VALUATION BY COURT CLIENTS – THE ROAD TO IMPROVING

FUNCTIONING OF COURTS

I have come across a news item appearing in media as under:-

The CJI said, "If I am a trial court judge and you publish a survey projecting that 90% (of the) people feel the judiciary is corrupt, then I will think it is an aspersion on my integrity. I will be fully within law to issue notice to you and seek your reply on referring contempt proceedings to the HC."( http://timesofindia.indiatimes.com/india/surveys-on-graft-in-courts-can-invite-contempt-case-says-supreme-court/articleshow/57281514.cms)

 

This apex court has also observed, “In our view, if a speech or article, editorial, etc. contains something which appears to be contemptuous and this Court or the High Court is called upon to initiate proceedings under the Act and Articles 129 and 215 of the Constitution, the truth should ordinarily be allowed as a defence unless the Court finds that it is only a camouflage to escape the consequences of deliberate or malicious attempt to scandalize the court or is an interference with the administration of justice.”(Indirect Tax Practitioners Association versus R.K. Jain)

 

I would like to draw your pointed attention to the fact that surveys are being conducted by Governments abroad through private firms to improve the functioning of courts.( https://www.coe.int/t/dghl/cooperation/cepej/profiles/Latvia_evaluation_satisfaction.pdf )  The courts are being run out of the money contributed by public therefore they cannot be left free like an uncontrolled horse to function according to their whims and fancies. The judges are public servants and accountable to public for their every public function. In view of the above your above statement is very unfortunate and anti people being the key functionary of judiciary in a democratic country.

 

May GOD be with you always and every time to strengthen Republic of India for the good of common man of this democratic country.
