There are a few sample agreements you can use linked here: http://596acres.org/en/resources/working-private-land-owners/ (I've pasted the simplest one below that you can use as a jumping off point, but I really recommend reading through the different resources linked to that page). 

For insurance, I would recommend getting an independent policy through the American Community Gardening Association. You'll need to become a member but that makes sense. Another group was just quoted $450 as an annual premium for a $1million general liability policy. Details are here.

Here's one sample license agreement between a private owner and a community group

I, _____________, grant permission on this day _______ to the group ___________ to use the vacant lot located in ______________, to create a community space.

This agreement is good until _____________ for temporary use of the land - which may be renewed again on ____________ if conditions allow and as I see fit.

This agreement also states that if, I the lot owner, requests that the group ____________ vacate the premises that the ___________ has created will be removed within ___ days of this request.

As the owner of this lot I am not legally responsible in any way for anything that occurs on the property during the cleaning, building or running of the Movable Community Space/Garden.

The group agrees to
- get insurance
- clear the sidewalk of ice and snow
- beautify the space...

We just received approval from the landowner (an attorney) to transformation his vacant corner plot into a community garden!

Right now he is asking for insurance or any guarantee that he isn't responsible for anything that happens there or if anyone wants to sue...

One of the community garden members home abuts this property, could that be extended through her coverage or is there a special insurance for these purposes?

Thank you very much for the link and samples Paula! We're still finding a name for the garden! Our team is working on an agreement with the landowner and will keep you posted on how things are coming along and if we up up against any roadblocks.
