KUALA LUMPUR, June 13 — AirAsia Bhd has requested the government to set up an independent body to probe the much-delayed construction of the new low-cost airport, klia2.

Chief executive officer Aireen Omar said an independent body should evaluate three key points regarding the project — the current progress of the project, when can it be completed and how much is it going to cost?

“We (AirAsia) believe that this is the fairest solution to ensure proper accountability for the project.

“Unless the true cause of the delay is made known, AirAsia feels there may be more finger pointing (against AirAsia or contractors) which will do nothing towards the completion of the project,” she said in a statement here today.

Aireen also rubbished claims by certain quarter that the delay was only caused by AirAsia’s ‘indecisiveness’ on the baggage handling system (BHS) and aerobridges.

“The claim deflects the public’s attention from the magnitude of the klia2 project which has grown so exponentially from what was originally envisaged in 2009.

“The BHS and aerobridges are only smaller components and should not be the main factor in the delay,” she said.

In June 2011, Malaysia Airports Holdings Bhd (MAHB) had accused AirAsia, the main airline to use klia2, for the construction’s delay, due to the latter’s request to up passenger capacity to 45 million passengers per annum from 30 million previously.

The airport operator also said the low-cost airline declined to use aerobridges, citing high operating cost and also decided at the last minute to switch from a semi-automated BHS to one that was fully-automated.

The realignments had pushed back the completion date of the new terminal to April 2013.

Prime Minister Datuk Seri Najib Tun Razak had in January 2013 announced that klia2 will be launched on June 28, coinciding the launch date of Kuala Lumpur International Airport (KLIA) in 1998.

It is a known fact that Air Asia was an integral part of the KLIA2 project late delivery problem. They were very unprofessional on several issues during the design and development stage of the project. Specifically on items such as the aerobridge and baggage delivery system. Later on, they insisted to create premium lounge in the international terminal. It is hardly a surprise if the added more issues during the construction period.

A month ago Malaysia Airports confirmed the revised delivery date of KLIA2 is due to ‘quality and safety issues’.

KUALA LUMPUR: Malaysia Airports Holdings Bhd (MAHB) has confirmed the delay in the opening of the new low-cost air terminal, klia2, scheduled for June 28, after taking into account several key quality and safety issues.

MAHB is expected to convene a special meeting with all stakeholders soon, to explain the delay in the construction of the RM4 billion airline hub.
“We will be meeting all concerned before announcing a revised opening date. The stakeholders are among others, the contractors, airlines, retail tenants and government agencies,” MAHB Chief Financial Officer, Faizal Mansor told Bernama.
He said MAHB does not want to rush the klia2 contractors, which could jeopardise the quality and safety of the airport.
“We want to ensure things are done right to avoid any glitches on the opening day,” he added.
Faizal,however, declined to reveal any timeline, as to when the klia2 would be launched, or the duration of the delay.
The June 28 launch date target was mooted by Prime Minister Datuk Seri Najib Razak, to coincide with the date of the opening of the Kuala Lumpur International Airport in 1998.
With some 10 airlines committed to operate from it, the klia2 is built to cater for the explosive growth expected in low-cost travel, while envisaged to also handle a maximum of 45 million passengers per annum.
It will have 60 gates, eight remote stands and 80 aerobridges, plus a 32,000 square metre retail space with 225 outlets.
Meanwhile, RHB Research analyst, Ahmad Maghfur Usman said the delay can go on for as long as six-months, with the airport at present just under 90 per cent complete.
He said the airport apron, a vital component of an airport, is also not ready.
“Even if the new terminal can be completed by September after a two-month delay, MAHB would still need to carry out operational trial runs, that may require at least four months,” he added.
Despite the delay in the klia2′s opening, Ahmad Maghfur said it is unlikely that MAHB will experience cost overruns, since it is not due to variations in the terminal’s design, while contractual terms are fixed. — BERNAMA

This is not new for the industry since renown airports al over the world had timeline delivery issues as well.

The ongoing progress in the KLIA2 project

This call by Air Asia CEO should be deemed outrageous since KLIA2 project is owned by Malaysia Airports Holdings Bhd., a public listed GLC which Khazanah Holdings Bhd. owns more than 70%. A plc capable of conducting its own investigations for any project’s late delivery and irregularities.

There is enough statutory regulation to be complied to ensure that any plc conduct its business under good corporate governance. There is the Executive Committee, Audit Committee and Board of Directors, which have its own reporting system and processes, and controls to deal for any projects undertaken or being contracted out.

Then there are also the same committees at Khazanah level, which are able to make the necessary queries for their own purposes if not safeguarding the public interest. After all, time is money to Khazanah and its their primary KPI to maximise the returns on their investments.

On top of that, projects under Malaysia Airports are being monitored by various committees under Ministry of Finance, Ministry of Transport, Ministry of Public Works and ICU under the Prime Minister’ of Department. Media could get relevant Ministers to give their comments on the subject matter.

If all reports and analysis are not satisfactory, then there is the Parliament. MPs and Senators, be it the ruling party or opposition, could raise the matter and demand for the relevance Ministers to respond.

AirAsia X IPO at RM1.45 a share, market cap RM3.4b (Update 2)

KUALA LUMPUR: AirAsia X Bhd‘s initial public offer (IPO) of up to 790.12 million shares, which includes the issuance of new shares, will see its market capitalisation increase to RM3.43bil, based on the enlarged share capital of 2.37 billion shares.

In its summary prospectus issued on Monday, AirAsia X said the enlarged paid-up would be 790.12 million shares comprising an offer for sale of up to 197.53 million existing shares and a public issue of 592.59 million new shares.

AirAsia X said the floatation exercise includes the sale of 197.53 million existing shares and 592.59 million new shares. The institutional offering would involve 538.01 million shares while the retail offering would be 252.11 million shares.

The listing exercise would enable AirAsia X to raise RM859.26mil from sale of 592.59 million new shares at an indicative retail price of RM1.45 a share.

Of the gross proceeds of RM859.26mil, it said RM280mil would be used a capital expenditure, another RM285.81mil for repayment of bank borrowings, RM255.45mil as general working capital and the remaining RM38mil for listing expenses.

The low-cost carrier posted revenue of RM535.27mil for the first quarter ended March 31, 2013, compared to RM1.28bil in the year to Dec 31, 2012.

Its net profit during the first quarter of 2013 and financial year ended Dec 31, 2012 stood at RM50.19mil and RM33.85mil, respectively.

These series of Tune Air subsidiary executives shooting their mouth off which should be seen as a smoke screen, to camouflage the issues and setback that Air Asia and Air Asia X are facing. Especially in the midst of the IPO exercise of Air Asia X and all the controversies that loom the company and their business deals.

The failed acquisition of Batavia Air should be under corporate governance microscope. Last July, Air Asia announced the acquisition of Indonesian carrier Batavia Air. The acquisition faced some controversies, which included Indonesian authorities investigation on the deal.

The deal was deemed dodgy less than three months after Tune Air CEO Tony Fernandes’s announcement of the acquisition is off, Batavia Air filed for bankruptcy.

Indonesian court declares Batavia Air bankrupt months after AirAsia aborted deal to buy

JAKARTA, Indonesia – Indonesia’s commercial court has declared budget carrier Batavia Air bankrupt just months after AirAsia, Southeast Asia’s top low-cost airline, aborted a deal to invest in it, officials said Thursday.

Agus Iskandar, presiding judge at the Jakarta Commercial Court, said a bankruptcy petition filed by U.S.-based International Lease Finance Corporation was approved on Wednesday after Batavia Air failed to pay a $4.7 million debt that was due Dec. 13. Flights abruptly stopped just after midnight, stranding hundreds of passengers across the country.

He said Batavia’s debt was from the purchase of two Airbus A330s financed by ILFC through a leasing scheme.

Batavia spokeswoman Elly Simanjuntak said the airline was planning to use the two planes to fly Indonesian hajj pilgrims to Mecca. The airline, however, failed to meet government requirements for flying pilgrims. Indonesia’s religion ministry oversees travel arrangements for the pilgrimage.

Simanjuntak said that Batavia, owned by Jakarta-based P.T. Metro Batavia, has seven days to decide whether to appeal the court decision, and had yet to make a decision on the matter.

“The court verdict and media information have caused us to lose confidence from our agents, customers and business partners,” she said while weeping.

She said the court designated four local law firms to handle all matters related to the company, such as ticket refunds, cargo, taxation and employment settlement for about 3,400 employees.

Transport Ministry spokesman Bambang Ervan said his office has called on Batavia to co-operate with other airlines to help transport stranded passengers to their destinations. He did not know the number of people who were stuck with unusable Batavia tickets.

Malaysia-based AirAsia announced its acquisition of a 49 per cent stake in Batavia in July to accelerate expansion in Southeast Asia’s biggest economy. But it abandoned the $80 million deal to buy Batavia three months later after determining it was too risky and may hurt earnings.

Batavia began operations in 2002 and operated up to 170 flights daily. It had 39 aircraft at its peak in 2010 and serviced 42 Indonesian cities and destinations in five countries, flying both Boeing and Airbus jets.

AirAsia and ANA Clash Over Japan Budget Airline

KUALA LUMPUR, Malaysia—Management tension is threatening to derail a budget-airline venture between AirAsia Bhd. 5099.KU -1.84% and the parent company of All Nippon Airways, indicating the challenges of operating a carrier in Japan.

The AirAsia Japan venture between AirAsia and ANA Holdings Inc.9202.TO -3.47% has been unprofitable since it started flying in August, underscoring the difficulty of getting a low-cost airline off the ground in Japan, where landing and ground-handling fees are among the highest in the world.

