Can you believe it? The end of the semester is here! Our last PSW presenter is Professor Hathaway, who will be presenting a paper she wrote with her students last year titled "The Law of Cyber-Attack." (I'm pasting a note she wrote to the Workshop below.)

To the Progressive Scholars Workshop:

Attached is an article my students and I recently published in the California Law Review on the law of cyber-attack.  I am now thinking about a question that this Article touches upon (in Parts II.A. and III. A.), but does not address in great depth: What can a state do in self-defense against a cyber-attack?  This is particularly complicated in part because, thus far, cyber-attacks have not caused sufficient harm to trigger states’ right to self-defense under Article 51 of the U.N. Charter.  But as the recent attack on Saudi Aramco makes clear, cyber-attacks are becoming increasingly threatening not only to U.S. military interests but to economic interests as well.  What legal rules apply and what policy concerns should U.S. government officials bear in mind in deciding how to respond to this growing threat? I look forward to working through these questions with you at the December 11 workshop.

 

Parts II.A. and III.B. of the attached article will be the starting point for the conversation.
