Statement of Agreement
By submitting the following Electronic Submission Form you are requesting to be disqualified or excused from jury service or to postpone/defer your jury service date. You understand that:

Any person summoned as a juror who is a full-time student at an out of state educational institution and who wishes to be excused or who is 72 years or older and who wishes to be excused, deferred, or exempted, may make the request without appearing in person by filing a signed statement of the ground of the request at any time five business days before the date upon which the person is summoned to appear.

Any person summoned as a juror who has a disability that could interfere with the person's ability to serve as a juror and who wishes to be excused, deferred, or exempted may make the request without appearing in person by filing a signed statement of the ground of the request, including a brief explanation of the disability that interferes with the person's ability to serve as a juror, at any time five business days before the date upon which the person is summoned to appear. Upon request of the court, medical documentation of any disability may be submitted. Any privileged medical information or protected health information described in this section shall be confidential.

IMPORTANT: Requests for excusal must be submitted in writing by the person summoned (not your employer). Requests for excusal must be submitted before you receive a Notice to Report; the Jury Clerk cannot grant you an excuse once you have been issued a Notice to Report.

Governor Kathy Hochul has signed S7394A into law, allowing New Yorkers to obtain an absentee ballot for any reason through an application to the board of elections. This bill removes the requirement of a reasonable excuse to obtain an absentee ballot.

Trial by jury is a vital component of our system of justice and provides a unique opportunity to fulfill an important obligation as a U.S. citizen. We appreciate your civic commitment and recognize that jury service may conflict with work or school schedules, planned vacations, and other life events. We also recognize that some citizens may need to be excused from jury service for age or medical reasons. Finally, some individuals may not be legally qualified to serve as jurors. This page provides an overview of the excuse, deferral and disqualification categories and provides additional information for you to consult.

All requests for excuse, deferral or disqualification must be in writing accompanied by your completed questionnaire and any required documentation. Requests for excuse, deferral, postponement or to explain why you may be exempt or disqualified should be submitted as soon as possible upon receiving the summons - at least ten (10) days prior to the start of your jury summons. Do NOT wait until you are directed to report to make a request for excuse, deferral, etc., as it will likely be denied. Only well documented requests for excuse, deferral or postponement will be considered. Since your term of service is for eight weeks, you must be prepared to report at any time during that eight-week term; therefore, any reason you must request excuse for any portion of that eight-week period should be made as soon as you receive the summons form. All requests for excuse, deferral, postponement, disqualification or exemption require that the summons questionnaire form be completed before any consideration will be given to your request.

There are two ways to submit your request for consideration:

EXCUSE: Requesting an Excuse means you are asking the court to either permanently excuse you for the entire term of your jury service or to temporarily excuse from a specific portion of your eight-week term. Some reasons may include medical factors, age over 70, and residence outside of the Western District. MEDICAL EXCUSE FORM

Finally, as a reminder, before any request for excuse, deferral, postponement, disqualification or exemption can be considered, you must have either completed the juror information questionnaire online at ejuror as instructed on the back of the summons OR complete and return the pink and white questionnaire in the business reply mail envelope provided in the summons packet. Also, any documentation in support of your request must be provided at the time you submit your request. Failure to include the completed summons for (or to have completed the online form) and supporting documentation will delay the Court's consideration of your request.

Most district courts offer permanent excuses from service, on individual request, to designated groups of persons or occupational class on grounds that service by such class or group would entail undue hardship or extreme inconvenience to the members thereof. Such groups may include persons over age 70; persons who have, within the past two years, served on a federal jury; and persons who serve as volunteer firefighters or members of a rescue squad or ambulance crew.

Excuses for jurors are granted at the discretion of the court and cannot be reviewed or appealed to Congress or any other entity. Each of the 94 federal district courts maintains its own jury procedures and policies regarding excuses from jury service. Contact the federal court where you were selected to ask about a temporary deferral or excusal from service.

As of August 28, 2022, all voters may vote in-person absentee during the two weeks prior to each election. This no excuse needed absentee voting method differs from application-based absentee voting in the following ways:

I would like to quickly excuse assignments in Canvas for multiple students at a time. For example, in 1st grade this week I have one remote class and 3 in person classes. The remote kids needed to do the assignment (I have them created as a group but can't assign it just to them) and we ran out of time for my in person kids to do it. I would love to excuse the assignment/quiz for my in person kids quickly. The only way to do it is to click on each student and mark it excused. My course is an entire grade.

Thanks for posting your question. I can understand how the use case your described being able to excuse a whole class of students would be helpful. Currently, the only way to select the Excused option in the sidebar or inputting EX for every student.

Absentee voting; no excuse required. Permits any registered voter to vote by absentee ballot in any election in which he is qualified to vote. The bill removes the current list of statutory reasons under which a person may be entitled to vote by absentee ballot and removes references to those reasons from other sections of the Code. This bill incorporates HB 25, HB 208, and HB 209.

If you are under the age of 70 and have a medical disability that would prevent you from serving, you must provide a doctor's note verifying the disability. The medical note must indicate the permanent nature of your disability or, if temporary, the specific time period for which your medical excuse is valid.

If an individual summoned for Jury Service wishes to be temporarily or permanently excused from service, the individual summoned must write a letter to the Court explaining the reasons for such a request. Additional materials which are relevant to the request may be attached to this letter. The letter must be emailed, faxed, or sent by U.S. Mail to the District Court such that it would arrive before the appearance date. The letter and associated materials will be reviewed by the Court. The individual will be notified by email or U.S. Mail of the decision.

The District Court will make every effort to accommodate vacations, medical appointments, or other pressing situations as best as circumstances allow. However, mailing a request for excuse from service within the proper time frame does not guarantee that an excuse will be granted. In the same manner, appearing before the presiding Judge to request an excuse does not guarantee that such will be granted. Reasons for excuse from Jury Service must be compelling and legitimate. Unless an individual has received notification from the Court granting an excuse from Jury Service, all individuals summoned must report for service on the date notified by the Clerk.

Some categories of people, upon their specific written request, may be excused from jury service. If you fit in one of the categories and you want to be excused, send a written request to the jury administrator in the division where your jury service is to take place. Of course, if you wish to serve and you meet the statutory qualifications, you are welcome to do so and need not contact the court before your summons date.
