small-time dealers, he should
have urged us to support either bill because either one would obviate
whatever problem he imagines there will be for numismatists. Regardless of
whether you personally like or don't like the Republican version's
requirement to find cuts to offset the income loss, the position he has
taken 1.) Could lead to a deadlock where neither 1099 reform bill passes,
and 2.) Is solely in line with the Republican agenda, supported by most
industry and trade groups, to back-pedal on government regulations and
spending.
It's clear that some sort of clarification or narrowing of the 1099
requirement is needed. However, Washington is full of hidden-agenda
corporate "astroturf" front groups that advance their own interests by
masquerading as grass roots movements. A common strategy is to try to
co-opt other, more legitimate interest groups. Without more information,
I'm certainly not going to characterize this as just a blatant, cynical
attempt to enlist us in their fight; but IMO it does have a certain whiff of
partisan politics and freshly laid astroturf to it.

The new requirement needs to be fixed, but for the record:
1. It applies only to total purchases of more than $600 worth of goods from
any single vendor.
2. The IRS says that purchases using credit cards will not count toward the
$600.
3. The bill only expanded the reporting requirement to goods. Purchases of
services exceeding $600 already have to be reported.
Congress knows it has to fix this. It's just a question of agreeing on what
kind of horses get traded in the deal.

CLEARING UP 1099 CONFUSION
The NEW 1099 Law - IRS Form 1099-MISC
This 1099 law (Section 9006 of the health care bill passed earlier
this year) is scheduled to go into effect January, 2012. Under this
law you will have to report ALL purchases of goods and services over
$600 (including smaller purchases aggregated over the full year.)
Yes, that includes your retail clients, your fellow dealers (no more
corporate exemption), office supply stores, show travel providers
(hotels & airlines), etc.
Small businesses and associations (including ICTA) have protested this
provision so fervently that Congress – and even President Obama – have
acknowledged that it is a problem. Potential fixes include repeal of
Section 9006 (ICTA’s strongly preferred solution), raising the dollar
amount threshold to $5,000, exempting businesses with fewer than 25
employees, and exempting transactions paid for via credit or debit
cards. However, the administration is extremely sensitive to the word
“repeal” as applied to any part of the health care bill.
This is a top priority issue for ICTA, and we will be keeping you
posted on any changes or proposed changes where we may need you to
weigh in with your Members of Congress.
So in layman's terms - if you sell $600 or more to a single dealer in
2012 they are required to file a 1099 form with the IRS. That form
includes your ss#. The IRS computers will check income reported by
your 1040 schedule D & E and if you fail to report that 1099 income I
guarantee you will find greetings mail and a possible request to visit
with the IRS if not in person by mail. Your ultimate prize for
failure to report is time share from club fed. google Wesley Snipes to
learn more about that. For the guy with a top notch accountant in
Houston run this by them for confirmation that this isn't issue. Also
check with the US Chamber of Commerce and National Federation of
Independent Business websites. I repeat you need to find a new
accountant otherwise.

The motives of the people whp propose legislation is more important
than the legislation itself in my opinion. A lot of legislation could
be given short shrift if the motives for putting forward the
legislation were required by law to be spelled out. Also lobbyists,
and that means competing lobbyists, by definition, put their own
interests above the welfare of the country.

