EMPOWERING DISTRICT COURTS WITH WRIT JURISDICTION
Kindly recapitulate that Article 32(3) of Constitution of India provides, “Without prejudice to the powers conferred on the Supreme Court by clauses (1) and (2), Parliament may by law empower any other court to exercise within the local limits of its jurisdiction all or any of the powers exercisable by the Supreme Court under clause (2).”
Invoking jurisdiction of High Court or Supreme Court is a hard nut to be broken by common Indian and the Constitutional Courts have been enjoying monopoly in the matter of Writs. The power is centralized to few (400-500) hands. Centralization of power generates corruption and many other illnesses to society. The decentralization of this writ jurisdiction may ease the difficulties faced by litigants and give them a breathing relief – lessening distance coupled with fewer expenses.
Therefore, please request Department of Justice and Law Commission of India for preparing a draft for the purpose for betterment of the citizens. However an initiative may be taken at your end too by providing that the District Courts may follow, mutatis mutandis, the relevant procedural rules for the time being adopted by the State High Court to which they are subordinate.
