Good morning everyone,

Please join us for our upcoming meeting on Wednesday, March 6th at 6PM. Our meeting this month will be hosted at Larimer County located at 200 W Oak St, Fort Collins, 80521.

We will be streaming the last GeoLearn session by Gary Kent, Easements & Rights of Way Part III: Written Easements and serving sandwiches from Cheba Hut, chips and drinks. Please RSVP by Tuesday at noon if you would like to be counted for dinner. We do ask for a $5 contribution for the cost of food.

Hi Heather,

 

I can’t make the meeting but I want to throw in my 2 cents about the Google Earth Monument Record application going away. I believe that the Google Earth application is a valuable tool in the researching of land surveys and the State not wanting to provide monument records to update the application is going to take away this valuable tool. Is there anything the PLSC can do to help get the State to allow Don Lambert access to the monument records to update the application?

I heartily agree with Bob. Don has put in a lot of work to make a very helpful resource for all of us to use, and I don't want to lose it because of something so insignificant. I would like to see the PLSC use our combined strength to put pressure where it is needed to keep CP-DB running.

I'm in unequivocal agreement with Bob & John: anything PLSC (as an organization) and/or we (as individuals) can do to preserve this wealth of knowledge needs to be done.

I cannot attend the meeting, but if it is recorded, I would love a link.

Heather,

I am skiving 0ff in California,  I would like to add to the discussion.  

Over the years the DORA site has been the worst source of research, I have on numerous occasions researched a corner, came back and the results held more or less results than before, I did a study and found out it depended on the day I looked.

This needs to be addressed.  DORA needs to fix this.  DORA should be financing the system or send it to someone that will make a functional system.  Every book I've made has a section on research, and I will have to rewrite it again.

Since tonight's discussion is regarding easements, etc, I have a question for the chapter that I'm hoping someone might have answers for or can point me in the right direction.  When I took my state exam last year, I had a question regarding inferred ROW widths to Colorado irrigation ditches/canals.  I have no idea if my answer was correct as they don't give actual results to questions. My coworkers and I can't find published information or case law regarding the info so I'm wondering where I can find some concrete law/evidence regarding ditch ROW when not stated in a record document.

Yeah, that’s a really good question Eric. I am not aware of any case law. I know the ditch companies typically will claim from top of embankment to top of embankment, together with a strip 25 feet on each side of that. Additionally, they will claim any area outside of that that is used for earthwork to support the ditch riders road. 

I’m also curious to hear if anyone else has morsels to contribute to this