Following the money usually leads to a correct solution.
The working joe, for years, has had every dime he makes reported to
the
government. Wages on W-2 forms, with the money taken out in advance,
and held by the government until April 15, with no interest paid.
Every
bank, savings, or Paypal account with earnings over $10 a year gets
reported, and you get a 1099 form. When you sell stock, the broker
reports your proceeds to the government on a 1099. When your
mutual fund declares a "dividend" even in a year like 2008, you got a
1099 form showing your "gain" even though the fund might have gone
down 50%!
One group which has been exempt from having their income reported
to the government has been lawyers, doctors, and consultants who are
self-employed and function as "independent contractors"
These icons of ethics have been "on their honor" to report their
income
to the government without the need of their customers sending in a
pesky 1099 form for the government to verify their compliance.
Since most of these professionals have formed corporations -- your
doctor or attorney or CPA firm, or the consultant writing a $250,000
"study" for some taxpayer funded government agency -- have been
exempt
from having 1099 forms sent on THEIR income.
The new 1099 rules removing the exemption of corporations means that
a lot of people making a lot of money will have a paper trail on the
income that they HAVE BEEN REPORTING AND PAYING TAXES ON
ALL ALONG, right?
These small business trade organizations should be GLAD that anyone
evading
taxes will finally have to start paying up, meaning less burden on the
HONEST
people, right?
Where were the "URGENT CALLS FOR REPEAL" when President Bush, in 2008,
signed legislation requiring Paypal to report your eBay income,
starting in 2011?
Was there so much "grassroots" outcry that Congress started work on
repeal?
Did the president ever have to address the matter at a press
conference?
It certainly affects many, many more people than the minor 1099
changes to
add "corporations" to include "persons."
I guess corporations only want to be "people" when they want to spend
money to
influence elections.
Why have the ANA and ICTA jumped on the lies spread on talk radio and
Fox News

track of how much
they spend at each gas station and motel to send them 1099 forms and
that all

of 1099 forms?
Perhaps to generate mass outrage at the president and the health care

(they are the company that prepares CPA continuing education courses

While it clearly states what kinds of things have to be reported on
1099 forms under
the new law, the lack of any mention of retail or wholesale
transaction of ANYTHING
does not convince people who want to believe otherwise.

The Obamacare Gold Grab
What does healthcare have to do with gold sales? In the minds of the fascist
crafters of the Obamacare law: apparently a lot.
Tucked away in the 2,300 page bill, in section 9006, is a provision that
expands the scope of the Internal Revenue Service (IRS) Form 1099. Beginning
Jan. 1, 2012, a Form 1099 will have to be filed to report to the IRS the
purchase of all goods and services by small business and self-employed
people that exceed $600 during a calendar year.
This is an onerous bookkeeping nightmare for all small businesses. But
precious metals dealers will really take a hit.
“Coin dealers not only buy for their inventory from other dealers, but also
with great frequency from the public,” Diane Piret, industry affairs
director for the Council for Tangible Assets, told ABC News. “Most other
types of businesses will have a limited number of suppliers from which they
buy their goods and products for resale.”
One coin dealer told ABC News he deals with about 1,000 customers each week
and predicts he’ll be filling out between 10,000 and 20,000 tax forms per
year because of the new law.
“I’ll have to hire two full-time people just to track all this stuff, which
cuts into my profitability,” he said.
That may help the unemployment situation a little, or maybe not. Many
dealers will have to cut loose some on their staff who actively contribute
to their bottom line in order to hire someone just to create paperwork to
satisfy the IRS.
The ABC News report said the new tax provision was intended to mine what the
IRS deems a vast reservoir of uncollected income tax and was included in the
Obamacare bill as a way to pay for it. The new law is expected to raise $17
billion over the next 10 years.
What this provision truly is is another attack on small business and a way
to better track who is buying and selling gold.
Just think, if you decide to sell some gold or silver to a dealer because
you need some cash, the IRS is going to know about it.
The establishment hates gold in the hands of the public. In 1933 President
Franklin Delano Roosevelt confiscated gold from the American people. These
new reporting requirements will make very it easy for an oppressive,
overbearing, out-of-control fascist government to do it again.
House Speaker Nancy Pelosi (D-Calif.) said we’d have to wait until the
Obamacare bill was passed to learn what was in it. The bill was a stinker on
the surface, but the deeper we dig the more odiferous it becomes.

