I will draft the letter and circulate among the group shortly for review and comments. This cover letter will need to be accompanied by each owner with the cheque of INR 1 lakh.Amit, I have seen the contents of the legal notice. The legal notice is in order and does cover all the points to show "deficiency of service" and "unfair trade practice" and does provide good grounds of action against the builder in a consumer forum in Gurgaon. My only suggestion is that if we do proceed to go legal (based on the fact that the builder did not provide adequate material based on the layout and on the builders agreement), it is better to file (to show great harm across the cross section of allottees) a common class action suit before the consumer forum rather than individual complaint. Filing a class action suit will help in speeding up the process at the consumer forum in Gurgaon and may assist in obtaining a favourable order. Possession here refers to as completion of flat in all aspects including washroom fittings, tiles, wooden flooring, modular kitchen etc. however; electrical fittings, ACs, last coat of white wash will be installed or completed only when builder will be the recipient of final payment from buyer(s).Here, possession also refers to as successful completion of all equipment’s, services and products with compliance certificates, which are essential and mandatory to live in securely & comfortably. This includes Fire fighting systems, lifts, CCTV surveillance, 3 tier security, water supply arrangement, electrical connection etc. Facilities which are luxury in nature like Club, Swimming pool etc. are not included here and builder will remain committed to provide all such facilities and services at the earliest.
- Permissive Possession: Since, buyer and builder agreed to pay full amount on final offer of possession, after satisfactorily completion of work, so received notice of permissive possession becomes null and void and builder will not impose any penalty basis any delay in payment till now for what so ever the reason it may be for delay in payment.
- Delay in Possession: Builder will complete all internal and external work as mentioned above within 30 days however; if builder is not able to do so then, builder will be liable to pay penalty as per the initial agreement signed with buyer(s) and no penalty for delay in payments will be levied on buyer(s) for delay from builder side for what so ever the reason it may be.
- Undertaking Certificate: Buyers will only sign the undertaking certificate while receiving the keys of the units and builder will accept all partial and full payments without signing of the undertaking form, shared along with offer letter of permissive possession.
- Management Charges: All management charges will be charged only after acceptance of final possession offer.
- Occupancy Certificate: Though builder has confirmed that they have completed all formalities for occupancy certificate and have applied for the same and any delay in obtaining the occupancy certificate will be on the part of builder and any penalty by government or regulatory body will be levied by builder only.
- Joint Inspection: This Saturday i.e. on 22nd Feb, 2014, we shall have a joint visit with builder and during the same visit buyers will showcase pending or repair work to be completed in flat & / or in society.
Demands:
- Super Area Calculation: We all buyers do demand super area calculation done initially while launching the society and now, when builder increased the super area and showcase to us where all the super area got increased.
- Change in internal lay out design: Builder has confirmed buyers that there is no change in initial lay-out design or floor plan and will showcase the same to flat owners however; if they found any change in initial floor plan during our joint visit then, builder will drive the best possible mutually agreed solution. If builder fails to work out a possible mutually agreed solution, then our demand is to pay off for reduction in carpet area.

There is no point in making payments blindly when it is amply clear that th= ere is no response from Spaze for any of the following points:
1. The work at site is no where near completion and this is the last paymen= t to builder.
2. The justification of increased super area (old and new approved drawings= ) is not provided.
3. Adjustment of possession delay penalty is not made.
4. No justification for extra electrification charges.
Making payment now is like closing all doors for yourself. I am proceeding = with sending a reply to spaze with above issues and subsequently take legal= action, if required.

I have a flat in Tower C (1930 Sq Ft).=3D20
The payment of about 14 L is due today (today being the final day). I =3D guess they gonna levy a penalty for delayed payment.
I went to the site yesterday to have a look..pretty messed up state of =3D<= br> affairs. Infact I was quite disappointed..the place is nowhere near a =3D state of being handed over.
Quite apparent these guys have pulled up a smart one in fooling guys =3D
like me!
Anyways, Just wanted to check on this forum if others are making the =3D
payments today too (or if they have already made)
Any other alternatives?? Or suggestions to go forward?
