Any updates on Queensgate ?

Hi All,

I had sent an email to Lakshmi today seeking information on Queensgate and I received expected response:

"Kindly be informed that the approvals are expected very soon, as we are in the last lap of seeking the pending ones, post which the work shall pick up the desired pace.

Hence, request you to kindly be attuned to our next communication in this regard.

Regards,
Lakshmi."


Did anyone else contacted or has any updates, Kindly share ?

I had spoken to sales person some days back regarding the status and possibility of cancellation, he told that HoH has a new legal team In place and should have updates by end of Jan, and asked me to hold as they are positive that they will get the pending approvals. Not sure how much of what he said is true :-)...

People are helpless and therefore remained silent :).. These standard answers we have been getting from them since the time I booked my flat, so no one knows why it is taking such a long time in getting approvals and when exactly they might get the same. Only thing we can do as a group is set some deadline and threaten the builder that if there are no approvals by so and so time frame all of us will cancel off our bookings in one shot; I am not sure how many can come forward and cooperate though...

A joint effort as a group is really required then only they will take queensgate investors seriously.

Cancelling is not an option, since we are losing the entire booking amount (20% ) paid. So the HOH is not on loss here, its us !
Not sure if this move will threaten them, but yes, we are taking a legal step against them, that makes sense. They have to clear why the approvals are pending for more than a year now.

I have discussed with CRM folks and we do not lose 20%, only 25K+ ST. So yes cancellation is an option.

 I just got off the phone with Lakshmi after a heated discussion, she said there will no refund , since MOU is signed and it says 20% of the amount.

May I know whom did you speak with ? There is a lot of discrepancy in information here.
I will try to speak with Kumar today afternoon and update.

I have spoken with Lakshmi and Sumit from CRM. Although I don't remember signing any MOU with HOH for my booking.

I spoke to Kumar Guru couple of weeks ago. These are the options available --

1. Switch to LV or CM and pay the difference (current price)
2. Wait it out for QG -- he says there will but it being a project from Hiranandani, you should get your apartment eventually
3. Cancel. In this case you will get your 20L after your unit is resold.

The options in the mail below have been on offer for over an year now.

Given the legal hassles and no approvals QG may not be launched any time soon.

We gave up on them last year.

The only other way may be to form an group and go legal.

As most of you are aware we have one whatsup group also for Queensgate owners. We are planning to contact as a Group to  hiranandani higher management to get issue resolved on priority.

Has anyone consulted a lawyer who can talk to all in the group and advise what action needs to be taken ?

Let's set a timeline and in case the timeline is not met all we have to do is to cancel the bookings collectively with builder paying us some interest on our booking amount. May be we can take some legal expert's in this regard.

Well, since we have signed MOU, they have flatly refused to refund any amount. I'm not sure about others, so far it looks like a deadend for us !

Which MOU, are you talking about the initial allotment thing(letters & related papers)? I am not sure about their legal validity, we don't even have a sale deed signed so shouldn't be a problem. We agreeing to their clauses in allotment doesn't necessarily mean the builder can delay the construction indefinitely, every damn thing has an expiry date. I am sure if we go as a group and try sorting it out only then we will see some progress, otherwise we end up hearing the same standard answers.

I spoke to Kumar when I was in India last month, and he said the same thing. I agree, they cannot take us for a ride even if MOU or whatever has been signed. I'm all in to go collectively and seek answers to why BBMP approvals are taking so long, they have to provide legitimate reasons at least.

All he said, since they are govt matters, he is unable to get the date when approvals would be done. That story is being said for months now. Things definitely look gray now. If some of you guys are in Bangalore, lets pitch in a lawyer and see our stand. We can share the fees amongst us.

Absolutely agree. Recent call HoH Rajesh said that the launch will happen in April now.

The current phase Club Meadows etc are being handed over without occupancy certificate. People are tired after having waited for the building for so long that they aren't bothered about occupancy certificate and all.

At the rate that QG is progressing I envisage myself to be in the same state at some point in time.

The MOU doesn't hold good going by what has happened in other instances across India. As a group if we approach the civil court, the amount could be refunded along with the interest for delay.

Albeit that a GROUP is formed and a lawyer is given power of attorney to represent the group in this particular matter.

I am in. Is there anyone in our group with good local background or is it like everyone is from different other states?

 To me approvals just appear as an excuse while real reason for the delay seems to be else where, my guess is LV & CM buyers are not coming forward for registration as their OC & amenities are still pending. Because there are no registrations from these buyers, builder doesn't have money to spend on QG, kingston & Penrith. When they have money, the first thing they do is siphon it to buy extra assets, so it will always be in a rotation in their case. So unless we pressure them, the builder usually tries to get away citing approvals as the reason.

If anyone with good local background comes forward, I assure him/her that we will all stand behind him extending our fullest cooperation & support.
