API Patient Upload problem

I keep getting an error when trying to upload QRDA's via /api/patient 

The error is: 

NoMethodError (undefined method `name' for nil:NilClass):

  app/controllers/api/patients_controller.rb:78:in `create'

Any ideas what is causing this?
