Dear Friends,

If the Company fails to resubmit the required Form with in prescribed time, then how we can approach to ROC for extension of time.

Generally we file e-form 67 by mentoning SRN number but what in the case of  Form 1, which is not approved

Please reply.

Regards
Ekta

Dear Ekta, in case you have not re-submitted the E Form within the stipulated time, which is normally given for one month, the form gets cancelled and then you will have to file all the forms again along with required fees. You can not file the forms with the same fees you already paid. you will have to pay the whole fees again. In case of Form 1, You will be asked by concerned ROC to re submit with same SRN and in case of any missing information, you will be asked to file form 61 along with the SRN.

Form 67 is not applicable in case of incorporation. The only option is to resubmit the Form 1 with changes. You have to file the forms in timelimit otherwise system will delete the SRN. If further time is to be sought, it should be obtained before expiry of timelimit.
