APPOINTMENT OF UPALOKAYUKTA SET ASIDE

In a judgemnt Karnataka High Court Bench comprising Justice N. Kumar and Justice Kempanna set aside the appointment of Chandrashekharaiah as the Karnataka Upa Lokayukta.

The bench found that the selection prcedure adopted the by CM is not in conformity to  law and hence the appointment is illegal, non-constitutional and void.

 They have uged the respondent Nos. 1 & 2 to expeditiously start a fresh selection process as mandated by the Act to find a New Upalokayukta as the post cannot be held vacant for long.

 The court has also suggested guidelines for the selection in which Chief Justice's opinion will have the primacy.
