Friend of mine who recently passed easily just write and published a new practice exam. Only 45 questions but after trying all the other available ones he decided to launch a new up-to-date one with better formatting, spelling, and grammar than most of the others. Not trying to be a salesman just letting you know! I think it's free if you have Kindle unlimited.

Hi!  Thank you for the tip!  I pulled it earlier and worked through it.  I was confused a bit about question number 4 and I thought I'd throw it out to the group since I don't know how to engage the author.

A litigant has their case dismissed after the judge cites a dozen similar cases that were found to be dismissed for lack of standing. This can be described as an example of:

a.) Case Law
b.) Statutory Law
c.) Arbitration Law
d.) Common Law

The correct answer I guess is D? I picked A because if a judge is citing a dozen similar cases that were dismissed for lack of standing, I'm assuming he relying on precedent to make his determination. I also think there are statutory definitions for standing as well in many states.  Anyway- if anyone feels so inclined to engage, please feel free. I've been licensed for 10+ years and I'll admit this was a kick in the shins to realize I did not pick the same answer as the author.  ;)

Hi Lizz,

I am a lawyer and my first inclination was answer A as well since it does look like the judge is citing cases to establish precedent. I will admit that common law isn't my strongest area but I am curious to find out why the author picked D over A.