AirAsia Japan, based at Tokyo’s Narita airport, competes with ANA cut-price airline Peach Aviation Co.

“We are looking for the best ways for the future growth of AirAsia Japan, and that includes the possible dissolution” of the venture, an ANA spokesman said.

ANA and AirAsia said there were no immediate plans to end the partnership, responding to a Nikkei newspaper report that they were set to dissolve the venture.

“The problem is not with the model, it’s with management,” AirAsia chief Tony Fernandes told The Wall Street Journal.

AirAsia Japan will do well, he said. “But it’s got to be run as a low-cost airline. The difficulties right now…are that we just have different styles of running it.”

Mr. Fernandes didn’t elaborate on the points of disagreement.

AirAsia holds 33% of AirAsia Japan, and ANA owns the rest. AirAsia said last month that the partners were discussing a turnaround plan. AirAsia Japan Chief Executive Yoshinori Odagiri said keeping costs low had proved to be the company’s biggest challenge.

AirAsia Japan flies to only five Japanese destinations plus Seoul and Busan, South Korea, using a fleet of four Airbus A320 jets.

The carrier, meanwhile, has to resolve the challenge of operating at Narita, which is one of the busiest airports in Japan but isn’t open 24 hours a day, unlike Kansai International Airport, where Peach is based.

Malaysia’s AirAsia remains the biggest budget carrier in Asia, operating a fleet of 124 Airbus A320s. It also has operations in Thailand, Indonesia and the Philippines and is seeking regulatory approval for a venture in India.

AirAsia’s long-distance affiliate, AirAsia X, held an initial public offering on Monday, seeking to raise up to $426 million. The IPO would be Asia’s largest since the listing of Japan Airlines Co. 9201.TO -0.40% last year, according to Dealogic.

This is not withstanding on the controversies such as the fact that Air Asia’s Airline Operating Certificate was not renewed last October, due to “Obsolete Flight Operations manual and non compliant to the Flight Operations manual”. A temporary AOC was issued by DCA, amidst the rectification of issues the authorities deemed as ‘flight operations and safety risks’.

Of course there is this perpetual controversy of Air Asia is said not to have passed the airport taxes they collected from the passengers to the Federal Government. The Malaysian public should be reminded of Tony Fernandes’s attempt to get the consumers to revolt against the Malaysia Airports in November 2011 in his ‘Airport Spring’ campaign.

Malaysians should be reminded at one point, Air Asia owed Malaysia Airport for an areas of RM 132 million of airport taxes and charges. Then the latest which was raised by former Wangsa Maju MP Wee Choo Keong on the refusal to hand over the unclaimed airport taxes.

There is also the controversy of Air Asia X was fined by an Australian Court for cheating.

The suspicion started to arrive on all these partnership and acquisition deals of Air Asia; Are they genuine and going concern or another sophisticated strategic marketing and corporate games gimmicks to uplift the profiles of Air Asia and Air Asia X? Is the Air Asia X IPO is a sophisticated corporate exercise to raise money from the capital market for the reduction of Air Asia’s debt?

These are very serious issues. Air Asia and Air Asia X should be investigated. Not just by the authorities, but independent panel of investigators. Considering that Air Asia and Air Asia X are PLCs and they carry 36 million passengers annually, Prime Minister Dato’ Sri Mohd. Najib Tun Razak should form a Royal Commission of Inquiry (RCI) to get to crux of the issues.

One of the more than few Air Asia’s runway mishaps

It should be deemed necessary as the two PLCs are exposed to investments from the public and capital market, and financial facilities for institutions local and abroad. Then there are ‘flight operations and safety issues’. The number of runaway mishaps, aircrafts returning to origin and some doubts on the maintenance, repair and overhaul operations (MRO) are also alarming and also require to be looked into.

There is also the question of Air Asia X IPO shares of being grossly overpriced.

The credibility and integrity of Malaysian PLCs, especially operating as an international carrier should be a concern for the Federal Government head of the ASEAN ‘Open Sky Policy’ due in 2015. The list of international investors and existing shareholders and commercial paper bearers of Air Asia X should be taken into consideration.

Malaysians should be reminded that Air Asia X was actually converted from the Fly Asian Express, which about from the Airline Rationalisation Plan(ARP)  that was brought forth by the dreaded ‘Level Four Boys’ in May 2006 during the weak and lacklustre administration of PM ‘Flip-Flop’ Abdullah Ahmad Badawi. FAX was originally licensed to take over the Rural Air Service of Malaysia Airlines’ community and national service to the interiors of Sabah and Sarawak.

This was part of the ARP where a sizable number of Malaysia Airlines routes were transfered to Air Asia. Air Asia used these new routes and number of frequencies of traffic and passengers as part of its book-building exercise. That warranted the consideration of additional financial facilities and commercial papers issued that would support the rapid and intense expansion program, especially to destinations around the region.

FAX was said to have immensely benefitted from the RM 250 million subsidy for the RAS and shortly there after, abandoned the program back to Malaysia Airlines to carry on serving the interiors of Sabah and Sarawak. Thus the MASWing was born. Conveniently in mid 2007, Air Asia X was launched using the FAX license and offered low cost carrier planned service to international destinations which include London, Paris, Jeddah, Perth, Sydney, Melbourne, Tokyo Haneda,  Beijing and Seoul.

The Malaysian public has been hoodwinked all this while  as ‘Low Class Operator’ Tony Fernandes. Nothing more than mere marketing and PR gimmicks such as getting Virgin Air Boss Sir Richard Branson to dress up as a stewardesses and the nauseating attempt to kiss.

Any of Tony Fernandes’s ventures should be taken with a sizeable amount of salt and knockings on the wood. At the announcement of the Air Asia-Malaysia Airlines ‘share swap’ in August 2011, he rubbished Malaysia Airports. Lucky that Prime Minister Najib saw the wisdom not to follow through the lopsided deal and reversed it back to status quo.

There is a limit to the falsehood of a sophisticated marketeer’s gluttony.

Ribut melanda Pulau Pinang lewat petang ini dan menumbangkan menara antena di atas bumbung bangunan Umno negeri di Jalan Macalister.

Struktur tersebut yang terletak di atas bumbung bangunan 23 tingkat itu, jatuh di atas jalan raya.


Menurut Ketua Menteri Pulau Pinang, Lim Guan Eng, pihak polis telah dimaklumkan mengenai kejadian itu untuk segera mengambil langkah keselamatan.

Dalam kenyataan audio kepada media, Lim berkata setakat yang diketahui, hanya seorang yang cedera serius dan telah dihantar ke hospital.


Menurutnya, kira-kira tujuh buah kereta rosak dan beliau berharap tidak ada lagi mangsa terlibat.Lim menggesa Umno negeri supaya segera membuka bangunan itu supaya tindakan segera yang boleh diambil untuk mengelakkan lebih bahagian bumbung jatuh.

NONESementara itu, Bernama melaporkan angin kencang dan hujan lebat yang mengakibatkan tiang antena itu runtuh, telah mencederakan tujuh penguna jalan raya, dua daripadanya parah.
  
Menurut jurucakap Balai Bomba Lebuh Pantai, tujuh kenderaan termasuk sebuah lori muatan tong gas rosak dalam kejadian lewat petang ini.
  
Katanya pihaknya menerima panggilan kecemasan pada jam 6.55 petang dan sebuah jentera bersama tujuh anggota dihantar ke tempat kejadian.


Sementara itu, ketika dihubungi, Ketua Pemuda Umno Pulau Pinang, Shaik Hussein Mydin berkata, beliau dimaklumkan bahawa antena di atas bangunan itu telah runtuh.

Terdapat banyak pejabat di dalam bangunan itu dan pejabat Umno terletak di tingkat enam dan tujuh.

"Ia adalah satu kemalangan, satu bencana alam," katanya.

Apabila diberitahu ada yang dipercayai cedera parah dan telah dihantar ke hospital untuk rawatan, Shaik Hussein mendoakan mangsa terbabit cepat sembuh.

"Kami akan menilai situasi dan melihat apa yang perlu dilakukan," katanya.


NONESementara itu, Bernama  melaporkan Sementara itu, Ketua Polis Pulau Pinang Datuk Abdul Rahim Hanafi berkata dalam kejadian itu mengakibatkan tujuh kenderaan termasuk sebuah lori pikap rosak teruk akibat dihempap pemancar telekomunikasi sepanjang kira-kira 20 meter itu dan pemandu lori berkenaan cedera parah. 
   
"Di daerah Timur Laut terdapat lapan tempat yang terlibat di mana ada yang pokok tumbang dan yang serius sekali di Jalan Macalister di mana antena (pemancar telekomunikasi) atas bangunan Menara Umno telah jatuh dan mengakibatkan seorang (pemandu lori pikap) cedera parah.
   
"Bagi daerah Seberang Perai Tengah ada dua tempat yang terlibat dan daerah Seberang Perai Utara ada 10 kawasan terlibat manakala di daerah Barat Daya melibatkan satu kawasan," katanya kepada pemberita di tempat kejadian malam ini.

Abdul Rahim berkata kejadian itu juga mengakibatkan paip bawah tanah di jalan berkenaan pecah.
   
Beliau berkata agensi kerajaan akan memberi bantuan segera bagi memulihkan keadaan dan beliau menyeru orang ramai agar memberi kerjasama kepada pihak berkuasa.
   
"Masyarakat jangan marah kepada keadaan lalulintas yang sesak dan saya akan pastikan jalan laluan berjalan dengan lancar dalam masa yang singkat," katanya.