everyone does.
Therefore the grocery store, a business, is required by law to track and
report my purchases to the IRS.
Let me ask you this. How are they not going to know who has passed the $600
aggregate limit unless every single customer is required to present a SSN
and state ID for every single purchase, no matter how small?
The answer is there is no way really. You will be required to present a SSN
for every purchase at every store, even a bottle of soda might push you over
the $600 limit, so you will have to be tracked for every purchase.
For those who are Christians, this has religious implications. No one may
buy or sell unless he has received a mark or the number of his name. Of
course no churches will say anything about this unless it is to tell their
congregants that everything is fine and it is OK to go along with this

To whoever says individuals will have to send out 1099s that is wrong,
however if you (an individual for purposes of this exercise) for
example sell $600 or more in coins, currency or bullion etc to a
single dealer they would be obligated then to send you a 1099.
I don't feel compelled to argue the point further - it is what is.
The law takes effect in 2012 so data collection begins that year with
reports issued in January 2013. So frankly of your CPA isn't up to
date they still have time..
Frankly the IRS had yet to issue rule making guidance on the proposal,
just a speech form the commissioner saying credit card transaction
will be exempt, that data is already collected through other means.

· The tax code (as I understand it) covers tranactions that involve Federal
Reserve Notes.
· If you do not use FRNs, then the IRS has no authority.
· A transaction using FRNs is defined as a "sale".

determine the tax, and there is no? authority for such tax. Likewise silver
for gold trades.
Now the IRS might claim that barter transactions as taxable. Which would
mean that you have to keep tabs on the trades? you make and keep good
records of them so they can be *properly taxed* The IRS alleges to measure
bartered exchanges by using the market price of the goods or services
someone receives. In a swap, both parties have to list the market value of
what they received as income.
The IRS is insane.
If the transaction is a SWAP (an exchange of things considered equal)
then there is NO PROFIT to tax.

The Senate late on Monday November 29 failed twice to repeal the
enhanced 1099 reporting element of the health care overhaul even
though a clear majority of Democrats and Republicans agreed something
needs to be done. The Democratic plan, sponsored by Senate Finance
Committee Chairman Max Baucus (D-MT) to overturn attracted only 44
votes in support with 53 against; a Republican plan from Senator Mike
Johanns (R-NE) that would have cut other programs as an offset to the
revenue the proposal lost by the repeal fell short on a vote of 61 to
35. Senate Majority Leader Harry Reid (D-NV) late last week weighed
in on the intense partisan dispute and set a supermajority threshold
of 67 votes to eliminate a provision that critics have seized on to
illustrate the failings of the health care legislation.
The failure to pass either of the two Senate votes on repeal
diminishes chances for some relief during the lame duck session of the
111th Congress. However some say the support garnered from both
parties bodes well for eventual action. What is clear – having
dueling Democratic and Republican proposals allowed lawmakers to
register their disapproval of the 1099 requirement.

The copy machine, the lawn guy, advertising, rent, attorney, accountant,
fixed assets. And if you pay with a debit or credit card, you won't need to
file a 1099 in any case. Any business is foolish that doesn't already pay
with the many small business cards thay pay cash rebates. Retail sales were
never intended to be included. That's just hogwash from the Cato Institute

Instiute article actually concluded that instead of trying to collect income
that tax evaders don't pay, a better solution is massive tax cuts, which
would reduce the incentive to cheat!

