Hi everyone

Just a quick update

I am now confirmed to go to LACIGF
The agenda of the event has also been published, but they are more
topical areas and no speakers published yet.
So I'm attempting to arrange some informal meetings about the theme of
the DC and the live document ready for sign-up.
I've sent messages about the DC to LACIGF community mailing list and
APC LAC - the civil society organizations on the MAG at LACIGF are all
APC.

APrIGF has also released a draft of its synthesis document and I
contributed w/ a comment mentioning the DC and the LACIGF informal
meetings on the relevant section of the workshop with DC members.

this is fantastic good news! And thanks very much for drawing the attention in the synthesis document. Is the final version already online? Should we also try to sent a joint contribution to the draft?

@KS what do you think? this sounds like a goal the team during the APrIGF could work around?

@ Latin American members: will you be attending the LACIGF?

I really love the idea that this year we started the conversation in Brussels and now Bangkok and Panamá.

Martin, this is great news, thanks! I think it would be good if we doo
a side meeting at LACIGF. Let's think about this and hear otehrs.

Lorena and all, anyone can comment on APrIGF doc until 19 July. Doc is here

And, for the 1st time, IGF Brazil (called Internet Forum), receives
proposals for sessions. It will be in Rio in november. So how about
adding another city to this DC's adventures? It will be very likely we
can have you all via remote participation. That is, if we are approved

Also confirmed for LACIGF and it will be a pleasure to join you and the fellows and try to move a bit forward with the ideas of the DC, Renata.

I am unfortunately not going to be in Brazil for the national IGF, but if the group thinks it is a good idea, we can try to propose a session on the subjects that matter for the DC, and not only as our own initiative, but also through the other stakeholders we are connected to in the country.

I guess a face to face meeting in Panamá with some of you can help us spark these ideas.

Dear colleagues -- I am thinking of submitting a short summary of the following statement made at Mexico IGF 2016 to the synthesis document. What do you think? Or shall we submit our joint statement into the synthsies docum?

Right to be Forgotten is not very welcome in Asia for a reason. There are many former colonies and dictatorships until recently which have not resolved these injustices or oppression that remain in their societies. In addressing those structures, they need to see the whole truth, not partial truth. Not truth just about public figures, not truth only about high level officials who collaborate with dictatorships or colonial administrations.

Proponents of Right to be Forgotten say that it doesn't apply to public figure, but sometimes you need more information to decide whether someone is public figure or not. If the information is delisted, you really cannot make that determination properly.

People have collective right to know the wrongs of not just others, or even themselves. Collective right to observe, evaluate, and retain what they see in one another. So that they do not repeat the wrongs.

The second reason is that there are already many laws in Asian countries that allow suppression of truthful information which is the role that Right to be Forgotten is fulfilling right now. For instance, in Korea, we have a truth defamation law so instead of making Right to be Forgotten requests to Google search engines, they can just go to prosecutors and ask for indictment of the person who spread truthful information about themselves.

The third reason is that RTBF, currently framed, is administrative censorship. Non-judicial administrative body, namely data protection agencies, are empowered to order search engines to manipulate search results. Administrative censorship has been abused deeply in Asia for blinding people from truths inconvenient to the authorities, as you could see in recent internet shutdowns in India. The danger of administrative censorship is that lawful information can be taken down due to progovernment bias can dilute those decisions. Also, the subject of orders are likely to challenge the decision even if there is a judicial review process because the government can always retaliate even just for challenging it.

Some people like to believe that data protection authorities are different from other organizations that have conducted censorship but I do not see it that way. I already see the evidence that in Peru, other Latin American countries where DPA is really playing the role of censorship. And in Korea, the dangers are also being played out. Internet censorship is not taking down unlawful content, bus taking down unethical content and what is ethical is decided by these nine Korean males in their 50s and 60s and nobody can really get a consistent principle out of that.

I like that you are taking into account the regional perspective
It is a strong, important statement

My suggestion would be to end also with a reference to the joint statement.
The reason would be to show that regional concerns are also present in a global perspective.
You are not alone.

First of all, a big +1 to your statement KS. In fact, I feel almost embarrassed that I didn't realize that central point earlier: that the public domain is vastly different from country to country and region to region, inextricably tied to its history, society, and culture. So, that is an important element to tease out when discussing "publicness," especially at the global level.

Moreover people who in the past were not public personas, may become public figures in the future. Then their past may matter.

And surely we can do it as individual members of the DC and

To all, the event today was a success.  The organizers told me it was the most attended session so far(they count it and announce to the Steering Committee and I will see if any of the latter sessions exceeds ours).  Also, despite the huge number (150?), we could have focused discussion through which you could feel the general consensus that Asia should not adopt RTBF as a rule (which some described as foreign) but only in exceptions in the case of child’s postings, sexually intimate images, identities of sexual crime victims, etc., which they also recognized that can be disposed of by the finetuning of privacy rules.  Also, Kelly courageously promoted our Joint Statement and collected the contact information from the people who showed interest in signing, 20-30 people.  

 

Finally, I think that we should update the UN IGF website before these people will come and view the page.

One is PDF with the names of initial signatories https://www.intgovforum.org/multilingual/index.php?q=filedepot_download/4516/576

The other is the google doc https://docs.google.com/forms/d/e/1FAIpQLSftuxOmHMYdPVWQY3UOoZYnVd_eyWwUMi06nAh3LeVa7E-G4g/viewform?c=0&w=1 where people can sign.  We should separately present these two links. The way they are presented now, people may just press the first link and decide that the letter is already closed for signature.  Also, we should show an UPDATED LIST of signatories somewhere.  If we do not replace the initial signatories list with an updated one, we should create a third link where people can check an updated list.  Then again, I understand that updating a UN webpage will take time.  If so, we can create an outlink where people can view the updated list.

I've just found out LACIGF will have a keynote on RTBF by Carolina
Botero - Fundación Karisma

I have - yet again - sent a note to a civil society list on the DC
existence, there will be likely a civil society meeting there a few
are involved
I tried to send the link to the statement to sign up but can't get it
to load here IGF website page
Can anyone send it to me?

I have now finally landed in Panamá

I was worried for a while I would not get here. As you may have seen in the news, Venezuela is in a very unstable moment and 9 airlines have been avoiding its airspace. Except, fortunately for Copa. Flying from north Brazil, one goes through south Venezuela.

This crisis can be all related to govs and transparency. See how this DC has its work cut out? ;)

Hi Lorena

I ended up using the Open Mic on LACIGF at the end of the session on RTBF
It was actually a keynote by the former rapporteur of the
Inter-American Human Rights Commission, Carolina Botero Marino
She gave a panorama of RTBF

In mic I've highlighted the DC's work and the need for a more global
perspective on this
Also how RTBF vould be used w/ political purposes
The speaker discussed about good rulers and bad rulers and how this be
shaped by the record left online about a gov

I did not find official records of floor interventions, unfortunately
But I guess we can try and continue to mention the theme to gain more
traction in LAC