NONESementara itu, Ketua Balai Bomba dan Penyelamat Lebuh Pantai Ismail Mohd Zain berkata: "Apabila sampai, kita dapati pemancar telekomunikasi di atas bangunan ini jatuh dan menghempap beberapa kenderaan.

Yang cedera parah adalah daripada lori pikap yang membawa tong gas, yang lain-lain cuma cedera ringan.
   
"Buat masa ini keadaan kembali stabil cuma kita nak kosongkan kawasan ini dan nak tinjau bangunan. Setakat ini, pada zahirnya bangunan ini selamat kerana yang jatuh itu adalah alat komunikasi yang dipasang bukan struktur bangunan," katanya.
   
Saksi kejadian, Imam Masjid Pakistan Hafiz Mohamad Akhlaq, 32, berkata ketika kejadian beliau berada di dalam masjid sebelum mendengar bunyi kuat seperti gempa bumi.
   
"Nasib baik saya berada di dalam masjid kerana selalunya saya akan duduk di luar kawasan masjid sementara menunggu waktu Maghrib. Selepas mendengar bunyi kuat itu saya dapati antena telekomunikasi menghempap sebuah kereta," katanya.
   
Seorang lagi saksi yang turut berada di dalam masjid itu, Mohd Yasin Hamid, 59, berkata beliau bersyukur kerana pemancar telekomunikasi itu tidak menghempap masjid kerana masjid itu terletak di hadapan Bangunan Umno.
   
"Memang satu keajaiban kerana pemancar itu tidak jatuh menghempap masjid ebaliknya jatuh ke jalan raya," katanya.-malaysiakini





Gale knocks down Penang Umno HQ antenna...

The Penang Umno headquarters was damaged by strong winds, breaking the antenna from the 23-storey building.

NONEAccording to Bernama, seven pedestrians were injured. Two of whom suffered serious injuries. Seven vehicles were also damaged.

The Lebuh Pantai fire station said that the incident happened at 6.55pm.


The rubble had caused massive damage to Jalan Macalister, located in the heart of Georgetown.
Kitchen gas cylinders which appeared to have fell off a truck were seen strewn across the road. 

In a press release, Penang Chief Minister Lim Guan Eng urged Penang Umno officials to swiftly provide rescue workers access to the roof to prevent more debris from falling off the roof.

"About seven cars have been damaged and we hope there are no more casualties," he said.


NONEWhen contacted, Penang State Umno Youth chief Shaik Hussein Mydin said he received word that the lighting rod of the building has collapsed.

"It's an accident, a natural disaster. We hope no one is hurt, " he said.

Shaik also offered his sympathy for those injured.

The building houses many offices. Umno occupies the sixth and seventh floor.


Yesterday, the meteorological department had warned fishermen to stay away from the sea as they had predicted strong winds and choppy seas.

Penang police chief Abdul Rahim Hanafi said there were many areas of the island that has been badly affected by the storm.

"In the Timur Laut district, eight areas were affected whereby trees fell but the most serious incident involved the antenna at the Umno building in Jalan Macalister toppling over.

"Two areas in Seberang Perai Tengah were affected, 10 areas in Seberang Perai Utara and one area in the Barat Daya district," he told reporters, according to Bernama.


CM: Let's help clean it up

NONESpeaking to reporters at the scene of the incident later, Lim said the state is looking into ways to handle the situation after security and cleaning works have been done in the area.

"Everyone now is in a state of shock. We are assessing the damage and how to get this road, which is heavily used by vehicles, back to normal again so as to not disrupt the traffic," he said.

Penafian beberapa syarikat pengeluar kereta bahawa mereka menurunkan harga kereta, sebagai sebahagian memenuhi janji pilihan raya BN, dilihat memalukan parti itu, kata Pengarah Komunikasi PKR Nik Nazmi Nik Ahmad.

NONEMenurut Nik Nazmi (kanan) lagi, ia sekali gus mendedahkan betapa terdesaknya parti pemerintah dalam berhadapan dengan kempen turunkan harga kereta oleh Pakatan Rakyat.

"Episod memalukan ini mendedahkan betapa terdesaknya Umno-BN dalam berhadapan dengan kempen #TurunkanHargaKereta Pakatan," kata Nik Nazmi dalam kenyataannya hari ini.

Pada 10 Jun lalu, akhbar Umno Utusan Malaysia melaporkan, kerajaan memenuhi janji menurunkan harga kereta secara berperingkat apabila lima syarikat pengeluar kereta mengumumkan penurunan harga 10 model kereta keluaran mereka.

NONEHarian itu juga melaporkan, penurunan antara RM449 hingga RM12,775 (dari 0.7 hingga 11 peratus) dalam tempoh Januari hingga Mei tahun ini membabitkan kereta keluaran Peugeot, Proton, Perodua, Volkswagen dan Honda.

Penurunan fasa pertama harga kenderaan itu merupakan sebahagian daripada pelan kerajaan menurunkan secara berperingkat harga kereta sebanyak 20 hingga 30 peratus sehingga 2007.

Bagaimanapun, Volkswagen dan Peugeot Malaysia di Facebook masing-masing, menjawab soalan pelayar Internet, menafikan perkara itu.

Volkswagen Malaysia menjelaskan, harga modelnya Golf tidak diturunkan dari RM169,888 kepada RM157,888, sebaliknya memang dilancarkan dengan harga RM157,888.

Manakala Peugeot pula berkata, mereka tidak dirujuk dan tiada kaitan dengan artikel itu. Menurut pengeluar kereta Perancis itu juga, harga yang ditunjukkan 308 Turbo pra- facelift dan 308 VTi sebenarnya merupakan dua varian berbeza dari Peugeot 308.

"Setakat pengetahuan kami, tiada dasar berhubung sebarang harga baru," jelas Peugeot Malaysia di Facebook lagi.-malaysiakini

Utusan's lied on lower car prices

Umno-owned newspaper Utusan Malaysia received another bashing from the Penang government for "lying" that car prices had dipped in line with the BN's government 'Janji Ditepati' (promises fulfilled) 13th general election slogan.

"Utusan lied when it said the federal government has fulfilled its election pledges of providing cheaper cars," Lim said at a press conference.

"But the car companies have come out to refute the reports," he added, referring to Volkswagen and Peugeot which had rejected claims of price slashing for their cars.

"This is serious and the authorities should take action against Utusan. It seems we cannot trust anything they write, perhaps we can only trust the date on the newspaper," he mocked.

The DAP secretary-general was quick to add "this is nothing personal about the journalists but the newspaper company".

Details nailing the lies released

NONEOn June 10, Utusan carried a front-page report that 10 models of cars are now cheaper, as their cost had reduced from between RM449 to RM12,775 (0.7 to 11 percent), from January to May this year.

The Malay-language daily said the reduction applied to models such as Peugeot, Proton, Perodua, Volkswagen and Honda.

"The government has fulfilled its promises to reduce car prices in stages when the five companies announced the price reduction of ten cars," said the report.

It also quoted the Malaysian Automotive Institute as saying that the car prices cannot be cut suddenly as that would impact the prices of used cars, bank loans, used car industry businessmen and the banking institutions which provides car loans.


Three days later, Volkswagen Malaysia said in Facebook that: "Please be advised, the price on the image is incorrect. The Golf price has always been RM157,888 from time of launch. Not RM169,888. Thank you".

NONEMeanwhile, Peugeot Malaysia, on the question of whether there is truth in the price slash said: "Without prejudice, nothing was issued by us, we were not consulted before the article went to print and have no association with the news contained therein.

"The prices shown appear to be of the 308 Turbo pre-F/L and 308 VTi which are in fact two different variants of the Peugeot 308".


Umno's 'desperation' 

Meanwhile PKR said the episode reflected the “utter desperation” of Umno in dealing with Pakatan’s '#TurunkanHargaKereta' campaign to slash car prices.

Anwar: Pilihan raya semula di kawasan berlaku penipuan

Malaysia's Post 13th GE: Issues, Risks & the Myth of Transformation

I was asked the same question over and over again by my peers, clients and the media. I did not give an immediate answer because it is precisely a "post-GE' assessment. There is a need to review and analyze the responses from various stakeholders, parties and observers. There is a necessity to feel  the pulse of the nation before a valid and fact-based observation can be made.

There are a few themes which emerged from the 13th GE. Some of the issues and repercussions are going to be highlighted in point form. Firstly, I would like to highlight the key issues:

1) Division: It is quite clear now that the 13th GE has created more divisions than common grounds. The are more profound political differences between the two coalitions - PR and BN - and their supporters. The whole political discourse has become either black or white. It is either you are with us or you are against us. It was compounded by the fact that the Opposition PR had expected to win the GE but was not successful. On the other hand, the BN regime had singled out the low Chinese support as the main reason for their less than stunning victory.

Hence, the two coalitions are caught in an awkward situation. PR had blamed the electoral system and the alleged frauds as the main reason for their unsuccessful campaign. BN had blamed the Chinese community for their predicament. Both cannot accept anything than an absolute victory at the polls.

Continuous post GE bickering over the election results, now preceded by the petitions, is going to drag on for months to come and is going drag in a lot of their supporters and members as well. This is the first sign of division.

Worse case scenario, the division might even expanded to include the rural-urban divide, ethnicity (Malay versus Non-Malay), alternative versus mainstream media and religion (remotely). On the urban-rural divide, the dialogue has involved both the communitarian and morality dimension. It has become socially unthinkable to take a centrist position without being berated by one's social circle. Supporters from both coalitions have taken to peer pressure and communitarianism to press for support and compliance from their friends, colleagues and peers. This is often coated with both communal and morality arguments.

