Hi Barun,

Interesting   web sites, thank you. India has ambitious new ideas,  presently India is moving to protect property rights with bio metric  solutions in the absence of    ‘ rule of law tools’.  Malaysia seems to follow.  I am very interested to know more.

India--  Bhoomi project is the computerised system of producing a farmer's Record of Rights Tenancy & Crops to 20 Million lands - an all-important identity  needed by the 7 Million owners have  introduced   their thumb impressions in to  computer to prevent tampering with the land rights. Malaysia—
Owner must personally submit land documents to the registry   where his thumbprint will be counterchecked against his MyKad to verify whether he is the real owner. Will this be a solution? or  will it create further problems.?  . .

Technology is not a panacea. It can only work in a particular context. If the context is conducive, then the technology can create big befits. If the context is counter productive, then technology can cause big negative results.
Bhoomi is a good example of limited utility of technology. It digitised land records with all its errors. Now people are fighting out the errors and frauds in the court of law. The reason being that the project was never intended to ground troth the land records, so they had not done any survey to match the situation on the ground with the records in the book.

In our case, there is a 2006 law recognising the land rights of forest dwelling communities. Their land had not been surveyed earlier, because much of it was part of revenue lAnd, but under forest department. The law has a cut off date of Dec 2005. The demand from the communities, together with the need for survey, and the access to satellite images of 2005, has created a convergence between the law, the people,s need, and the technology. Which is why we might have a better success rate.

In this context land fraud is not an immediate issue. But we are trying to integrate our database with the biometric card no. of the claimant. This contains information related to iris and finger print. Since a program,me to create unique ID for all Indians is going on, at some point, I am sure we will be able to integrate the land coordinates, which are unique for each parcel of land, and the biometric UID, which are unique for each person.

Thank you Barun,   So much of ideas,   it is a pity that those who are involved working towards property rights in   countries which are moving towards the  transition for better land rights  do not have a single forum  to share the ideas, or  meet at least once a year to share the  ideas. 

Perhaps the Commonwealth countries [53countries ]that are very much involved should request for such a forum. I hope someone will provide funding. Mala
