Issues with allowing empty NLMSA?

Are there any issues in allowing the creation of an empty NLMSA? I see
in the cnestedlist code, it checks a variable 'ntotal' to see if it
would be creating an NLMSA with nothing in it. Is there a reason for
this? I removed this check and it seems to work fine. When trying to
use it, I get a KeyError because there is nothing in the
prefixUnionDict (which to me is an error I can handle).
