I need legal advice...
1. Is pacing a legal way to catch speeding in AZ?
2. Why are cops dicks? Not all.. but many. This cop's words were...
"I was HOPING you'd speed up to 86, so I could take you to jail today,
but no such luck I guess."
WTF?!?!?! FUCK YOU!!!!!!!!!!!!!!!!!
Then when I KNEW I was only going about 78/79ish, I asked to see his
radar. "I didn't clock you. I was pacing."
Never did I admit to speeding, or my speed.
Any advice here people?

I had a cop tell me he had me on radar at "8 or 9 over so I'm writing you up
for 10." I was young and stupid and just paid the ticket. Dumb, dumb, dumb!

Basically, you're screwed!
I'd still show up in court to plead your case though. Sometimes, if you put on
a good face the judge might only put you on probation for 90 days or so. It's
well worth your time considering what a speeding ticket will do to your
insurance. Good luck... and be more careful next time...

Could ask for the ISO 9000 paperwork showing it was calibrated
back to a standard source and that the calibration was preformed
on a regular basis :)
Find a good lawyer. Pay them. Let them do all the work while you smile at
the cop as you leave the courthouse scot-free.
I ALWAYS get a lawyer for moving violations, if I can't do the defensive
driving thing. Their fee is around $150, which would end up being less than
the cost of the ticket, court costs, and inflated insurance after it got on
my record. I'd much rather pay someone else than the city.
Oh yeah, get a radar detector (Valentine 1 is the best, but expensive) if
they aren't illegal there.

PS, you might consider filing some sort of complaint against this cop for
what he said. Who knows, next time he might *say* you were going 86 so he
could take you to jail, even though you were doing 80, or whatever.

It is in Louisian, sort of. I got out of one because he couldn't catch up
to me, he said I was going 75 when, in actuality he was doing 75 to catch
up to me. I think it's a little cheesey myself.

One more firm and solid piece of supposrt for carrying some sort of
recording device in your car at all times. Laugh if you want, but after
seeing the 20/20 report on the State troopers in West Louisiana who were
confiscating property without just cause, I have a little mini tape
recorder that stays in the console.

I think it'd be worth the consultation fee of $50 or so to ask a lawyer.
Then, by all means, contanct the internal affairs dept. and admit "yes I
was speeding and I really do not have proof, but his sttitude was uncalled
for". The one speeding ticket I got really did not bother me that much
because the cop was so disgustingly nice I was ready to pay him.

I'd say shouldn't just because so many cops are pricks. I always found it repugnant that the court would automatically believe a cop over a private citizen just because he is a cop. I felt this way before, during and still do after having been a deputy sheriff for a number of years.It should be legal in all 50. I don't see why it wouldn't be.

He was *paced* by the patrolman, remember? A radar detector wouldn't
have done a thing for him in this instance.

Actually, Jay, this isn't always true. Here you can record any
conversation with the consent of only one of the parties. It doesn't
even require a court order. Many of the police cars in the midwest are
equipped with cameras, and the officers wear microphones. The
department in our city records all traffic stops, just in case they need
evidence.

AFAIK, it is 21 mph over the posted limit. At that point, you can
be charged with reckless driving, which is a criminal cite. It
probably varies according to locale.

Usually. I don't speed or commit other crimes unless i'm prepared to pay the
consequences. if i get stopped for speeding, i don't argue. if the officer
asks me "do you know how fast you were going?" I politely say "yes, officer,
between <speed> and <speed>"
Then, he asks me for my license and registration, which i keep in a leather
wallet type deal that is used to hold my courtesy badges. ANybody have these?
Their badges given to an officers family member(s) to let an officer know that
there is an officer(s) <4 in my case> in the guy/gals family. The cops usually
let me go and tell em to have a nice day unless i'm doing something REALLY
dumb. Unfair? Probably. Am i going to get flamed? OH yea. bring it on.

I pushed it today myself. Major radar traps running along 132 here in
Central CA all day. I counted 14 bears in one hour, writing people up
for doing over 55. We even had a coveted Federal Polar Bear pulling
people over today. (white CHP car - mainly there to stop drug
trafficking.) Anyway, was pushing it to get in ONE LAST LOAD before the
quarry closed at 3:30. Pushed it to 65, and watched my mirrors like a
hawk. I got lucky, and made it to the pit 2 mins. before they closed.
But, I could just as easily have been written up for 10 mph over, which
for a trucker, would cost me $1874.00 in that county. Yes, nearly TWO
THOUSAND DOLLARS, for doing 65 in a 55. All cites for truckers are more
than for Class C drivers. :(

I did not SAY that. You are reading between lines and adding words. This reply was

That's why I think that federal law only applies to the telephone and to other
peoples domiciles. In Louisiana your car is considered an extention of your home,
which is why you could carry a gun anywhere in your car even before we had conseal
permits. So on that note I can have a tape recorder running in my caf if I want to.
You can not tape on the phone or tape in other peoples homes <or office> without
their knowledge. Which brings to mind why the Feds think it's ok for them to do it to
Edwards even though he probably deserved it. Interestingly enough this law says
specifically says audio, which is why cops have trouble prosecuting the sick-o's that
video tape renters but only tape the video w/o the audio. If you live where the cops
wear mics and have a video going all the time, then I doubt he would be a smartass.
Unless he turns his back to the car, smashes his thumb over the Mic, and say, "I'm
gonna whup yer aise boaaay"...

