Dear sir, 

 

Today I met with the Estate Office –II at around 12 noon in his office to resolve my queries of plot no 2256/sector-57, Gurgaon.

 

The young Estate office was rude and in place of resolving the issues raised by me, he threatened to cancel the allotment of my plot.

 

I am enclosing herewith a copy of my letter dated 28th December, 2015 to the Estate Office-II.

 

I request you to point out if I had written something wrong or illegal or illogical or indecent in my letter to the Estate Officer. The Estate officer is doing everything to evade replies to the questions raised in my letter in respect of my plot originally allotted to me. 

 

The Estate Officer-II went to the extent to threaten to me to cancel my plot duly registered in my name through conveyance deed, is shocking.

 

This is just for your information and necessary action.

Dear Sir,

This has reference to the letter no- 12697 dated 6th November 2015 from the Executive Engineer, HUDA, Circle No. 1, Gurgaon (Annexture-1) in response to my email dated 16/10/2015 to you.

I sought few clarifications in my mail to you. All points were related to the development of the area where my plot is situated except one point in which I asked for a copy of the court order, which has given power to HUDA to claim additional enhancement money from the plot holders. Till now neither have I been provided a copy of the court order nor any satisfactory reply about the issues raised by me about the development of sector-57.

The reply given by the Executive Engineer only provides information about the bare minimum development works, i.e. water supply, sewerage, the road up to WBM & electrification work only. But I was not provided the other allied development work which also includes street lighting, park, club/community centre, hospital/dispensaries, shopping area, school, security, cleanliness etc. These are very basic needs of residents of a colony and HUDA promised at the time of allotment of the plot. However, till date there is no response from HUDA on these aspects.

The reply given by the Executive Engineer vide memo no DS/2015 dated 06/11/2015 has stated that date of completion of development works surrounding the plot no-2256, sector-57 is 13/04/2010. This is totally untrue and, in fact, I got the actual physical possession of plot on 29/06/2012 after removing unauthorized construction on my plot. At that time also there was not even WBM road in front of my plot. It seems that the concerned Executive Engineer is trying to shield corrupt/ inactive persons by supplying false/incorrect information. As a proof I am attaching an image taken from the Google map dated 03/08/2013 that clearly shows that there was no approach road for my plot till that day (Annexture-2).

A few days back, I visited the location of my plot only to find that even now there was not even metallic (WBM) road in front of my plot and surrounding to my plot and most of the roads in the sector were in a pathetic condition except very few parts of the roads. There is no street light in the entire area, no cleanliness, no security, no shopping area, no club/community centre, no school, no health centre, even the plot allotted for the park was in very bad and unimaginable condition with some unauthorized rooms/ huts constructed in the park area. It looks like an unauthorized and unplanned colony cut on an agricultural land by some villager and not by a reputed state government organisation like HUDA which has a huge force of highly capable and qualified persons and with the backing of state government.

HUDA gave me offer for possession on 14/01/2010 vide letter bearing no 892 but due to delay in handing over possession  and inaction in respect of the development of the site by your team, I am not been able to construct my house for last 6 years. I have to make alternative arrangements for last 6 years for accommodation because of your fault and delay. Due to delay in handing over the physical possession and non development of the area I have to spend additionally to live in Gurgaon. Presently I am facing difficulties due to high rates of rented accommodation and I am compelled to leave Gurgaon shortly. Now you have to pay the compensation for the same. The cost of constructions has also increased in last 6 years which will be claimed from you apart from the other damages.

At this juncture, I once again draw your attention to the point no-7 of the allotment letter (annexture-3) dated 28/01/2005 that possession of the site will be offered to you on completion of development work in the area, where the site is situated. In fact, this is the only point in which you made a promise to me and all the other point are relating to either penalising allottee or providing you some authority or some directions to the allottees. You failed to fulfill the only promise made by you in the allotment letter and expecting that allottees should fulfill all the other terms and conditions/ directions of the allotment letter, is unfair. On the basis of the terms and conditions of the allotment letter, I accepted the plot and paid the entire savings of my family. It is very unfortunate that your entire team has defrauded me and is now trying to justify by supplying wrong and incorrect information. I am also attaching the printout from your website which clearly mentioned that the offer of possession of plot is given after completing all the development works in the sector (Annexture-4).

Also, I once again request you to provide me a copy of the court order that has given power to HUDA to claim additional enhancement money from the plot holders. I suspect that your officers are not giving correct facts to the allottees and trying to collect the amount illegally in the name of the Court order because out of Rs. 575,61,41,460/- towards of enhancement demanded by HUDA only Rs. 23,03,34,548/- is awarded by the court after allotment made to me and rest of Rs. 5525806912/-( i.e. 98% of total amount towards enhancement) was awarded by the court was on 21/07/2003 which is much prior to the date of allotment(Annexture-5). This fact was not disclosed to me in the allotment letter which means that you had concealed this material fact relating to the plot, willfully. I am feeling  cheated as you are demanding Rs. 6712.91 per square meter additionally towards the enhancement of cost which is about 145% more than the tentative price offered to me in the allotment letter and failed to disclose this material fact that out of this 96% amount was relating to the period before allotment of plot made to me. I fail to understand why this crucial and material fact was not disclosed to me at the time when the plot was allotted to me.

In addition to the aforementioned court order, please also supply a complete copy of the offer document made to public for Sector-57 in the year 2003/2004.

I would also like to remind you of the preamble of HUDA, which is being reproduced for your ready reference

Is it not the duty to give prompt and fair reply to me (allottee), which HUDA has promise?