2) Credibility Crisis. The newly minted PR has won almost 90% of all urban seats, leaving BN with both semi-rural and rural seats. However, any discourse concerning the nation is often dictated by the urbanites. The emergence of the online social tools such as the Twitter, Facebook, Blog, Youtube etc. the dominant discourse is not one the ruling regime will cherish.

On the polling night itself, after news that the BN had successfully formed the Federal government, the public discourse on the Internet had established its foothold, intent, shape and agenda. The BN regime and the institutions and processes created by its regime were going to be discredited so that the PR would gain immediate advantage and influence over the minds of the urbanites.

Even with a comfortable mandate and majority, the BN is going to find a hard time restoring its credibility if it cannot influence the discourse. BN might continue to rule but the PR would continue to hold on to their influence and electoral gains and hopefully to build on them.

What is worse and damaging is the credibility crisis has grown internationally. Supporters and leaders of the PR coalition are taking their grouses to the UN, the White House, the UK government, Australia and other international platforms. A number of fraud allegations were made online and they were quickly replicated and shared out by the followers.

The coalition led by de facto leader Anwar Ibrahim was quick to respond with the "Blackout 505" rallies throughout the country to blame the coalition's defeat on electoral fraud and a partial Election Commission. Soon, the fault lines expanded to include the First Past the Post electoral system, gerrymandering, imbalanced rural-urban voters ratio, indelible ink and weightage and others. Calls were made by the pro-PR NGOs for the EC heads to step down.

All these allegations were made before the election petitions were filed and up till today there was no incriminating evidence on illegal Bangladeshi voters or actual blackout at the counting centre. Nonetheless, the intention was clear - to ruin the credibility of the victor in the elections and to cast doubts on the electoral system, agency, players and rules. Here, the PR has successfully taken a higher moral ground and has won the perception war on the back of the newly elected government's credibility.

It is important to note that because the discourse was dominated by largely the pro-PR urbanites, the allegations made and rumours spread by the PR to gain electoral advantage during the campaign period were never challenged or questioned or brought up in any of the civil discourse.

To make the matter worse, the BN had actually committed various money related offenses during the campaign period. Most of them were committed via their 'supporters' and not directly through their candidates or parties. The electoral abuses are going to haunt the regime in the coming days and even leading up to the next GE.

3) Directionless. We can positively expect the political bickering to continue in the coming months if not years leading to the next GE. PR has made impressive gains not only in the Parliament but also in most of the state assemblies. While we rejoice at the birth of the two party system, the real two party system can only be beneficial if both coalitions know when to bicker and when to cooperate. Perpetual bickering is the most likely scenario here. Mutual competition and opposition is going to happen on all policy decisions and this can be really distractive to governance.

On the aspect of economic management, there is a need for a bipartisan cooperation since the BN has control over finances and the Federal administration while PR is leading the two biggest economies in Malaysia; Penang and Selangor. On economic competitiveness, the country must find viable solutions to a vast array of issues e.g. finding new economic frontiers, fostering a vibrant economy to attract more local and foreign investments, create more valued added jobs, solving the income bottlenecks, moving up the value chain and technology adoption, regional positioning and strengthening trade.

A number of these issues cannot be addressed without ironing out the political differences between these two coalitions. The political risk posed by the bickering coalitions is enough to turn off any potential mid-to-long term commitment and investment in the country.

There is a danger of the BN government being selective in its economic direction and stimulation. Some hawkish leaders in UMNO are already calling for a tit-for-tat action against the Chinese community for rejecting their hand of "friendship". Utusan Malaysia, the conservative UMNO mouthpiece, has been publishing provocative headlines on the Chinese voters' snub against the UMNO-led ruling regime. The same leaders have suggested to the Najib administration to focus more and reward the Malay, Indian and Sabah and Sarawak natives for supporting the regime.

If Najib's submits his administration to the internal pressure, it might spells more instability for the private sector investment in Malaysia. There is going to be a greater outflow of funds and talents overseas.

There is little to differentiate the economic model of both PR and BN; although the former claimed to be more credible and accountable. However, there has not been any major institutional or systemic transformation in both Selangor and Penang over the last 5 years. During the 13th GE, both coalitions had stuck to the populist policy by promising more grants and subsidies to the lower income group.

There was little mention of transformation, reformation and overhaul of the socio-economic model and governance. There was no mention of their respective foreign policy direction. Hence, it is suffice to note that the socio-economic model and the foreign policy direction would not be undergoing any major transformation apart from the check-and-balance e.g. open tender, counter wastage and corruption proposed by the PR.

4) Myth of Transformation. It would be foolhardy to expect any major transformation or reforms after the 13th GE. In fact, the country is facing a risk of more hardline executive decisions, legislations (e.g. control of the Internet, sedition law, treason etc) and enforcement from the administration. In Malaysia, any political reform or liberalization is interpreted by the conservatives as a sign of weakness and losing its political influence.We might actually face a government that is less wiling to reach out to its perceived foes especially those who did not support the regime in the last GE.

Reformists in the BN might face a tougher time trying to convince the conservatives that more reforms are going to win back the urban support. It is left to be seen if the conservatives are going to call for a change of leadership in UMNO. There was a suggestion that UMNO needs a stronger and decisive leader. The period of Mahathirism is still being looked at with envy by his successors. Dr M had consistently delivered a 2/3 majority for the coalition throughout his 22-year tenure as the President/Prime Minister.

All programmes and measures that are seen to be accommodative to the Chinese community might be reviewed if the conservatives have their way. Just a moment ago, the Minister of Tourism Nazri Aziz has threatened a law suit against a Chinese school, SRJKC Chin Woo, for occupying a piece of land belonged to the ministry. A lack of representation in the Cabinet means the community is going to face a tougher time in bringing such issue to the Cabinet to be reviewed.

On the PR side,  their supporters have been berating any criticism against the coalition. They argued that it is still too early to press the coalition on governance and policy decision. They pointed out that the focus should be on the regime change. Since the GE, the coalition has yet to lay down their expectations and key targets for the 3 key states. PR especially the PKR is expected to go through some turbulence in their party polls this year.

For now, it is fair to say that PR's focus is going to be on efforts to continue to discredit the BN and to destabilize UMNO. The dynamics are quite substantial. It was reported that Gua Musang MP and UMNO veteran Tengku Razaleigh is again pitting himself as a PM candidate. It might be the case that the proposition was announced by his hardcore supporters rather than the man himself. On the PR side, it is highly unlikely that it is going to be anyone else but Anwar Ibrahim. Anwar is the DAP's choice and the latter holds the most Parliamentary seats among the 3 component parties. Any dissenters from UMNO and its alliance would prefer to align themselves to Muhyiddin Yasin rather than Ku Li.

Horse trading, bickering and party elections are going to take up the entire 2013. Transformation, for the nation and for the common good of all, is going to take a temporary backseat - hopefully not too long a wait.

5) Whither Reforms. It is time for PR leaders and elected representatives to realise that any change to the electoral system, Election Commission, federal agencies and re-delineation can only materialize if there is a bipartisan effort and common agreement. But who is going to take a lead and who would be allowed to lead? In the case of Malaysia, if BN give in to any of PR demand it would be seen as a sign of weakness vice versa. Hence, the DAP supremo Lim Kit Siang had made a number of good suggestions to reform the political system but would fall short at taking the first step to implement it at the DAP controlled state assembly.

It is unfortunate that both sides lacked leaders and elected representatives who could reach out to the other side and at the same time would enjoy the trust of their own party/coalition. It is a fact that both sides would have to sit down to identify and agree on the terms of governance and reforms needed to allow the two coalitions to cooperate in the parliament and state assemblies. Both coalitions cannot afford for the country to fail due to their excessive and unending bickering and frictions. Elections are not supposed to be a competition to celebrate the winners only. It is about the act to elect the people we can entrust to run the country on our behalf.

It is becoming quite difficult to appoint or identify any third party to help coordinate any bipartisan effort. The civil society is devoid of any credible, respectable and sincere centrists who could gain the trust of both coalitions to play the role of moderators. The blame game, peer pressure and overzealous partisanship have often come in between these centrists and the politicians. Most of the civil society activists had voluntarily or pressured to take side. The whole situation has contributed to a lack of political literacy in the country.

In summary, it is going to be a tough time for the nation to identify and chart its direction within the current political situation. For Malaysia to move forward, its citizens would have to take emotion out of the whole political discourse and start to understand the basic role of the electoral process, the real meaning of democracy and check-and-balance. Politicians need to understand that winning is not the only thing in an electoral process.

There are more important questions to answer: Is this nation going to become a better one in the next five years? If yes, what can I do for my nation? How?

Petisyen PRU13: Pakatan Rakyat 39, BN 21...

Petisyen Pilihan Raya Umum ke-13 (PRU13) yang tempohnya berakhir semalam, menyaksikan sejumlah 60 petisyen difailkan sekaligus menjadi jumlah paling banyak dalam sejarah petisyen pilihan raya di negara ini.

Apa yang menarik, tindakan memfaikan petisyen yang biasanya hanya sinonim dengan pihak pembangkang, kali ini juga turut dikemukakan oleh BN.

Daripada jumlah keseluruhan 60 petisyen itu, 39 dikemukakan oleh Pakatan Rakyat manakala 21 lagi oleh BN.

Bagi Pakatan Rakyat, 39 petisyen tersebut adalah membabitkan 25 kerusi parlimen manakala 14 kerusi Dewan Undangan Negeri (Dun).