We already know that Obama's mentor and facilitator George Soros considers
the manipulation destruction of countries and their peoples an enjoyable
game. Soros looks at said countries and humans as mere puppets in his
playpen, useful only to satisfy his wicked desires to control them--totally.
On 3 June 1993, Soros is quoted--one of his more benign ones--by the
Independent as commenting: "It is sort of a disease when you consider
yourself some kind of god, the creator of everything. But, I feel
comfortable about it now since I began to live it out!" Megalomania is a
Soros attribute. And as a perennial persona non grata, he has been thrown
out of multiple countries (including Great Britain and Malaysia) and banned
from returning to them. Now he has laid the plans and--with Obama's
assistance--is in the process of destroying the USA. The Obama seems to be
following his master's every command. Let's take a look at what Soros'
apprentice has already accomplished. These are accomplishments of which The
Obama is proud--very proud, indeed!
1. Obama has stolen most of US taxpayers monies and--via new intrusive
programs--is bent upon taking the rest of it
2. Obama has given his billions of his ill-gotten dollar gains to foreign
countries (including China) for THEIR work forces, while eliminating (now at
30 million and rising) American jobs
3. He has effectively nationalized the auto and financial industries and now
seems to have his sights set on the airline industry. Note: The US
Government already controls the US train system via Amtrak
4. Obama now controls our bodies, medical care and the time of our deaths
via his massive and all-intrusive and forced-down-our-throats "ObamaCare"--a
program that has little to do with health care but, everything to do with
control of human bodies and minds
5. Although the TSA was installed before The Usurper Obama assumed power
over We-the-People, he is now using it as his personal "conditioning the
masses" tool. Not only are adults being sexually groped but, more and more
frightened and screaming children are also. I've included a number of source
references at the end of this column but, there are simply too many to
include all of them here
6. Although I presume not all TSA agents are as vicious as the ones depicted
are, the TSA has--for reasons we now know--announced that ALL cameras will
be confiscated and no one may now film the sexual, humiliating and still
illegal-in-any-other-venue groping by TSA agents. By the way, where are the
decent TSA agents? Have they contacted their union and advised them they
will not proceed with these aberrant behaviors? If not, why not? Note:
Folks, this has nothing to do with security but, everything to do with the
Obama/Soros program to create an even larger group of Sheeple--those willing
to submit to anything and everything. More control of humans so they will
march more submissively to some newly-planned gas chambers?
7. Still using the proven hoax (aka "lie") of "global warming" as his
excuse, The Obama is bent upon passing a bill to restrict if not end
individual energy usage in the USA. The prices would be so high that few
could afford it. More control of humans so they will go back to tribal
fires?
8. Obama & Co's plan to control ALL of America's food sources--including
home gardening in the Orwellian proposed bill S 510. Although some of the
more draconian measures are said to have been stripped from the proposal,
from experience I know it's easy and even usual for the Marxist
congressional leaders to enter them back in before going to a vote. Please
continue to call your Senators (202-224-3121) and demand they vote "NO" on
this additional attempt at enslavement of We-the-People
Sadly and as usual, there simply isn't enough room to discuss all of the
ills Obama & Co have brought to this country and all of the particulars of
their war against us. Don't forget they are still--against the will of the
American people--trying to pass the DREAM Act--a first-stage effort toward
Amnesty; the creation of a new Democrat (aka Marxist) Party voting bloc. We
need to remember that winning the House with conservative constitutionalists
was only the first step in taking back OUR country.
The Marxist ruling class now in charge of congress plans to leave no earth
unscorched before it leaves in December. Our next steps must be to stop
Obama and his policies in their tracks. A gridlocked congress is a good
congress! Next election, we must vote out the rest of the Marxists up for
reelection--this includes RINOs--and replace them with true
Constitutionalists. We also need to include prayers to God with our actions.
And with reference to the TSA? Let's ALL just say NO to the groping and stop
this insanity! Remember, the TSA is NOT affecting full body "pat-downs" on
Muslims. Hmmm. Is that merely more insanity, another Obama/Soros perversion

If you believe that the federal government is evil and you also adhere
to any creed that prefers good over evil, you really have 2
alternatives. A full and intelligent discussion of the subject is in
Rheinhold Niebuhr's, "Moral Man and Immoral Society".
Broadly, the choices are to change the government or to leave the
country and if it is sufficiently evil work for its overthrow.
Really, the braver course is to work to change the government. In
doing so, the more obvious avenue is to run for public office. May I
also mention that getting elected is usually difficult and it earns
you the right to have all of the complaints directed at you. If you
choose that course, I feel quite safe predicting that it will change
your perspective on your leaders, enormously.
Read the book and think it over.
