Two trials remain in connection to failed rare coin case

December 25, 2008

What happened

On Nov. 8, 2007, two people burst into a home on Mayflower
Road in the Town of Ellington. One of the two men had a
handgun and knocked down the female member of the household.

The woman shouted to her husband, who replied that he
already had called police.

The two men were spooked and fled the scene, empty-handed.

An investigation conducted by the Outagamie County Sheriff's
Department revealed the couple had responded to a classified
ad a few weeks earlier advertising the purchase of rare coins.

The couple indicated to the advertiser they were interested
in selling their coins. It was determined the ad was placed
by Frank Dimatteo, 54, of Appleton, who authorities said
plotted the attempted robbery.

Ultimately, six people, including Dimatteo, were charged
with playing some role in the planning or execution of
the failed robbery.

What's new

On Dec. 17, Dimatteo was convicted in a jury trial before
Outagamie County Circuit Judge Mark McGinnis of conspiracy
to commit burglary. McGinnis scheduled sentencing for
Jan. 29.

Two cases out of the six remain unresolved:

Robert Losse, 25, of Menasha, is scheduled to go trial
Jan. 8 on charges of attempted armed robbery and burglary
as a party to the crime.

Bobby Boshers, 41, of Appleton, is scheduled for trial
on Feb. 23 on charges of attempted armed robbery and
burglary while armed with a dangerous weapon as a party
to the crime.

Of the others:

Frank Kersten, 20, of Menasha, was sentenced to five
years in prison and two years of extended supervision
on a charge of attempted robbery as a party to the
crime.

Myles R. Friebel, 20, of Neenah, was sentenced to
two years in prison and five years of extended
supervision on a charge of conspiracy to commit
burglary.

Daniel N. Morack, 26, of Appleton, was sentenced to
two years in prison and three years of extended
supervision on a charge of burglary as a party to
the crime.

According to Assistant Dist. Atty. Kyle Sargent, who
has handled all six cases, it was never made clear
which two of the six entered the home on Nov. 8, as
those involved blamed each other for the robbery.