The reckless ticket was for the burnout, and the other was because he
tried to loose the cops in a crowded apartment complex. The only reason
they caught him was because his had coil come loose and grounded against
the block.
One of the tickets was for about 800 dollars, and I guess he was lucky
that he didn't have his butt hauled off to jail by the Mukilteo, WA
police...
He took it to court (!?!) and had it reduced to about $300, which he
called chump change. He was angrier at the coil for coming loose than he
was at himself for doing something so stupid.
He weren't too bright, if you catch my meaning :0)

Oh, that's true, but if he had had his radar on at any time before he saw
him, then that might have made him slow down. I should get one myself..but I
keep finding other areas to spend ~$400.

I have heard from many friends and other people that here in TX, if you
double the limit, or are going over 100mph, they can take you to jail if
they want to. I'm pretty sure they can take you to jail on reckless driving
as well, if they felt the need for it.
All that is second hand info, but I'll try to find out for sure what the law
in TX is.

in this country its not even funny.. We pay the law enforcement's salaries,
the politicians salaries, but do you think they work for us? Ohhhhh no..
Not only that, they have the nerve to charge almost 2 grand for 10 over? I
better just stop right now........
Oh and to the guy with the ticket, get a lawyer, pay the standard 150
dollars, and wash yer hands of it completely. No ticket that costs more
than 150 dollars, no points, no insurance hikes, no need to bother to go to
court and waste your time. Money talks in politics, so use it to your
advantage. My advice of course, it would be wise to take it..

The best protest IMO is for large numbers of people to never
exceed the speed limit. Eventually the gridlock will sufficently
annoy enough law makers and large company excutives to change
the limits and with them the laws and how they are enforced.
When large companies start loosing millions due to traffic tie
ups and shipping problems then things may start to change.

month for an illegal right turn onto an interstate on-ramp.
I can't decide if or how I'm going to fight it. Judgment day is the 22nd. I
was very courteous to the cop, and he likewise. The ticket is $115.

For those of us in NC, I will pass along NC law to help ya
out----you can be arrested by an officer when you are doing 15 over the
limit. That is a misdemeanor and means you can be arrested. If he asks to
search your car and you were doing 15 over, and you don't have something to
get ya REALLY busted, better let him look, or he will arrest you and search
the car anyways. I am an x-cop in NC and I know of at least 3 times my
partner used this to get into the car and to the evidence he wanted. Goes
like this: the guy was arrested first for the 15+ over limit (because he
said we couldn't search), then re-arrested for the
<drugs/paraphernalia(spell?)/etc.> after getting it from a LEGAL search of
his car due to his being under arrest at that time for speeding and we had
to "inventory" his car........
Onto an even more funny note. Bad guy in car says you can't search.
Why, sir, your tag is expired. Arrested! (yep, that is a misdemeanor and
you can be arrested.) Search vehicle then. Better keep under a misdemeanor
at all times OR let the officer search is the moral here.......
To help you with the ticket: Get a lawyer. Ask about a PJC. "What
is a PJC?," you ask. It means a "prayer for judgement" or something like
that. Lawyers use them all the time. Basically it is deferred judgement
for 3ish years and if you don't get another ticket you are "set free" and
that PJC ticket never happened. HOWEVER, the bad part, if you get another
ticket in the same jurisdiction and it shows up in court, you get that PJC
ticket AND the new ticket instated in full. Or so was my understanding each
time 'the Lawyer' pulled this one on me.........I liked it because it made
the people slow down for 3 years cause they felt they had a reason to "be
good." Which is why I gave them the ticket anyways......this is why I NEVER
objected to a PJC while I was an officer.........in other words, officers
AND lawyers like them, so judges give them........problem is, it is a one
time deal.........so you don't get them but every 3 years.....and you WON'T
get one if the judge/officer/DA knows you have had one lately.

Exactly. Even more than that, it records times on the camera. That
way, it eliminates the possibility of an officer turning off the
microphone and getting in people's faces. Even if they shut the camera
down, it still records time. If someone comes in with a complaint, you
can look at the time logs. If the camera is off, but the officer
doesn't go back on duty with dispatch for another 10 minutes, we start
to ask them serious questions. It really takes care of the a-hole
problem. We had one cop here like that when I started. He's not here
anymore :'), and in fact isn't in law enforcement.

Would you be talking about "deferred adjudication"? This is the same thing
where they let you off the hook, unless you get ticketed again. However I've
never had nor heard of a judgement that lasted for 3 years! I'd not even go
for that, there's no way I'll not have a ticket in 3 years! Three months
would be much more feasible ;).

I would have figured he'd goto a different agency that didn't have cameras.
That's what all the La. cops did that got caught by 20/20 stopping people for BS
reasons to confiscate their cars under the drug forfeiture law.
Nah, not around here. If you get "released" from a department in this
area, you'll end up working basically private security. They don't want
to inherit problems.

there are always loop-holes. You place a cell phone call to your
house and let the answering machine record the conversation of you and
the officer. And just lay the phone down on the dash on while you
talk to him. Letting officer know that your in the middle of a phone
call. Then he knows your on the phone. Granted he doesn't know that
your talking to a machine, but that is what he gets for assuming...
