Hi Lizz,

I probably would have been confused as between A and D too because both seem to be correct depending on how you look at it. But an attempt to justify D as the answer is that case law refers to final decisions made by judges in cases (i.e judgment), while common law refers to the legal principles applied by judges, which legal principles are developed from judicial decisions. 

In the scenario described in the question, the judge dismissed the case by applying the legal principle of stare decisis, which is a common law principle, but not necessarily case law. That’s as best as my attempt goes.

A quick search on Google seems to suggest both terms are used interchangeably in the U.S. So, it sure is confusing.

Hi Jess,

Thanks for sharing your thought process- that analysis makes sense to me too. The bummer about multiple choice tests is that you can't get partial credit for providing a rationale. I'll just hope questions of this ilk don't show up on the test. ;)
