However it’s high time we decide on our future course of action as PCL seems to be in no mood to address the concerns raised by us jointly as well as individually and therefore we may have to shift our approach accordingly.
I suggest if possible we should approach an appropriate forum/authority and seek their help in getting an early resolution to our concerns against the builder.
However whatever needs to be done has to be done quickly and collectively therefore please advise what should be out next course of action?

Today I have received a letter stating that, since 30 days are over and we have not made the payment as per the final demand letter therefore they are likely to terminate the contract. It reads more like a threating letter, can they do that legally?
Can someone advice?

We are in receipt of your email of 1/11/2012. The offer of possession has initially been made to approx. 25% of the apartment owners, out of which 80% have already paid or taken steps to pay the dues, in terms of the contract, as set out in the letter of offer. The process of registration has already started and over two dozen registries have already been effected and it is programmed that approx. 50 other apartments would also be duly registered after completing all formalities.
Today is an auspicious day, as the first customer has moved in to live in Pranayam. A number of other valued customers have started the work of fit outs.
Please appreciate that as a policy decision taken by the undersigned, nobody in the marketing department is authorized to waive even one naya paisa from the amount of the offer of possession and no rebate or waiver will be granted in any case.
It is brought to the attention of all concerned that a plot of land admeasuring approx. 4 acres abutting Pranayam is being auctioned by HUDA in about a fortnight's time. The reserve price of the FSI is Rs. 1750/- per sq. ft. Such of the members of Pranayam who wish to unionize may do so and take their chances. Any meeting desired by any group of customers will only take place after we have exhausted giving possession to such customers, who have honoured their commitments in the entirety.

After personally facing PCL MD Mr Mohinder Puri’s venom in February this year (at least one other buyer was also on the receiving end), I am of the opinion that like any other builder, apart from having no scruples, they have the money power, muscle power and political power to make our lives miserable.
Irrespective of any legality or not, let us face it, in the current scenario (till our RWA is properly formed and registered) they can definitely harass us. If we do go legal at this stage, the possession of the apartment becomes a distant dream (till the case is decided). At the end of the day we will be losers.
My suggestion is that we pay them the undisputed amount immediately while we deliberate. This will keep them off our back for some time. In the meantime we try to find some amicable resolution either by meeting PCL management or otherwise.
The first priority should be to avoid a situation where PCL can exploit us through some nefarious legal clauses. Second priority should be to take possession and immediately form a RWA. Subsequently we could jointly decide on the next course of action.
