Getting an error with effect.js in Chrome "Illegal Constructor"

This is triggering an error in Chrome 39

            new Element('span', {style: tagifyStyle}).update(

              character == ' ' ? String.fromCharCode(160) : character),

              child);

>  Uncaught TypeError: Illegal constructor

Seems in you code, error, what is `child`?
You might post code with error in jsfiddle?
