Yes – I expect they’re still spending my money.  I would love to take the fight to them, but feel pretty much as though it’s my mistake and I have to live with it.  As far as I can work out, there has not been a single success story with either getting planning permission or getting money back from these companies.

Unfortunately this is one Company whom there doesn't seem to be any action against.

Some of the information you can find if you google Dhaliwal v Bluebell. My understanding is that around 50 plot owners have got together to fight this case. The solicitors used were BH Solicitors in Lewisham and the legal rep is Kelly Sharman. 

I would be interested if anybody has any further information particularly regarding this rumour that someone has been successful in claiming against Bluebell ltd and Baron Deschauser. 

Also if anyone is part of the Dhaliwal (and 50 others) consortium that can provide any further information regarding this case.   

Finally if anyone wants to get together to form a group and take this further.

I am trying to contact the solicitors who won the case against Blue Bell and Baron Deschauer who seem to have large number of registered companies. I purchased a plot in Sewards End but there is no chance of getting planning permission. So I intend to take the comany to court. I am also receiving threats from their solicitors for not paying the service charges. Company which sold me this plot is Glenridge Estate (Essex) ltd. Do you or do you know anyone who bought land from Lloyds & Co Land Agency based in London (typically no longer trading), they convinced me to buy a plot at a place called Barby.  After checking with the Land Registry I found that the sale is real and the land is real but I don't have a grid reference.

It is not just a case of the seller promising that planning applications would be forthcoming or would be a forgone conclusion, for example many of our members were given assurances that a group management committee or forum would be established to deal with such matters, something which never happened. You need to form yourselves into a cohesive group, someone needs to pick up and run with the issue to get the ball rolling. It requires a great deal of determination and persistence and then other plot owners to step up and help out, it will also take along time, you need to think in terms of years not months. Whoever "steps up" to start it all off will also need to commit some money to the project as well as their time and effort. Our group has chosen to pursue the planning application route rather than litigation in the first instance, bringing a lawsuit is a whole new ball game. The owners live in a multi million pound estate called Wilderwick House, in Dormansland, I think the house is on 150 acres.  Some could say that land scams pay.

A more recent development regarding some land banking companies and people linked with these companies is shown in the following article from www.Insolvencynes.com

From this case it shows that given time and effort some action can be taken against land banking companies and the directors involved. There is no mention of the money from the investors.

Five directors handed 53 years’ disqualification 29 July 2013

A group of five directors who ran three landbanking companies have been disqualified for a total of 53 years following an investigation by The Insolvency Service.

The companies collected over £7m from approximately 80 investors using “intimidating and high pressure” sales tactics.Scott Assemakis, David Evans, Gavin Walter Gravesande, James William Murphy Dominic and James Whatley were directors of Ultraclass Limited, which traded as The Property Partnership, Burnhill Land Investments Limited and RTW (Burnhill) Limited, and which sold plots of land including areas of flood plain and of the green belt.

Mark Bruce, chief examiner at The Insolvency Service, said: “The scale of losses for the unfortunate victims over these three companies is quite disgraceful.

“Those who tried to reduce their losses by pulling out of the scheme were met with underhand tactics. The Insolvency Service is determined to come down hard on directors who set out to rip people off by deliberately misrepresenting the investment opportunity on offer.”

Many of the land plots were sold to investors for more than 10 times their original purchase prices, despite being sold within a few months of purchase with total sales estimated at around £6,778,316.

The sites themselves were either on green belt land, conservation sites, at high risk of flooding, in landscape protection areas or adjacent to areas of outstanding natural beauty.

The investigation also uncovered deficiencies in the books and records of all three companies.

Assemakis and Evans – directors of all three companies – were disqualified for 11 years, Gravesande – director of Ultraclass Limited, trading as The Property Partnership – was disqualified for 11 years, Murphy – director of Burnhill Land Investments Limited – was disqualified for 10 years and Whatley – director of RTW (Burnhill) Limited – was disqualified for 10 years.

I have made contact with an agent who was part of the team that sold me a plot on bluebell hill. Ive been advised to get a group together to enable a new case and legal proceedings to begin again to get our money back from baron deschauer . There has already been a case that was settled out of court where approx. 25 plot owners got their money refunded plus costs.

Today I spoke to Citizens Advice Solicitor re. maintainence charges for Blue Bell Land Plot. We have heard that the land has been rented back to the farmer. Solicitor advises we send letter refusing to pay mainenance charges until we receive our share of the rent! We are late to this but have been directed here by a friend who brought into the Blubell Estaate.

We brought 2 plots through Gilbert estates in 2005 and still pay an annual covenant charge.

Like some of you we received a letter recently offering to stop all future charges after a one off payment. 

We would be very interested in pursuing a legal case.

Are you still being charged the annual covenant charge?  

If so, there is now a group, Land Banking Victims Association who have engaged a powerful contract law expert and they plan to challenge Terracorp and Mr Deschauer.  If you are interested please contact in...@landbankvictims.com

There are hundreds if not thousands who have fallen victims and only a group action can help us all.  Individually we are no match to this man.

We bought 5 plots from Baron Deschauer; but at Collingham Gardens in April 2004. Apparantly he has over 20 different companies They will never receive planning permission to build on!

I am interested in the legal case; any details?
