A.   Reporting  A

Further to KQU 2833 dated 3.6.24, being and important matter we would inform you that about Fist fight over ‘speed-money’ in FBR triggers transfer, inquiry (Attachment 2769.1) in the ensuing paragraph, with emphasis our in bold and underline for quick reading.

2.   A fist fight over share in the ‘speed money’ received from a company and trespassing the jurisdiction in dealing with the ‘cut’ matters have unmasked internal wrangling of the tax machinery and how money changes hands when refunds are issued.

3.   However, this led to the transfer of officers from the lucrative posts as the news of the fight made its way into the social media. An FBR spokesperson confirmed the occurrence of such an incident but opted not to go into details unless the facts are duly verified.

4.   He said his department took a pro-active action by removing the officers being alleged so that a fair inquiry into this case could be made. Abid Bodla, Chief Commissioner of the CTO Lahore, will head the fact-finding inquiry, said Bakhtiar Muhammad, the spokesperson.

5.   The issue started over the tax refund of an air conditioning manufacturing company. A refund of Rs 550 million was ordered to be released. And a 10 percent ‘cut’ of Rs 55 million was agreed. Everything was fine up to this stage. Dispute emerged over the share in it as an officer from an unrelated field formation of the FBR was negotiating the deal in return of a certain share in the ‘cut’.

6.   He was said to be in contact with the company’s representative. The tax officer who was competent to issue the refund was told that a cheque of Rs 55 million had been issued. Issuers of the refund as well as the facilitators and enablers of this deal will get their percentage from the ‘cut’ depending upon their role and the rank.

7.   However, the situation went haywire once the enabler of this deal succumbed to temptation. He allegedly received the ‘cut’ from the company in cash and shared it with his immediate and distant bosses including the one who has received ‘performance award’ from the government. However, the one who sanctioned the release of the refund was deprived of his part in the ‘cut.’

8.   He was told that the cheque issued for the amount released by the company under the head of the ‘cut’ has bounced, which appeared to be part of the script that the amount would be received in cash. As the sanctioning officer took up the ‘cut’ matter with the company, he was told that it had been released in the form of cash. This sense of being abandoned made him hit the roof.

9.   He called the enabling officers at his office who were junior in rank but belong to the different formation. Instead of being apologetic, the junior officer provoked a fist fight. He also ordered his staff to bring a pistol from his car. The situation was pacified by the staff however the news spread like a wild fire resulting in removal of all the suspected stakeholders of this ‘cut’ from their positions and an inquiry has been ordered to determine the facts.

B.   Reporting  B

10.   A refusal of issuing invalid refund by an additional commissioner of CRTO to his chief commissioner has led to his transfer on Friday. (Attachment 2769.2) in the ensuing paragraph, with emphasis in bold and underline for quick reading.

11.   In a complaint addressed to Commissioner Enforcement-1, Additional Commissioner CRTO Azhar Jehangir pointed out that since he has refused to agree to the illegal demand of the CCIR and not approved the controversial refund keeping in view the applicable law, rules and procedures, therefore, he might land into trouble.

12.   “But I am a servant of the state and not of any specific officer. I cannot indulge into maladministration by issuing an invalid refund only because my Performance Evaluation Report (PER) was due with the CCIR and he might make adverse entry into the same,” he added in his complaint, copy available with BR

13.   In his complaint, Jehangir termed the action by the Chief Commissioner as a pressure tactic against him for his refusal to process refund matters of Vega Lubricants (Pvt) Ltd. He said CCIR, CTO, Lahore Ch Muhammad Tarique called him to his office on 30.6.22 and asked him to process and get a refund of Ms Vega Lubricants (Pvt) Ltd. (NTN 1408628) and issue it by close of office hours.

14.   He informed him that it was June and his Officer was busy ensuring collection so that budget targets could be achieved, therefore, no deadline should be set for the same day. However, the Chief Commissioner did not listen to him and threatened him that if the refund of Ms Vega Lubricants (Pvt) Ltd. was not issued by evening, he would be transferred.

15.   According to him, he returned to his office and started scrutinizing the record of the case after obtaining it from the concerned deputy commissioner for grant of administrative approval in respect of 3 tax years i.e. 2014, 2015 and 2021.

16.   Jehangir said his DC informed him that he was also called by the CCIR and directed to forward the refund for administrative approval.

17.   On receipt of the request in 3 tax years for approval in Iris, he checked all three tax years’ record and returned the matter to the DCIR, in Iris, by conveying rejection of refunds on the ground that the taxpayer has revised its return for tax year 2014 on 13.6.22 by reducing declared/assessed loss in original return of income by an amount of approx Rs 100,000.

18.   The taxpayer has filed an application under section 170 of the ITO, 2001, on the basis of the said revised return of income on 22.6.22. The refund application cannot be accepted/processed because the taxpayer has failed to fulfil the conditions prescribed for revision of return in section 114(6).

19.   Similar discrepancies were found by Jehangir so far as tax years 2015 and 2021 are concerned. Therefore, he declined to issue invalid refunds, followed by his transfer on 1.7.22

20.   Meanwhile, Tanveer Iqbal, staff officer of chief commissioner CRTO, when contacted, said that the complaint has been followed by transfer of Jehangir. However, when it was pointed out that the incident took place a day before his transfer to the legal cell, the said officer restricted his response to a narrative that an inquiry committee has been constituted to sort out the issue.
