FYI: Lot Subdivision Efforts in Palomar Park

Board,

We wanted to bring something to your attention that may have broader implications for Palomar Park and the quality of life we all value here.

Kat and I were recently made aware of efforts underway to encourage lot subdivisions in Palomar Park with the goal of increasing housing density. This was brought to our attention by a resident who was directly approached and left the conversation feeling very uncomfortable.

As we all know, one of the defining characteristics of Palomar Park is its unique hillside setting, larger parcels, and septic system environment. These elements are part of what preserve the character, privacy, and lifestyle that make this community so special. We are concerned that promises are being made suggesting smaller subdivided parcels can be made to pass percolation testing and support additional housing, even on lots that already have existing improvements.

We are also seeing more for-sale signs appear on vacant lots of varying sizes and configurations, which makes this something worth watching closely.

Kat and I will be addressing this more directly through our business and also as proud residents of the hill. In the meantime, we wanted to make the Board aware so that, as we all speak with neighbors and remain engaged in the community, this issue is on everyone’s radar.

For now, this is simply an FYI, but we believe it is important enough to flag early

Usually this stems from developers, contractors and even real estate agents wanting to make a buck and take advantage of quiet neighborhoods. They can almost be described as predatory. In my experience the few I have seen here like to flip houses, they don’t follow building permit rules and produce sub par remodels that look good from the outside only. Lipstick on a pig. 

It’s likely time to meet with the new environmental health director about the fraudulent perc testing antics at the corner lot. I’ve been fighting next to me the ridiculous mis-representation of the septic ordinance and County officials granting septic variances on a parcel that had multiple houses destroyed by landslides as well as recent other large landslides causing major property damage. Somehow they think putting a very large septic system above the landslide is ok.
These folks cheat, lie, and have no ethics.

These opportunist don’t want to live in our neighborhood they just want to make money and leave. They don’t care one bit for the health or welfare of our community or residents. 

I personally went to the building dept. and turned in the project at 760 Palomar for doing a major remodel and only having a permit to change plumbing and electrical fixtures. I received no support from anyone. When these people get away with 1-2 projects that’s all it takes for their pattern to emerge and now it’s a giant snowball in motion.

Nobody wants to standup, speak up, or make an effort on this.

Bob I appreciate your note, but you’ve known this was in motion for a while now and the horse is long out of the barn and not sure it’s ever coming back.

Denise - I agree the sale of “the lot” under what certainly appeared/appears to be false promises about viable perc testing was the proverbial “camel's nose under the tent."  As a community, we did impact the plans by the owner of the property above Los Cerros Road (corner of Palomar) from going through with plans to overbuild on that parcel.  Thus far we have yet to have anything to challenge with respect to the plans of the new owner for construction on “the lot.".  We can pursue that if/when it becomes an issue.  If we are successful in that endeavor, it will likely result in litigation initiated by the buyer/current owner over misrepresentation by the agent who sold it to him,  that litigation could be sufficient enough to bring that agent’s nefarious activities to a halt. You’ve fought the good fight all along and the community is better off for it.  We just need to remain vigilant and I’m convinced good will outweigh evil.- B