Bagi BN pula, 21 kawasan yang terlibat adalah masing-masing enam parlimen dan 15 Dun.

Di Kedah, kawasan parlimen yang terbabit dengan petisyen adalah Merbok dan Kulim Bandar Baru yang dikemukakan oleh PKR, manakala tiada bagi kerusi Dun.

Di Kelantan perlimen terlibat adalah Ketereh yang dikemukakan oleh PAS, Machang (PKR), Bachok (BN), manakala bagi Dun pula, Kok Lanas (PAS), Selinsing (PAS), Ayer Lanas (PAS), Jelawat (BN), Mengkebang (BN), Gaal (BN) dan Manek Urai (BN).

Di Terengganu, tiada kerusi parlimen terlibat petisyen, tetapi kerusi Dun adalah Hulu Besut (PAS), Kuala Berang (PAS), Rantau Abang (BN) dan Teluk Pasu (BN).

Di Pahang juga tiada petisyen terlibat bagi kerusi parlimen, namun hanya satu bagi kerusi Dun iaitu Dun Cameron Highlands (DAP).

Bagi Pulau Pinang pula, parlimen terlibat adalah Balik Pulau (PKR) dan tiada petisyen bagi kerusi Dun.

Di Perak, parlimen terlibat adalah Tapah dan dua petisyen bagi Bagan Datok yang dikemukakan PKR, manakala bagi kerusi Dun adalah Selama, Rungkup, Manong, Pasir Panjang, Manjoi dan Lubok Merbau yang kesemuanya dikemukakan oleh PAS.

Bagi negeri Selangor, tiga kawasan parlimen terlibat iaitu Sabak Bernam (PKR), Sungai Besar (PAS), Kuala Selangor (PAS) manakala tiada petisyen bagi kawasan Dun.

Bagi Kuala Lumpur, parlimen terlibat adalah Setiawangsa (PKR), Titiwangsa (PAS), Lembah Pantai (BN) dan Parlimen Batu (BN).

Di Melaka, tiada petisyen yang dikemukakan oleh Pakatan Rakyat, manakala BN memfailkan dua petisyen iaitu bagi kerusi Parlimen Bukit Katil dan Dun Bukit Baru.

Bagi negeri Johor, parlimen terlibat adalah Pulai (PAS), Segamat (PKR), Ledang (PKR), Muar (PKR), Tebrau (PKR), Pasir Gudang (PKR), Labis (DAP), Batu Pahat (BN) manakala bagi Dun adalah Gambir (PAS), Mahkota (PAS), Nusajaya (PAS), Penggaram (BN), Parit Yani (BN), Stulang (BN) dan Puteri Wangsa (BN).

Di Sabah, parlimen terlibat adalah Kota Marudu (PKR), Beaufort (PKR) dan Pensiangan (PKR), manakala bagi Sarawak adalah parlimen Baram (PKR) dan Sarikei (BN).

Menurut Perkara 118 Perlembagaan Persekutuan, jika terdapat mana-mana pihak tidak berpuas hati dengan keputusan pemilihan pilihan raya umum lalu, mereka boleh mengemukakan petisyen pilihan raya kepada Mahkamah Tinggi yang mempunyai bidang kuasa di tempat pilihan raya itu diadakan.

Seksyen 38 Akta Kesalahan Pilihan Raya 1954 (Akta 5) pula memperuntuk tiap-tiap petisyen pilihan raya hendaklah dikemukakan dalam tempoh 21 hari dari tarikh keputusan dan penyata pengundian disiarkan dalam warta.

EC challenged in record 60 seats...

Deadline for submitting election petition to challenge election results in the recent polls ended yesterday, with a record 60 petitions filed by both sides of the political divide.

While election petitions have traditionally been filed by the opposition, this time 21 of these petitions came from Barisan Nasional, protesting the results announced by the Election Commission.

Pakatan Rakyat's 39 petitions involved 25 parliamentary constituencies and 14 state seats, while BN is disputing six parliamentary seats and 15 state seats.

In Kedah, the Merbok and Kulim Bandar Baru parliamentary seats are part of the petitions filed by PKR. 


While in Kelantan, the parliamentary seats and parties involved are Ketereh (PAS), Machang (PKR) and Bachok (BN). Three state seats are Kok Lanas (PAS), Selinsing (PAS), Ayer Lanas (PAS), Jelawat (BN), Mengkebang (BN), Gaal (BN) and Manek Urai (BN).

No petition was filed over parliamentary seats in Terengganu, but both BN and PAS are each disputing two state seats. Similarly, only DAP file election petition over the Cameron Highlands state seat.

Penang saw one election result - in the Balik Pulau parliament seat - which was wrested back by BN, being disputed by PKR.

In Perak, the parliamentary seats involved are Tapah and Bagan Datok, while state seats are Selama, Rungkup, Manong, Pasir Panjang, Manjoi and Lubok Merbau.

In Selangor, only parliamentary constituencies saw petitions filed: Sabak Bernam, Sungai Besar and Kuala Selangor.


 

In the Federal Territory, the seats and petitioners involved are Setiawangsa (PKR), Titiwangsa (PAS), Lembah Pantai (BN) and Batu (BN).

Election results in two state seats are disputed by BN in Melaka.

In Johor, election petitions have been filed for Pulai (PAS), Segamat (PKR), Ledang (PKR), Muar (PKR), Tebrau (PKR), Pasir Gudang (PKR), Labis (DAP) and Batu Pahat (BN) parliamentary seats. State seats involved are Gambir (PAS), Mahkota (PAS), Nusajaya (PAS), Penggaram (BN), Parit Yani (BN), Stulang (BN) and Puteri Wangsa (BN).

Sri Ram to act for Perak Pakatan over polls petitions...

As the deadline to file election petitions elapsed yesterday, there was one notable name which may have sent waves in the legal fraternity, namely, former Federal Court judge Gopal Sri Ram.

Justice Sri Ram - who retired from the apex court in February 2010 - is set to represent Perak Pakatan Rakyat in several of its petition applications in court.
Sri Ram, 69, was a practising lawyer who then became the first person to be directly appointed to the Court of Appeal from legal practice, and then was made a Federal Court judge in 2009.

NONEThe other person who broke the record was former Chief Justice (CJ) Zaki Azmi, who rose from public practice to become a Federal Court judge, and later CJ.

His name is written in several of the Perak petition applications, and he is expected to appear in court.

PAS central committee member Mohd Hanipa Maidin (right) - who is one of the party's legal adviser - confirmed with Malaysiakini the Federal Court judge is one of the senior lawyers who would act for them in three cases in Perak.

"All in all, there are six election petitions filed in Perak - all of them involving state seats.

"Three of them are being handled by the party's legal team and the remaining three are through our volunteer lawyers that include the eminent Gopal (Sri Ram)," said Hanipa, who is also Sepang MP.

PAS has filed six election petitions in Perak - involving Pasir Panjang, Manjoi, Lubuk Merbau, Rungkup, Selama and Manong.

Meanwhile, PKR has filed one election petition involving the Tapah parliamentary seat.

The Perak Pakatan election petition applications are seen as pivotal, because if Pakatan is successful, it can change the ruling government.

BN won in 31 state seats, while Pakatan has 28 seats. A switch of two out of six in the petition cases would result in a change in government.

Sri Ram not involved in Perak case
 

As the silver-producing state faces the constitutional crisis imbroglio - following a change of government in February 2009 - Sri Ram had not been involved in any of the appeals up to the Federal Court.

Former Perak MB Mohammad Nizar Jamaluddin had asked for a full bench of 11 judges to hear its appeal, but this was rejected by the apex court.


NONEIn the Federal Court, Nizar's (right) appeal was heard and rejected by then Court of Appeal president Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria (now CJ), and Federal Court judges Zulkefli Ahmad Makinuddin (now Chief Judge of Malaya), Mohd Ghazali Mohd Yusof (retired) and Abdull Hamid Embong (still Federal Court).

Hence, there should not be any problems for Gopal to act for Pakatan should BN lawyers object to his presence in the cases.

The former federal court judge, among others, is noted for giving oral judgments on the spot after listening to submissions.

He was also controversially involved at the Court of Appeal's judgment in the Metramac case against former Finance Minister Daim Zainuddin's running of the ministry "like it's a coffee shop".

Eventually, the remarks made by Sri Ram against Daim were expunged.

Nonetheless, Sri Ram is best known for his numerous sound judgments which still stand and are continuously being referred to.-malaysiakini

CIMB big boss Nazir Razak is now, officially, the darling of Pakatan Rakyat. He is hailed as a new hero for coming out to praise AirAsiaX CEO Azran Osman Rani for his anti-Malay, anti-Umno stance. Nazir has even won the adoration of DAP's Lim Guan Eng, who urged Najib Razak to try and be as brave as his little brother, and Zaid Ibrahim.

Some will ask if there is more than meets the eye. 

The one certainty is the label of “kacang lupakan kulit” will stick forever. Many will say he is where he is today because he benefited from NEP, because he has strong ties in Umno and because of his linkages with the party top leadership. So, why is he so prepared to be seen as anti-Malay, anti-Umno and along with that, inflict the unkindest cut of them all on his own brother, the PM?

One theory is that Nazir is buying political insurance to stay relevant in the event of an "Ubah". Never mind that it could be by street violence. It has been said a corporate man is always keen to see an easier passage for his company or business's quest for profit, profit, nothing but profit. It does not matter who is the government of the day so long as he covers both sides. This sometimes can lead to spilling the beans to stay alive if there is a new power in Putrajaya.Today, given the political landscape, Nazir may be out to buy insurance. Even if the premium happens to show one is anti-Umno and anti-Malay by supporting Azran.

