Dear Pankaj,

 

If my plot was in a disputed land then how the possession of the same was given to me? Can you believe that by putting pressure on them they can solve the litigation process?

 

Actually, HUDA officials are working as agent of some property dealers and are putting pressure on the plot holders for alternate plot. Later on they will re allot the same to their near and dears through whom they can get hefty gifts and benefits.

 

Secondly, HUDA is demanding enhancement from plot holders as per clause no -9 & 13 of the allotment letter. Why a plot holder cannot demand for the development work as promised by the HUDA in clause no-7 of the same allotment letter?

 

And if any plot holder is just writing letters to HUDA with no litigation for his rights, you are targeting him as a member of ongoing litigation plot holders!!

 

Please do inform me the position of your plot/plots.

Dear Pankaj,

 

First of all I do not want any litigation with anyone. I am ready to pay full enhancement amount demanded by HUDA as per the terms and conditions of the allotment letter. They have written in clause 7 of the allotment letter as follows:-

“The possess ion of the site will be offered to you on completion of the development work in the area, where the site is situated.”

 

HUDA offered me possession on 14/01/2010, thereafter I deposited the last installment due to them on 22/02/2010, hoping that they will give possession to me. I also purchased the stamp papers for executing the Conveyance deed but thereafter the Estate officer informed me verbally that my plot is on disputed land so they insisted me to write them for an alternative plot. I refused it and put so much of pressure through RTI and ultimately he has to execute the conveyance deed in my favour and remove all constructions at the site of my plot.

 

Now, I want to put pressure on them for development issue. There is no development at all and even there is no road by which I can go to my plot. The enhancement issue would be sorted out by the Court, but we can put pressure on them for proper development in the area so that we can live there or sale our plot at a decent price. Because of no development and fear of further enhancement there is no buyer of the plot.

 

Secondly, HUDA has also claimed in their letter no 413 dated 2nd January, 2013 that - “The Court has enhanced the acquisition cost of land in this sector i.e. Rs. 6712.91/- per sq. mtrs.” Now they are trying to extract the money from the plot holders by giving mis- statement. Therefore, I requested you for the Court order.

All these acts of HUDA officials are against the clauses of allotment letter issued by them. Therefore, I am requesting them to first develop the sector then ask compensation.

Dear Rahul,

I would like to ask are you the member of ongoing litigation of the plot owners of Sector-57 against enhancement by HUDA?  if yes then you can easily avail the copy of such judgment. If not then please contact Varun Sidwani on +91-9911900266 he may help you through this.

However, the judgement made by Sessions Court in the matter of farmers does not talk about Plots owners of Sector-57. It merely announced the enhancement of compensation which is to be paid by Haryana Government through Land Acquisition Department (LAO). Once such enhancement is paid by LAO, then HUDA reimburses such payment from Plot owners by the way of Enhancement.

About the guidance which you wish to seek, I would suggest that  you should wait till the matter pursued by the other plot owners in Hon'ble High Court is decided and if the judgment extends only to petitioners then you along with other plot owners who missed the opportunity to be the part of petition can seek court's intervention for such order to be made applicable on you also.

Do let me know if your plot was in disputed list or not?

I need a copy of judgement by which HUDA  is demanding enhancement from plot holders of sector-57. If you have the same please arrange to send else you may give the detail of the case so that I will get the order copy.

 

I am a plot holder of sector-57. I will be obliged if you guide me in this regard.
