Posession Letter for B tower

Dear all,

My husband and I have bought a flat in tower B (B-62) and unfortunately are out of country at the moment on work.

Is it possible for someone to let us know the status of construction? Also, we would like to know what the larger decision of the group has been - paying and taking possession rightaway or are things still under discussion with the builder.

Request you to share this information to help us make the right decision at this point of time.

Actually there is no consensus yet. Some ppl were of the view that we may pay up and then fight because if we think of any legal course the possession will be delayed indefinitely. There are many issues besides 10% increase in  super area. Spaze want an undertaking to be signed before taking the so called " permissive possession". This undertaking if signed by us closes doors for further negotiations, so even some clauses in this undertaking needs to be reworded or deleted. Spaze have applied for Occupancy Certificate but it's not known as to when this certificate will be available. Till then, we have no right on the apartment. Spaze said that In case we take permissive possession we can start living there but in that case they have to indemnify us against any legal complications that arise after we occupy since OC has not been received so far. Then there is question of Electricity , water and sewage connection which is generally done after OC is received. Till then, they will supply us these services at exhibit ant rates. We have had many meetings with Spaze but no concrete results so far. I hope this gives you the gist of the status so far.

People have started paying the money after adjusting the delayed Panelty amount.

Once we get the possession, then probably we can think to go legal and fight with builder.

I have not heard anything about the protest, instead what I have learnt is that many people are paying up. Perhaps the agitations seems to have died down.