Me, I think it is ok to massage the hand that may one day feed you but it is a betrayal to bite the hand that is still feeding you. 

p.s. I hope Nazir doesn't get carried away by Guan Eng and Zaid's praises. We know they'll use anything and anyone to get at his brother.

Proses Pembersihan Golongan Pro Pakatan Sudah Bermula????

Maklumat Tulang Besi dapat maklumat dari satu sumber yang sangat2 boleh dipercayai. Bahawa adalah sebuah "war-room" telah pun ditubuhkan. Matlamat "war-room" tersebut adalah untuk memandu serta mengkoordinasi kempen bagi menghadai pemilihan PAS bulan November ini.

Apakah matlamat kempen tersebut?

Tidak lain dan tidak bukan untuk memastikan tokoh dalam PAS yang dilihat tidak "wala'" kepada ulama dan Presiden dibersihkan sama sekali dari kepimpinan tertinggi parti.

Antara nama-nama yang telah disenaraikan dalam senarai "bersih" adalah : Khalid Samad, Salahuddin Ayub, Dr Dzul, Dr Hatta Ramli, Dr Syed Azman, Dr. Mujahid Yusuf Rawa, Husam Musa dan ramai lagi. Dengar ceritanya Dr Siti Mariah serta Siti Zailah pun bakal disembelih.

Mereka2 ini dilabel sebagai "pro Anwar" dan dianggap meletak Anwar lebih tinggi dari Presiden kerana banyak memangkah serta menegur Presiden PAS.

Tulang Besi tidak tahu maklumat ini benar atau tidak.

Kalau ditakdirkan maklumat ini benar, dan kalau perancangan "pembersihan" ini berjaya, maka selepas ini PAS akan menjadi parti PRO NAJIB dan akan muncul nanti ramai "NAJIBRINA" dalam PAS.

Dengan terbuangnya orang2 seperti Salahuddin Ayub dari Dewan Harian, maka projek PERPADUANG atau UGII akan berjalan dengan lancar selepas ini.

Atas sebab itulah kita lihat sekarang ini puak2 UG begitu marah apabila konsep wala' dipersoalkan. Begitu bersungguh2 mereka mempertahankan konsep wala' dari dipersoalkan. Marah sungguh mereka apabila dikatakan wala'itu adalah candu.

Ini kerana modal mereka untuk menjalankan kempen pembersihan tidak lain hanyalah "Wala'" dan "ulama".

Masej machai2 UG adalah satu: Kepimpinan ulama mestilah diberikan wala' yang tidak berbelah bahagi. Jangan persoal kalau ulama suruh Najib jemput PAS untuk bekerjasama atau anak ulama pakai Porsche sedangkan si sosialis Jeyakumar Sungai Siput jual AP dia untuk buat jambatan rakyat, jumpa UMNO dalam gelap dsbnya.  Yang penting wala'.

Dah jadi macam paderi2 katholik pulak stgh2 Ustaz dalam PAS (bukan semua) ni ye. Tidak boleh mempersoalkan tindakan mereka sama sekali.

JUNE 22 BLACK505: One moment in time for M’sians – last chance to stand up for themselves?

Whitney Houston’s song “One Moment in Time” perhaps best sums up the gargantuan momentum that is being showcased in the Blackout 505 rallies – with tiny Perlis being its latest ‘wow’ phenomena.

Up to this day, since the close of GE-13, we are witnessing the undeniable swelling crowds of tens of thousands at these rallies all throughout the country. Certainly there is a BIG picture taking root. And this, no force can rule out, suppress or even attempt to annihilate. And if they do, it will be at their own loss.

The spirit of the masses can best be alluded to in Whitney’s song:

Each day I live

 

I want to be

 

A day to give

 

The best of me

 

I’m only one

 

But not alone

 

My finest day

 

Is yet unknown

The citizens are emerging and converging all across the country – come pelting rain, or roaring thunderstorm, to express their hope for this nation. To miss out this BIG picture ‘meaning’ behind the gatherings is to deny citizens their rightful role in patriotism for King and nation.

I broke my heart

 

Fought every gain

 

To taste the sweet

 

I face the pain

 

I rise and fall

 

Yet through it all

 

This much remains

As they make the time to be out in droves when they could be huddled in the comforts of their homes, couched before the idiot box, it means sacrifice for the good of all citizens, king and nation. It means the kind of hope that Whitney tried to capture in the lyrics of her song:

I want one moment in time

 

When I’m more than I thought I could be

 

When all of my dreams are a heartbeat away

 

And the answers are all up to me

 

Give me one moment in time

 

When I’m racing with destiny

 

Then in that one moment of time

Yes, the Blackout 505 will have to be (not by maneuvered force but by volition) a full blown experience that must at some point culminate in crowning glory. In all likelihood, the mega-Blackout 505 planned for 22 June might just be the one significant moment – that “One Moment in Time”.

In fact the entire nation is already abuzz pregnant with hopeful talk from warongs to corporate corridors similar to the sentiments as captured in the song, i.e. When all of my dreams are a heartbeat away.

I’ve lived to be

 

The very best

 

I want it all

 

No time for less

 

I’ve laid the plans

 

Now lay the chance

 

Here in my hands

When you chat up with the people gathering at these rallies, you cannot miss that common thread of thinking and feeling that seems to draw each and every one of them out into the open – wearing some black on them, and standing up attention to sing the national anthem with such passion and magnetic connectivity. It appears to be a commitment to be a part of a future that they can all be proud of for generations to come – just like our forefathers who earned Merdeka for us.

But unfortunately there are still forces-that-be that cannot recognize that the people all across the country, cutting across race, religion and socio-economic class and age divides are converging with those sentiments as best expressed in Whitney’s lyrics:

Give me one moment in time

 

When I’m more than I thought I could be

 

When all of my dreams are a heartbeat away

 

And the answers are all up to me

 

Give me one moment in time

 

When I’m racing with destiny

 

Then in that one moment of time

However if the UMNO-BN party alliances want to be a part of that tidal wave and be also crowned as You’re a winner for a lifetime then they must race against time to seize that “One Moment in Time” if they too want to “Make it Shine”.

But let honesty prevail – can they be contrite enough to face up to it? However, it appears that the prince and politician, Tengku Razaleigh’s recent sojourn with the protesting BN MPs might just give UMNO lama that last saving grace.

Why?

Because as in that song One Moment in Time, the spirit of the people says it all very clearly:

When I’m more than I thought I could be

 

When all of my dreams are a heartbeat away

 

And the answers are all up to me

Yes, the BIG picture of the Blackout 505 rallies is all about being FREE – about freeing this nation from corrupt ways; about returning democracy in all its pristine glory untainted, beginning with clean and fair general elections; about returning to the Rulers their Constitutional glory and our loyalty uncompromised; about being a one nation for one people called Malaysians.

If the power brokers and their paid peddlers continue to see Blackout 505 as a threat and keep attempting to give it unwarranted labels like ‘security threat’, ‘opposition ploy’, ‘chaos’, ‘foreign agents’, ‘out to topple the government’ and the likes, then the Blackout 505 will only get tougher for the enemies of the citizens of this country.

A defining day

In a nutshell, Blackout 505 on 22 June 2013 is bound to be a defining phase for this nation. If we try to deny that reality, we are fools blinded by our own insecurities.

For certain, Malaysians are a peaceful lot, disciplined and able to bite the bullet when the situation demands. This has been proven time and time again throughout all the previous rallies involving tens of thousands of citizens congregating against all odds – be it imposed by man or nature.

It is no more a pre-election campaign fever. It is about honor, integrity and determination to make this nation a model for the region, an inspiration for the troubled world.

And so, Whitney Houston’s song One Moment in Time would serve most edifying for the doubters, skeptics, blinkered fools and of course for all those who are dead bent in continuing with the legacy of fast fading regimes around the world.

The “Anwar Rally”

What I found surprising about the Bersih 3 rally last year is that the crowd consisted of about 60% young people. Some maybe not even old enough to vote. But there they were, bangsa Malaysia. All 3 races fighting for a good cause, united in purpose.

It was the same at Kelana Jaya stadium last month. The crowd was huge but the unity was simply amazing. Old Chinese men lining up at the PAS booths to buy and then to wear Tshirts that said Hudud with a facebook styled “like” symbol. Young Chinese and Indian youth making head bands and capes out of PAS flags, young Malay guys waving DAP flags. It’s amazing the way the young have completely judged UMNO’s institutionalised racism as outdated and made a sincere effort to showcase it last night.

When Mat Sabu, Sivarasa, Tian Chua, Fauziah Salleh, Dr Michael Jeyakumar and all the other leaders of the Pakatan pact took the mike and after they said their short address, the crowd roared in approval.

When Lim Kit Siang took the mike, the roar of the crowd shook the air. I kid you not! I thought that was the best 50,000 humans could do. That is, until Anwar took the mike. I don’t think a popular rock star could enjoy such a high approval.

Look of guilt on Najib’s face

Anyway, the reason I’m writing this is to share what I learnt that night. Barisan National’s victories in 30 parliamentary seats are in question. Most of the stories we heard about blackouts are not true. But what actually happened that night is that the polling agents in the various stations were sending their numbers to the Pakatan operations center, who were then tallying up the numbers to determine the winner for each seat. Bu 11pm, the Pakatan portals were announcing that they had won.

