SAN FRANCISCO, Jan. 9 /PRNewswire/ -- Informix Corp , Melita
International Corp. and Oracle Corp today
announced an agreement that allows Informix to continue using the name
"Universal Server" for its software
products. Previously, Oracle and Melita had claimed exclusive rights to
the words "Universal Server."

The agreement comes after San Francisco U.S. District Court Judge
William Orrick, on July 10, 1996, denied a
preliminary injunction sought by Oracle and Melita which would have
blocked Informix from using the Universal
Server name pending trial. In denying Oracle and Melita's motion, the
Court found that Informix's use of the name
"INFORMIX-Universal Server" was not likely to be confused with
"ORACLE(R) Universal Server" or Melita's
"Universal Server." The Court noted that the use of the prefix
"Informix" clearly denoted the source of the product.

Informix and Oracle are promoting software products named
"INFORMIX-Universal Server" and "ORACLE(R)
Universal Server." Melita, a worldwide leader in call center solutions,
has offered its PhoneFrame(R) CS system,
which incorporates its "Universal Server(R)" technology, since 1994.

None of the parties involved in the agreement offered financial or any
other type of compensation in return for the
out-of-court settlement.
