Limitations on "non-public" initiative activities

Gotta do this one quickly, while on lunch hour.  At about 54:30 of the February 25 call, the point was made that HIMSS does not rise to the level of being a "public forum," hence no official initiative activity could take place ("information-only").
 
Does this also mean that any of the proposed PDMP-EHR exchange specifications for which members of the public must pay a fee to inspect should also be considered "information-only"?
 
How can members of the public weigh in at all on the merits of any of these proprietary specifications? It seems as if significant participation in the initiative's deliberations are being limited to just those with the wherewithal to purchase these specs.
 
It also seems to raise a potential conflict of interest if those with a proprietary interest in selling copies of the specifications are also engaged in the analysis of their merit.
 
Am I misunderstanding something?