But Bernama, Astro Awani and all the other TV stations were still reporting 40BN, 30DAP, PKR and PAS 2 each. This alone was an attempt at inciting some problem.

Something I’ll never forget is the look of guilt on Najib’s face when he took the mike after the EC’s Wan Ahmad announced that BN had obtained 112 seats. The look on the PM’s face and on those around him told us everything. They knew even at that time that all of Malaysia and the entire world would know that they cheated. Not one of them had the guts to look the camera in the eye. I suppose the thoughts running through their heads must have been images of Tunisia, Egypt, Thailand and all the other Govts that were recently overthrown after they cheated at the elections.

You could almost smell the gloom and heart break in the air all over the nation on the morning of the 6th of May. We expected BN to win and could only dream of a Pakatan victory. But as we watched the numbers come in, the joy was building up within. WE HAD WON!!! Tyranny was defeated by the people of Malaysia!!! Then, along comes Wan Ahmad.

Too much evidence to ignore

Many videos evidencing electoral fraud have been posted on Face Book and YouTube that stone walling and ignoring the outcry in the hope that it will go away is just too arrogant and is simply not going to work. I’ve seen videos of people being paid cash after voting, one of voters lining up to demand their pay after casting their vote, one of “phantoms” being escorted by Police to cast their vote after the crowd chased them away, and I’ve also seen one with EC officials picking up 2 ballot boxes from the road side while driving to the main counting center. And THIS, folks, is probably why the numbers counted at the polling center and numbers during the recount differ.

Does Najib really realise how much he has hurt us? Badawi had the same problem as Najib. Both PMs realised that the cheating, fraud, corruption, rent seeking, racism and the bullying of minorities had to end. And they asked the electorate for the mandate to make those changes. But both were unable to stop the rot. In fact the corruption and theft of public resources have gotten much worse under Najib. Creating MASSIVE fraud and then going to the people and humbly saying “Sorry lah, kami memang korup,” and then saying “Hey, heres $500…. Oh, and heres another $100 for books.” Didn’t work the way it was intended. Does Najib realise exactly why we were so very disappointed when they stole this election result from us?

Did we get our hopes up when he promised a lot of transform and reform? Were we shocked at how shallow his promises were when the corruption cases kept coming in? Were we surprised when the Pakatan MP’s periodically revealed more evidence of phantom voters in their constituencies? I admit though, that I was very happy when the EC finally agreed to implement the indelible ink to prevent people from voting more than once. But we know how that went. It’s not been 7 days, but I haven’t seen anyone with the ink still on. What I did see though is that 2 of the foreign banglas working at my place had the indelible ink on their indexes the next day. Even after bersih 2 and 3 under Najib’s watch, NOTHING changed!

So what made us sad is waking up on the 6th of March to the realisation that BN is here to stay. Another 5 years of being inundated with stories about Anwar Ibrahim’s sexual escapades. Of young men visiting Mekah to swear stuff. Another 5 years of pointless propaganda in the mainstream media, and producers of pornography in full gear.

Are we looking at another 5 years of stupid issues like some rectums going around trying to copyright the name of God? Will the churches be attacked and burned? will bibles be seized and desecrated ? Will new cases of multi billion ringgit corruption involving the Barisan National be reported every week in the alternative media? Will foreign media produce movies about the high level of corruption in Malaysia while the Govt locally makes promises after promises to “ACT?” Will we see another 1,500 suspects of crime dying while in custody? Will the Federal debt continue to skyrocket? In the 4 years under Najib, the Federal debt has doubled. Is he going to double it again? Will ALL the money stolen from the people of Malaysia ever be returned? Will BN leaders be allowed to perform acts of bitter provocation while young students be handcuffed and charged in court for stepping on pictures. Will we have to endure more incidents of political violence by young men?

Is Malaysia’s Bumiputra population going to double with more and more foreigners being given bumi citizenships? Will the illegal/illicit outflow of funds exceed 300 billion ringgit this year? Are we still going to remain the most corrupt nation on the face of the planet?

We rejected all of these when we cast our votes but we were outdone by electoral fraud. We have to stand behind Anwar Ibrahim this time and support his efforts to right this fraudulent electoral result. In the course of demanding re-elections in the 30 constituencies in question, some may fall back to BN and some may fall to PR while some judges may just throw them out.

Although Pakatan Rakyat’s chances of actually taking over the Govt is slim, we must by all means demand that the electoral rolls be cleaned up, or deleted and replaced with a new one, requiring every Malaysian to re register.

Wouldn’t that be a good place to start?

IPCMC & EAIC: Who Twisted?

Two days ago, I had written that Datuk Paul Low is sorely mistaken that the difference between EAIC and IPCMC is just in the name.  The difference between the two is clearly in their intent, with the former set up as a toothless tiger meant specifically as a cosmetic job to placate the public’s demand for an IPCMC, while pandering to strident objections of the police force.  The IPCMC on the other hand, was clearly an agency to check, discipline and inculcate greater professionalism in the police force.

Datuk Paul Low had pleaded victimisation immediately on 10th June, to express his “grave disappointment” at how his words have been “blatantly misrepresented for reasons best known only to Mr Tony Pua himself”.

“I fail to see how much clearer I can make it understood ...IPCMC and EAIC are only names, and what really matters is that we arrive at an independent agency that has the resources, clout and scope of influence to do the job effectively, now that the weaknesses of the existing EAIC had been more or less identified… Whether the name remains ‘EAIC’ at the end of the day… ‘EAICC’, ‘PEAIC’, etc… does it really matter? …Clearly, even a teenager would be able to conclude that my intention was never to equate the EAIC in its current form to that of the IPCMC proposed by the RCI in 2005,” he said.

So did I “blatantly misrepresent”  Paul Low’s words or his intent and as a result maligned him unfairly?

Let me remind him in his own words stated just less than 2 weeks ago on 30th May in his press conference.  Datuk Paul Low has actually stated in his own words that the “EAIC is actually the IPCMC”.  When asked if he meant that there was no need for an IPCMC with the existence of the EAIC by reporters, he specifically responded that “we already have the channel”.

Now this “teenager’s” question to him is, in the context of the above statements – did I misrepresent his words or did Datuk Paul Low twist his own words?

However, as pleaded by Datuk Paul Low himself, let me be constructive and give him the benefit of the doubt.

The point of my earlier statement was that the names of these institutions signifies and signals the intent of the Government.  And that is exactly the reason why the Government has stubbornly refused to set up an institution named “IPCMC”.  Otherwise, if it is all “just a name”, why not just change the Commission’s name from EAIC to IPCMC, and claim the moral victory of delivering what the rakyat is “crying out for”?

The RCI 2005 has even drafted a proposed IPCMC legislation which was substantively rejected by the BN Government.  The EAIC was emasculated to become essentially a “post-office” to refer cases back to the affected institution’s own disciplinary panels and committees, without any power to enforce punishment or recommendations on the guilty enforcement parties.

Datuk Paul Low has a simple position to take.  Incorporate all the recommendations made by the RCI proposal for the IPCMC into the EAIC, and Pakatan Rakyat will immediately concede that the EAIC can retain its name.  After all, to quote the Transparency Minister, it is “just a name”.

EAIC Will Deserve Praise If It Does Its Job

Enforcement Agency Integrity Commission (EAIC) chairperson Datuk Seri Heliliah Mohd Yusof claims the opposition will never admit it if a government agency does a good job. Datuk Seri Heliliah said this in response to criticism from me that the EAIC was “designed to fail” from the onset.

“Will the opposition praise any government body despite it being set up with heartfelt sincerity?” she asked.

Let me declare upfront that I will be the first to praise the Government if the Independent Police Complaints and Misconduct Commission (IPCMC) and bring to book all who are guilty of misconduct.  And this will certainly not be my first time doing so.

However, I’d like to ask the Chairperson of EAIC if she actually thinks that the Commission has delivered anywhere remotely close to what was promised?

In the past 3 years, the EAIC receive only a budget of RM7 million a year.  Today, it has only 1 investigating officer as part of a 23-man staff which include its clerks and drivers.

In terms of actual concrete actions taken since its formation in September 2011 and until the end of 2012, the EAIC had only recommended one disciplinary action and two warnings to civil servants.  In that sole case of disciplinary action, a complaint had been lodged against a police officer mid-last year for closing a case after three days.

Even in this relatively minor case of indiscipline, the EAIC CEO Nor Afizah Hanum Mokhtar admitted that she doesn’t know if the recommended disciplinary action of a demotion has actually been carried out by the Police.  This is despite the fact that within the EAIC law, the Police is required by law to feedback to EAIC on the actions taken on specific complaints and recommendations.

The fact that the Government isn’t serious, with only 1 investigating officer today to “look after” 19 government agencies. is proof of the intent for the entire exercise to fail.

The performance of EAIC is so dire, that Datuk Seri Helilah’s former colleague, former Chief Justice Abdul Hamid Mohamad had openly questioned the effectiveness of the EAIC.  Datuk Seri Helilah should perhaps be thankful that the ‘opposition’ hasn’t been more harsh in their criticism of the EAIC, perhaps its Commissioners being accused even of “sleeping on the job”.

Hence the opposition’s “criticisms” of the EAIC are entirely valid and should not be summarily dismissed by the EAIC as the chairperson did.  In fact, I would challenge the former Court of Appeal Judge, Datuk Seri Helilah to state unequivocally if the EAIC has actually served its purposed and has successfully met its founding objectives.

Audacious Armed Gang Robberies Brings Crime To New Low

Nearly 70 people were robbed at an open air steamboat restaurant in Cheras in the early hours of Saturday morning by a group of 10 persons armed with parangs and iron rods.  The shop owners and patrons lost more than RM20,000 and at least 2 of the customers were assaulted as a result of being too tardy with coughing up with their valuables.

