Land Banking Victims Association Ltd (LBVA), representing victims was involved in a legal battle with Terracorp which sued its members for non-payment of the wholly unfair covenant charge (CC).   LBVA put up a spirited fight and WON.  The judge has ruled that the charge is NOT PAYABLE.  The judgement has also awarded the CC that Terracorp refund CC paid in the past.

The judgement applies to the victims that were part of the case that took place in June/July this year.  Those not part of the case can still benefit by referring to the case.  January is the month when Terracorp sends invoices to the long suffering victims.  So when you get a demand from Terracorp or a successor company, get in touch with LBVA, They have a procedure which you can use to avoid paying the charges.


PLEASE DO NOT PAY COVENANT CHARGE.

Excellent - I've been waiting for them to start proceedings against me in Bayford, Hertfordshire as I've refused to pay for 8 years.

Hi, I've just had this response from Mr Deschauer claiming the courts have found the covenant charge to be valid, is that true? The reports I've heard have been that the courts found them to be wrongful.


"With regard to your allegations, please note that the court has dismissed all of the various counterclaims raised both against the company and myself personally in relation to the sales and upkeep of the land. The court also confirmed that the sale contracts were valid and that the covenant charges were also valid. The issue at hand relates to the timing of payment of the covenant charges and we will be getting this clarified in due course through the courts (currently on appeal). As you can appreciate, I must wait until this has been decided in the courts and can’t discuss this more than I have above."
