May service agents sign enrollments on providers' behalf?

I'm writing service agent documentation now, and wondering about this question:

"Is it acceptable for me to fill out and sign the Provider Statement on the provider's behalf?"

Right now my default answer is: "Please confer with the state Medicaid office." But in your experience, is it acceptable for someone who's helping a provider enroll (e.g., an insurer or the office administrator at their practice) to fill out and electronically sign a Provider Statement on the provider's behalf?

For reference, right now, the default Provider Statement (customized for Minnesota) says:

I certify that the information provided on this form is accurate, complete and truthful. I will notify MHCP Provider Enrollment of any changes to this information. I acknowledge that any misrepresentations in the information submitted to MHCP, including false claims, statements, documents, or concealment of a material fact, may be cause for denial or termination of participation as a Medicaid provider.

And the fields underneath are marked for the Provider Name and Provider Title.

It could be that we should customize this part of the form, so that if you're logged in as a service agent or service admin, there's an additional agreement/addendum where you attest that you're doing this on behalf of a provider who's asked for the enrollment.

We've had a conversation about e-signatures with at least one state:

State: Incorporate electronic signatures with the provider enrollment applications and updates.

PSM team: Currently we have a "Provider Statement" where the provider submitting the application certifies that they have answered accurately.  Does that match what you're thinking of?

State: Yes.  I suspect each state has its own rules to ensure an e-signature can with stand the legal impact.


That doesn't answer your specific question, but suggests that this will need to be configurable.