In fact, it was reported that the Police have received four reports on such cases in Kuala Lumpur and another in Petaling Jaya in the past two weeks.  I also know as a matter of fact that there has been many of these cases occuring in various parts of Petaling Jaya commercial centres over the past 6 months, but these shops are fearful of unwanted publicity which may result in reprisals from the armed robbers.

The sheer audacity of these robberies have plunged Malaysia’s already bad crime situation to new depths.  We are not talking about an armed robbery of someone walking in a dark and isolated back street.  We are now seeing blatant armed robberies in crowded open restaurants.

As a result, the Royal Malaysian Police is being subjected to the triple crisis of confidence and credibility today.

Firstly the rise in crime and its aggressiveness has proven the Police failure in their most important task, that is to ensure that the man-on-the-street do not live in fear for their lives and property.

On Saturday, the Prime Minister Dato’ Seri Najib Razak just launched the “United Against Crime” campaign claiming that the effort to fight crime is “a war which needs commitment and continuous support from all levels of society to create a safe surrounding for the people”.

Bernama reported that in urging all strata of society to be united to combat crime, the Prime Minister called on the private sector, specifically owners of shopping centres, to upgrade the level of security at their premises such as installing more close circuit televisions and hiring more security guards.

While the above are supplementary acts which may help mitigate crime, the ultimate responsibility of fighting crime, such as these violent and outrageous open air restaurant robberies, can only be handled by the police.  The Prime Minister is surely not asking all Malaysians to stop eating outdoors, or all restaurants, big and small, to install CCTVs and hire security guards.  Or worse, that all Malaysians should stay at home in the evenings so that they will not be unfortunately robbed at eateries.

Secondly, the Police today are more interested in playing politics than fighting crime.  To quote the Member of Parliament for Lim Kit Siang, we now have the “most political IGP” in the nation’s history.  Over the past month since Tan Sri Khalid Abu Bakar’s appointment, Malaysians do not see any new real initiatives, breakthrough or success in the most important challenge of the police to make safety and security the top police priority.

Instead, we see the police under the IGP coming down hard on Pakatan Rakyat leaders and social activists, although public peace and order had not been undermined in any manner.  The IGP has instructed to police force to use and abuse the Peaceful Assembly Act and the Sedition Act to intimidate and clamp down on all political dissent.

And thirdly, after the 4th death in custody within 18 days under the watch of the new IGP, the professional reputation of the police force is in complete tatters.  The latest death involving a Japanese citizen in the lock up of USJ police station is also the 9th this year.  Essentially, this points to the fact that there has been no improvements at all since the recommendations made by the Royal Commission of Inquiry (RCI) on the Royal Malaysian Police in 2008.

These triple crises of confidence and credibility of the Malaysian Police puts on the spotlight on the Barisan Nasional government’s obstinate refusal to implement the key recommendation of the RCI report, that is the establishment of an Independent Police Complaints and Misconduct Commission (IPCMC).  The IPCMC is “aimed at dealing with complaints regarding the police, and seeking to improve the professionalism of the police force and to make certain that doctrines, laws, rules and procedures are observed and applied by the police”.

The blame rests squarely on the shoulders of the BN Government.  If BN would even dream of winning back support from the urban population in Malaysia in the next general election, then it must implement the IPCMC to prevent the further deterioration of the crime situation, the continued politicisation of the police force as the catspaw for BN and any additional loss of lives of those held in custody in the lock ups.

IPCMC and EAIC: More Than Just Names

In a statement related to a recent discussion Minister in Prime Minister’s Department, Datuk Paul Low held with the MIC, several NGOs and with the cabinet on the matter, he said the 'IPCMC' and 'EAIC "are only names".

Therefore he said that a "revamped" and "beefed up" Enforcement Agency Integrity Commission (EAIC) is a better option than starting a fresh commission like the Independent Police Complaints and Misconduct Commission (IPCMC).

The fact that the Government isn’t serious, with only 1 investigating officer today to “look after” 19 government agencies- the police force, the Immigration Department, the Customs Department, the Rela Corps, the National Anti-Drug Agency, the Malaysian Maritime Enforcement Agency, the Department of Environment, the Department of Occupational Safety and Health, the National Registration Department (NRD), the Department of Civil Aviation, the Road Transport Department (RTD), the Department of Industrial Relations, the Department of Fisheries, the Department of Wildlife and National Parks, the Manpower Department, the Health Ministry (Enforcement), the Tourism Ministry (Enforcement and Licensing units), the Domestic Trade, Co-operatives and Consumerism Ministry (Enforcement) and the Ministry of Urban Wellbeing, Housing and Local Government (Enforcement) – is proof of the intent for the entire exercise to fail.

Datuk Paul Low has added that "the cabinet more or less concluded that an extensive revamp and enlargement of the powers of the existing EAIC would be a better option than setting up a new IPCMC from scratch, as the latter would involve too much time to get up and running."  He said the three-year-old EAIC had taken two years to settle in due to "teething problems".

The abject failure of the EAIC is not due to “teething problems”.  It was because the BN Government has designed for it to fail.

In reality, what it means is that Datuk Paul Low has become just a mere spokesman to convey decisions made by the Cabinet.  It appears that he has lost all convictions in all the recommendations he has made to the Government while he as the President of Transparency International, where he was personally insistent that
“The implementation of the watereddown Independent Police Complaints and Misconduct Commission (IPCMC) to a Special Complaints Commission (SCC) indicates the inability of the government to regulate gatekeepers.  The IPCMC, which was the recommendation of the 2005 Royal Commission, was diluted after open revolt from the top brass of the Royal Malaysian Police.”
It is disappointing that since appointed the Transparency Minister, Datuk Paul Low has now reversed his earlier position to argue that the Special Complaints Commission in the form of the EAIC is now sufficient to regulate the enforcement authorities, particularly the Police force.

Now with the latest death of a 33 year old Japanese citizen in police custody yesterday, allegedly by hanging himself, it is the 4th death in police custody in 14 days, or the 9th in 2013.  How many more deaths will it take for the Cabinet to be convinced that an effective check and balance system is desperately required to ensure and regulate the professionalism of the police, as well as to bring the all the rogues in the force to book.

Dr Mahathir Redefines Racism

The UMNO DDD brigade, exposed by Member of Parliament of Gelang Patah, Lim Kit Siang has continued their non-stop inflammatory propaganda to cast the DAP as a racist party.  The DDD brigade led by none other than former Prime Minister, Dr Mahathir Mohamed has now claimed that the proof that DAP is a racist party is that the Chinese voters voted for them, and the Chinese turn out for the recent Pakatan Rakyat rallies are high.

This accusation must rank as among the biggest piece of gibberish coming from the 88 year old UMNO President.

When Malays vote overwhelmingly for UMNO in the past, it is never “racism”.  When a 100% Malay crowd hold weekly protests against the Pakatan Rakyat government in Penang, it is not “racism”.  When Chinese voted for MCA in the past, that can’t be racism.  When Chinese also voted strongly for PAS and PKR in the current elections, PAS and PKR are not accused of racism.

When Malays increased their support for the DAP candidates in the same election, Dr Mahathir accused DAP of spreading “propaganda” that influenced educated Malays into perceiving the Barisan Nasional (BN) government as corrupt.

However, when the Chinese also voted strongly for DAP, that is proof of DAP “racism”. When many Chinese turns up at Pakatan Rakyat events, that is beyond shadow of a doubt, Chinese “racism”.  What type of senile perverted logic is that?

Dr Mahathir and his DDD brigade should perhaps look up the dictionary on the definition of “racism”.  Racism is defined in Dictionary.com as “a belief… usually involving the idea that one's own race is superior and has the right to rule others” or “a policy, system of government, etc., based upon or fostering such a doctrine; discrimination”.

By the above definition alone, it is proof that the real racists of this country are UMNO, Dr Mahathir and his DDD brigade.  In fact the multi-million ringgit DDD brigade has via influential blogs and the UMNO mouthpiece, Utusan Malaysia completely rewrote the definition of “racism” to fit their own political objectives.  Their objectives are to brainwash Malays and Malaysians into believing “anti-racism” as “racism”, and “racism” as their birthright.

Where else in the world can you find a party like UMNO which calls for “ketuanan Melayu” or supremacy of the Malays as its sole raison d’etre being able to dispel all notions of its racism?  While at the same time, DAP, a party that fights only for equality of opportunities, justice regardless of race and religion as well as for free and fair elections, being demonised as the most racist entity in the world.

Just because we support the doctrine of “ketuanan rakyat” or the supremacy of the people, and oppose the doctrine of the supremacy of any single race, UMNO has since the end of last year made DAP their biggest enemy to ensure the survival and continuation of their racist policies. The concerted non-stop onslaught by the DDD brigade led by Dr Mahathir, funded with hundreds of millions of ringgit is resulting in DAP facing the single biggest fight of our political history.  Their objective is nothing less than the total demise of the DAP whether via de-registration by the Registrar of Societies, the imprisonment and disqualification of our leaders via the abuse of Sedition Act and other draconian laws, and the total rejection by Malays and Malaysians of DAP as a “racist” party it is not.

The DAP will stand firm on our principles and fight all racist attacks from UMNO and Barisan Nasional.  The leaders will stand on our principles without fear or favour and are prepared to suffer all injustices meted out by the UMNO regime to ensure that our future Malaysian generations will not be trapped in the racist framework we endure today.
