If they have a way to communicate, or perhaps even travel, in what amounts to superluminal speeds, then they're so far above us that we must appear like little more than bacteria or something to them.
In any case, we certainly can't communicate faster than light. We've only been sending out modulated radio waves for a little over a century, and the teensy tiny little bubble of spacetime that much encapsulates is to the galaxy like a CO2 bubble in an ocean of Coca Cola, in both space and time. The odds of life appearing in it at all, let alone an intelligent technological space-faring species, much less one that has developed FTL capabilities, are too small to contemplate.

If so, they're doing a pretty lousy job of it. I suppose we Earthapoid animals could sue the ET Aliens for neglect in Galactic Court, but first we would have to do a shitload of discovery (like showing that the Galactic Court even exists. Not to mention the
ET Defendant).
