Please find attached the individual communication format which has to be sent to PCL asap in your own interest. Please send it even if you have paid out fully or partially. This will be of help to all of us, including you as well.

All you need to do is just type your name and apartment number, take a print-out of the attachment to this mail sign (at the place where it indicated with red arrows at the bottom of the document), scan the communication, reattach it to the mail and send it to  Mr. Mohinder Puri, PCL  at " <mohind...@ymail.com> ".

Number of  buyers of “The Pranayam” who got their final  demand letter for taking possession have been confronted with a situation where M/s Puri Construction Ltd. (PCL) has levied varied  charges not specified in our agreements,  in lieu of handing over the final possession. In this context some of the members met on the 2nd October and reviewed the situation. It was felt that while on one hand possession is  important ,on the other, there is a need to ask PCL to justify the levies  which prima facie appear untenable. Therefore, members of  the  Pranayam Google Group (PGG) unanimously consented to submit a memorandum to request PCL  justify  these levies and comprehensively explain how these amounts have been arrived at. 

We’d, therefore, request PCL management to have a face to face general meeting with the members of PGG to discuss these issues to expedite possession.

We are in receipt of your email of 1/11/2012. The offer of possession has initially been made to approx. 25% of the apartment owners, out of which 80% have already paid or taken steps to pay the dues, in terms of the contract, as set out in the letter of offer. The process of registration has already started and over two dozen registries have already been effected and it is programmed that approx. 50 other apartments would also be duly registered after completing all formalities.

Today is an auspicious day, as the first customer has moved in to live in Pranayam. A number of other valued customers have started the work of fit outs.

Please appreciate that as a policy decision taken by the undersigned, nobody in the marketing department is authorized to waive even one naya paisa from the amount of the offer of possession and no rebate or waiver will be granted in any case.

It is brought to the attention of all concerned that a plot of land admeasuring approx. 4 acres abutting Pranayam is being auctioned by HUDA in about a fortnight's time. The reserve price of the FSI is Rs. 1750/- per sq. ft. Such of the members of Pranayam who wish to unionize may do so and take their chances. Any meeting desired by any group of customers will only take place after we have exhausted giving possession to such customers, who have honoured their commitments in the entirety.

To me the message received from PCL is nothing but bullshit. They are just trying to create confusion among us. However it’s high time we decide on our future course of action as PCL seems to be in no mood to address the concerns raised by us jointly as well as individually and therefore we may have to shift our approach accordingly.

I suggest if possible we should approach an appropriate forum/authority and seek their help in getting an early resolution to our concerns against the builder.

However whatever needs to be done has to be done quickly and collectively therefore please advise what should be out next course of action?

Hello Group,
Today I have received a letter stating that, since 30 days are over and we have not made the payment as per the final demand letter therefore they are likely to terminate the contract. It reads more like a threating letter, can they do that legally?

Can someone advice?
 

What should be our future course of action as PCL seems to be in no mood to address the concerns raised by us jointly as well as individually.

Today I have received a letter stating that, since 30 days are over and we have not made the payment as per the final demand letter therefore they are likely to terminate the contract. It reads more like a threating letter, can they do that legally?

Can someone advice?
 

What should be our future course of action as PCL seems to be in no mood to address the concerns raised by us jointly as well as individually.

The offer of possession has initially been made to approx. 25% of the apartment owners, out of which 80% have already paid or taken steps to pay the dues, in terms of the contract, as set out in the letter of offer. After personally facing PCL MD Mr Mohinder Puri’s venom in February this year (at least one other buyer was also on the receiving end), I am of the opinion that like any other builder, apart from having no scruples, they have the money power, muscle power and political power to make our lives miserable.

 

Irrespective of any legality or not, let us face it, in the current scenario (till our RWA is properly formed and registered)  they can definitely harass us. If we do go legal at this stage, the possession of the apartment becomes a distant dream (till the case is decided). At the end of the day we will be losers.

 

My suggestion is that we pay them the undisputed amount immediately while we deliberate. This will keep them off our back for some time. In the meantime we try to find some amicable resolution either by meeting PCL management or otherwise.

 

The first priority should be to avoid a situation where PCL can exploit us through some nefarious legal clauses. Second priority should be to take possession and immediately form a RWA. Subsequently we could jointly decide on the next course of action.

We have visited our apartment yesterday, our is in D-3.we are yet to receive possesion letter.
 
This is just my personal opinion but i am sure lot of other people will agree to this.
 
The Construction quality, overall project is one of the best at present in the area.
 
We happended to check out Emperial estate - which was adjacent to The Pranyam - their apartment quality way beyond even if compared to classic specifications.
 
Red coloured Fire Fighting pipes are visibilre in floors common areas, AC & water pipes are visible.Quality of tiles, flooring is so no where on compariosn level.
 
Whereas if we look the pricing, they are similar.Though the project has its own flaws also,but they are really not big if we compare other builders.
 
And yes we saw 2-3 families have already moved in.
 
Also on charges which are demanded by PCL - most of them i guess are mentioned in contract, like escalation in steel prices
 
So we think if sumone in group has understanding on legal aspects can check the contract & update others also.

Pl. refer to my mail below to which no reply has been received yet , not even from the active members of group who were responsible for drafting the memorandum and collecting the supporting documents from various agencies.

I would again request them to advise in the matter to enable me to take a final call on the payment of heads demanded by PCL but contested by group in their said memorandum. An immediate reply would be solicited.

Ours is D3 1502. We have not received the letter but were told that it should reach us by December 1st week. If you have received the same, please share.

As per their verbal communication, 30 days should be provided. I talked to one of their person who was handling registries, he mentioned that registries would have to be done through them only.

Hi All,

I have not received any demand letter from the Pranayam side yet.
Any one from C11, C12 tower received Demand letter? If Yes Then how Much Paranayam is asking for final payment. (Or any other tower resident who got the final possession/demand letter from Puri and having flat area of 2184 Sqft, Type C) can help me how much approx. amount Puri is asking in their final letter.
