I have been forwarded the following email by Mr. Arvind Soni (Don't know why these emails are not marked to me) in which a Circular dated 7th April'2014 is attached signed by Mr. Kaushik Sengupta. There are some points/observations in the said circular regarding audit of common area maintenance charges on which, being member of the audit committee, I would like to bring factual position before the residents of the Pranayam Society and Mr. Sengupta too.
1) Point No. (b) of the circular - regarding maintenance charges:
The extracts of the above point is reproduced below:
"All these expenditures average out to be Rs.3 per sq. ft. per month. The above accounts along with supporting vouchers were shown in detail to representatives of the apartments owners last week. At the time of inspection they raised no objection at our office, however it seems that they have conveyed a different picture to the apartment owners. We once again welcome an audit of the above expenses which can be conducted at mutual convenience at our office."
The factual position:
On 20th March’2014, Mr. Shisir Kant (Strarta Services) fixed a preliminary meeting at the New Delhi office of Puri Constructions Private Limited (PCPL) for common area maintenance audit. Myself alongwith Mr. Arvind Soni and Mr. Anuj Mehra went to the meeting. The meeting was joined by PCPL’s accountant Mr.Agarwal (forgetting his name, on being asked he refused to give his visiting card/ mobile number). He gave us 2 pages printout containing summarized details of common area maintenance charges for the period May’2013 to Febraury’2014 (10 months period). Copy of these 2 pages are attached herewith.
On prima facie examination of the summarized details of common area maintenance charges, immediately, we objected to the following expenditure which are in the nature of capital expenditure/non maintenance expenditure but included in the common area maintenance charges. These expenditure are as follows :
a) Rs.3,00,000/- being operating charges paid for coffee shop.
b) Rs.2,60,947/- being paid to Khurana for Lockers at swimming pool.
c) Rs.4,50,314/- being meter installation expenses of common area electricity.
d) Rs.2,09,750/- being Fixed Assets charges ( no details given).
e) Rs.52,614/- being lift maintenance expenses for the month of April’13.
f) Rs.38,667/- being STP Maintenance expenses for the month of April’13.
Apart from the actual expenditure, the summarized “Details of expenses incurred” sheet contained expenses on provisional basis of Rs.4,80,000/- p.m. ( if you calculate for 10 months period it will become Rs.48,00,000/-). The details of provisions are given below:
Provisions:
Lift AMC - Rs.1,50,000/-
DG AMC - Rs. 30,000/-
Various Equipment & balance Insurance - Rs.1,50,000/-
Govt. Departmental Laisioning Expenses - Rs.1,50,000/-
Total monthly provision - Rs.4,80,000/-
When asked why these provisions are made when we have the actual expenditure, there was no answer.
Then, Mr. Shisir Kant suggested that first we give them a list of required documents/records/information for the purpose of conducting common area maintenance audit. On receipt of such list, he will arrange the required documents/records/information and then the audit will begin.
In the meantime, PCPL has issued letter for electricity disconnection, disregarding the recommendation of audit report of common area electricity charges. Due to the unexpected/unilateral move by PCPL and not giving any respect to the outcome of audit of common area electricity charges there was no point in conducting common area maintenance audit. What is the guarantee that PCPL will respect the outcome of the audit ? Due to reasons stated above, we were discouraged to do any audit and have not sent any list of required documents/records/information to Mr.Shisir Kant.
The comments from Mr.Sengupta:
“At the time of inspection they raised no objection at our office, however it seems that they have conveyed a different picture to the apartment owners.”
Are incorrect and undesirable from the signatory of the above Circular. May be the office staff of Mr.Sengupta have miscommunicated the factual position of the preliminary discussion regarding common area maintenance audit.
My advice to Mr. Sengupta is that rather than misleading people, please come clean and charge actual cost of common area maintenance to the resident, people will love to pay.

Dear Mr. Arjun Puri,
I have been asked by all owners cum buyers of the Pranayam Society to sent you copy of memorandum for Pathetic Maintenance Services and Exorbitant/Escalating Demand for Maintenance and Common Area Maintenance Charges.
Your company has been totally ignoring the rights of buyers from the day of making a Buyer Binding Agreement which you called Builder Buyer Agreement.
In same lines you have formed your own service company Full Mark Facility Management pvt ltd and make a Buyer Looto Agreement which you call Maintenance Agreement and forced all of us,the buyers of Pranayam Sec 82- 85 ,Faridabad to get it signed as condition to execute the registration of Flat.
This maintenance/service agreement is valid up to 5 yrs and extendable with 3+3 =6 more years. That you have planned to loot us for next 11 years
Initially you have looted us for about 5 yrs during construction. So total loot period is about 16 years. Means until the retirement or later.
You have looted about 50 crore on account of steel increase charges ,wrong calculation of super area,selling increased super area many times etc by using Buyer Binding Agreement.
Your construction quality is worst having poor quality materials,seepage, highly unsafe lifts and poor safety systems etc.
Now you have linked that Buyer Binding agreement with service agreement
your services are poor but you are charging Rs 3 per sq feet which is highest in FARIDABAD and in entire Haryana.
In addition to it you are charging Rs0.53 for common area maintenance.
Total maintenance Charges Rs 3.53 per sq feet,which you may further
increase after Apr' 14 as mentioned in maintenance agreement/buyer looto agreement.
You are continuously using our electricity and diesel for your construction/project work but you are billing it to us which is a malpractice and illegal.
You are also repeatedly threatening us to pay the wrong bills generated by you and accepting your malpractices.
You have distributed a circular with notice to cut off the light in case meter is negative. Meters of most of the residents are negative because bills generated are wrong. Which you never corrected and forcing us to accept.
Light and water are basic services which non can disconnect.
You are forcing us to live like tenants in own home.
It is enough, now you have crossed your all limits,so we residents of independent India,worlds largest democracy, can not tolerate any more your illegal practices and tactics to suppress us and divide us.
We are well qualified buyers cum owners not your slaves, please make a note of it.
Please refer attached file(19 pages+ 1 covering letter,Total 20 Pages)
for memorandum signed by about 100 owners/buyers of Pranayam and supporting documents.
In case you cut off light of any resident, you being MD of PCPL/FULL MARK will be he held liable for all consequences.
We will take suitable legal action and will meet in the concerned court, if needed.
